The Will of John Roffe

 

In the Name of God Amen I John Roffe of Chertsey in the County of Surrey Timber Merchant do make this my last Will and Testament as follows ffirst Recomend my Soul into the hands of Almighty God and my Body to the Earth to be buryed at the discretion of my dear and loving Daughter I dispose of what Temporal Estate Almighty God hath been pleased to bless me with as follows In the first place I give devise and bequeath to my Son in Law Samuel Gardiner Ten pounds of lawful Money of great Brittain to buy him Mourning I also give and devise unto my loving ffriends Richard Chapman of Chertsey in the County of Surry Gentleman and to John Smith of Lambeth in the County of Surry Gentleman and to their heirs and assigns All that my Messuage or Tenement Stables Outhouses Buildings Gardens and Orchards with the Appurtenances in Chertsey now in my own occupation In Trust nevertheless and to the intent and purpose that they permit my said Daughter to receive and tale the Interest and proffit thereof for her own sole and separate use until my Grandson John Gardener shall attain the age of one and twenty years and from and immediately after he shall have attained that age & Then in Trust and to and for the only use and behoof of my said Grandson John Gardiner his heirs and assigns for ever and in case my said Grandson John Gardiner shall dye before he shall attain the age of one and twenty years then to permit and suffer my said Daughter to receive the Rents Issues and proffitts thereof to her own sole and separate use during the Joint lives of my said Daughter and her husband and from and after the death of my said Son in Law then to and for the only use and behoofe of my said Daughter her heirs and assigns for ever I also give and bequeath to the said Richard Chapman and John Smith one Guinea apiece to buy each of them a Ring I also give and bequeath to my two said ffriends Richard Chapman and John Smith all the rest and residue of my Goods Chattells and personal Estate whatsoever To the intent and purpose they may with all convenient speed convert the same into Money and thereout in the first place pay off and discharge my just debts ffuneral Expences and Legacys and in Trust that they the said Richard Chapman and John Smith their Executors and Administrators may from time to time and at all times dureing the joint lives of my said son and Daughter put place out and keep at Interest on the best securitys that may be gotten for the same what Moneys shall remain in their Hands after such payments shall have been made as aforesaid and to permit my said Daughter to receive the Interest and proffitts thereof to her own separate use and from and after the decease of my said son in Law in case he shall dye in the lifetime of my said Daughter then to pay the whole principal and Interest to my said Daughter and in case my said Daughter shall dye in the life time of her said husband then my Will is that the said principal and Interest to go and be paid to my Grandchildren John Gardiner Samuel Gardener Daniel Gardiner Mary Gardiner and Elizabeth Gardiner equally between them share and share alike my Will also is that if any Money shall chance to be lost by my said Trustees without their Wilful Neglect or default that my Trustees should not be answerable to make good the same my Will also is that my said Trustees be at liberty to deduct out my Moneys that shall come unto their Hands by virtue of this Trust their reasonable and necessary charges and Expences and my Will also is that my Daughter may be at liberty to deteyne for her own use any part of my Household Goods or ffurniture of which she shall make choice I do hereby make nominate constitute and appoint my said ffriends Richard Chapman and John Smith Executors of this my last Will and Testament and hereby Revoak all other Wills In Witness whereof I have to this my last Will and Testament sett my Hand and seal the ffirst day of December in the year of our Lord one Thousand seven hundred and forty     Jn Roffe
