The Will of Thomas Robinson

 

In the Name of God Amen I THOMAS ROBINSON of the Parish of North Nibley in the County of Gloucester Yeoman do hereby make publish and declare this to be my last Will and Testament as follows And First I give and devise unto my daughter MARY BATMAN widow All That messuage or tenement where she now dwells and also the small messuage or tenement thereto adjoining together with the gardens outlets and appurtenances to the said two messuages or tenements belonging all which are situate and being in the Parish of Horsley in the County of Gloucester aforesaid To Hold to her my said daughter MARY BATMAN and her assigns for and during the term of her natural life and from and after her decease I give and devise the same and every part thereof unto her son and my grandson GEORGE BATMAN his heirs and assigns for ever Also I give and devise unto her my said daughter MARY BATMAN all that messuage or tenement (late Tainton’s) also situate and being in the Parish of Horsley as aforesaid wherein  (blank space)  doth now dwell together with the garden outlet and appurtenances thereto belonging To Hold to her my said daughter MARY BATMAN and her assigns for and during the term of her natural life and from and after her decease I give and devise the same and every part thereof unto her son and my grandson JOHN BATMAN his heirs and assigns for ever Then I give and devise unto her my said daughter MARY BATMAN all that messuage or tenement (late Lockier’s) situate and being at or near Harley Wood in the Parish of Horsley aforesaid and wherein JOHN WINDOW doth now dwell together with the garden outlet and appurtenances thereto belonging To Hold to her my said daughter MARY BATMAN and her assigns for and during the term of her natural life and from and after her decease I Give and devise the same and every part thereof unto her son and my grandson THOMAS BATMAN his heirs and assigns forever Then I give and devise unto my daughter BETTY the wife of JOHN MINCHIN of the Parish of Horsley aforesaid Wheelwright all those my two messuages or tenements (late White’s) situate lying and being in the Parish of Horsley aforesaid wherein JOHN SMITH and BETTY COOK do now severally inhabit together with the gardens outlets and appurtenances to such two messuages or tenements belonging,, one of which said messuages or tenements is commonly called or known by the name of “The Great House” To Hold to her my said daughter BETTY and her assigns for and during the term of her natural life and from and after her decease I Give and devise the messuage or tenement wherein the said JOHN SMITH doth now dwell called “The Great House” and the outlet garden and appurtenances thereto belonging unto her son and my grandson JOHN MINCHIN his heirs and assigns for ever And from and after the decease of the said BETTY MINCHIN I give and devise the other messuage or tenement wherein the said BETTY COOK (Page 2) doth now dwell and the outlet garden and appurtenances thereto belonging unto her daughter and my granddaughter ELIZABETH otherwise BETTY MINCHIN her heirs and assigns for ever And Whereas there is a considerable sum of money due to me on mortgage of a messuage or tenement garden and premises where in one NATHANIEL TEAKLE now lives situate at or near Harley Wood in the Parish of Horsley aforesaid, which said messuage or tenement now doth or lately did belong to one DANIEL YOUNG and I have taken possession of the farm for the better securing the repayment of the principal and interest money due to me thereon, but no conveyance of the equity or redemption of the said premises has ever yet been made to me Now I do hereby give such messuage or tenement garden and premises or such estate and interest as I have therein unto her my said daughter BETTY the wife of the said JOHN MINCHIN and her assigns for and during the term of her natural life and from and after her decease I give and devise the said messuage or tenement garden and premises of such estate and interest as I may then have therein, unto her son and my grandson THOMAS MINCHIN his heirs executors administrators and assigns as and for his and their own absolute property: But in case the said DANIEL YOUNG or his heirs or such other person or persons who may be entitled to the equity of redemption of the said premises shall at any time after my decease think fit to pay off such principal and interest as my be due to me thereon Then and in such case I direct that such principal and interest shall be paid by the person or persons entitled to such equity of redemption to STEPHEN RUDGE in the Parish of Slimbridge in the County of Gloucester aforesaid Baker and JAMES SPARKES of the Parish of North Nibley aforesaid Yeoman (who I do hereby appoint to be Trustees of this my will) or to the survivor of them or the executors or administrators of such survivor upon trust to be by them the said STEPHEN RUDGE and JAMES SPARKES or the survivor of them or the executors or administrators of such survivor put and placed out at interest either in the funds or upon such securities or security as they shall approve And upon this further trust that they do and shall pay the interest thereof to my said daughter BETTY the wife of the said JOHN MINCHIN for her life and after her decease upon trust that they do and shall pay the principal money (whatsoever the amount thereof maybe) unto her for and my grandson THOMAS MINCHIN to whom I give and devise the same as and for his own absolute property And Whereas I have lent Twenty Pounds to one EDWARD WORKMAN on mortgage of a messuage or tenement garden and premises in the Parish of Stinchcombe in the County of Gloucester Now I do hereby give such Twenty Pounds so due to me from the said EDWARD WORKMAN and all such interest as may happen to be due thereon at the time of my decease unto my granddaughter ELIZABETH otherwise BETTY WORKMAN as and for her own absolute property (Page 3) And Whereas I have lent the sum of Thirty Five Pounds upon mortgage of a messuage or tenement garden and premises (late Wall’s) situate at Nailsworth in the Parish of Horsley aforesaid Now I do hereby give such Thirty Five Pounds to my said trustees the said STEPHEN RUDGE and JAMES SPARKES upon trust that they or the survivor of them or the executors administrators of such survivor do and shall either call in the farm and place it out again or else continue it at interest upon the same security as to them or the survivor of them or the executor or administrators of such survivor shall seem best And upon trust that they do and shall pay the interest thereof equally between my two granddaughters RACHAEL and HANNAH ROBINSON (Daughters of my son JOHN ROBINSON deceased) until they shall attain their ages of Twenty One years as for and towards finding them clothes and when and as soon as they the said RACHEL and HANNAH shall attain their said ages of Twenty One years Then I give them the said Thirty Five Pounds equally to be divided between them, but if either of them the said RACHEL and HANNAH shall happen to die under the age of Twenty One years Then I give the whole of the said Thirty Five Pounds and the interest thereof to the survivor of them as and for such survivor’s own absolute property: And I do hereby direct that the receipt and receipts of the said RACHEL and HANNAH ROBINSON for their respective parts of the interest of such Thirty Five Pounds shall (notwithstanding their non age) be from time to time good and sufficient discharges to my said trustees for the same. Then I give and devise unto my son MATTHEW ROBINSON all that messuage or tenement wherein I now dwell and the outhouses outlet garden close of ground called The Little Ground and Wood thereto belonging (all late Lewton’s) situate in the parish of North Nibley aforesaid To hold to him my said son MATTHEW ROBINSON and his assigns for and during the term of his natural life (he keeping the premises in tenantable repair, but cutting no timber whatsoever, nor committing any other waste on the said premises or any part thereof) And from and after his decease I give and devise the said messuage or tenement outhouses outlet garden close called The Little Ground and Wood and every part thereof unto my granddaughter HESTER ROBINSON (Daughter of my said son MATTHEW ROBINSON) and to her heirs and assigns forever Then I give the sum of Nineteen Pounds that is now due to me on mortgage of a messuage or tenement and premises belonging to PETER PROUT in the Parish of Horsley aforesaid unto my said trustees the said STEPHEN RUDGE and JAMES SPARKES upon trust that they (Page 4) or the survivor of them or the executor or administrators of such survivor do and shall either call in the same and place it out again or else continue it at interest upon the same security as to them or the survivor of them or the executors or administrators of such survivor shall seem best And upon trust that they do and shall pay the interest thereof equally between my two granddaughters HANNAH and ANN ROBINSON (daughters of my son MATTHEW ROBINSON) until they shall attain their ages of Twenty One years as for and towards finding them clothes and when and as soon as they the said HANNAH and ANN shall attain their said ages of Twenty One years Then I give the said Nineteen Pounds equally to be divided between them, but if either of them the said HANNAH and ANN shall happen to die under the age of Twenty One years Then I give the whole of the said Nineteen Pounds and the interest thereof to the survivor of them as and for such survivor’s own absolute property: And I do hereby direct that the receipt and receipts of the said HANNAH and ANN ROBINSON for their respective parts of the interest of such Nineteen Pounds shall (notwithstanding their non age) be from time to time good and sufficient discharges to my said trustees for the same. Then I give and bequeath to my said son MATTHEW ROBINSON as and for his own absolute property all the principal money and interest that is now or may hereafter become due to me on mortgage of a messuage or tenement now or lately belonging to PLEASANT KNIGHT and wherein WILLIAM KAINTON doth now dwell situate and being at or near Ginfield in the Parish of Uley in the County of Gloucester aforesaid Then I give to my eldest son THOMAS ROBINSON the sum of Two Shillings and Sixpence to be paid to him by my executrix hereinafter named in one month after my decease Then I give to my granddaughter HESTER ROBINSON (daughter of my said son MATTHEW ROBINSON) my eight day clock, my best bed, bedstead and all the linen and other things to such bed and bedstead belonging And also my corner cupboard, my best oval table, my great chest and my warming pan and swing looking glass, all of which I direct shall be delivered to her father for her benefit within one month next after my decease Then  I give to my daughter HANNAH all the pewter, which was late her mother’s, and the residue of my pewter I give to my granddaughters HESTER, HANNAH and ANN ROBINSON daughters of my son MATTHEW ROBINSON) equally to be divided between them share and share alike Then I give to my granddaughter HANNAH ROBINSON (daughter of my said son MATTHEW ROBINSON) my clock that stands in the kitchen Then I give to my said daughter MARY BATMAN my second best bed, bedstead and all the linen and (Page 5) other things to such bed and bedstead belonging Then I give to my son MATTHEW ROBINSON my third best bed, bedstead and all the linen and other things to such bed and bedstead belonging Then all the rest and residue of my personal estate and effects of what nature or kind soever or wheresoever I give and bequeath the same and every part thereof unto my daughter HANNAH the wife of the said STEPHEN RUDGE as and for her own absolute property she paying thereout my just debts, funeral expenses and the charges of proving this my will And Lastly I do hereby nominate and appoint her my said daughter HANNAH, the wife of the said STEPHEN RUDGE, to be the whole and sole executrix of this my last Will and Testament, hereby revoking and making void all former Wills and Testaments by me made In Witness whereof I the said THOMAS ROBINSON the testator have to this my last Will and Testament contained in this and the four preceding sheets of paper, to which four preceding sheets I have set my hand and to this fifth and last sheet my hand and seal this Thirteenth day of November in the year of Our Lord One Thousand Seven Hundred and Ninety Seven.
