This is the last Will of me Thomas Rippington
of fforesthill in the County of Oxford Gent being of sound &
disposing mind memory & understanding praised be God I give & devise
unto my Dear Wife Rebecca All that my Messuage or Tenement situate &
being in fforresthill aforesaid now in my occupation with the
Buildings Gardens & Appurts thereto belonging & also all that
Messuage or Tenement now divided into three Tenements formerly a
Public house called or known by the Name or Sign of the Bull with
the Buildings Gardens & Appurts thereto belonging thereto belonging
situate & being in Wheatley in the said County of Oxford now in the
occupation of John Clarke & others To hold unto her my said Wife &
her assigns for & during the term of her natural life & from &
immediately after her decease I give & devise the said Messuage or
Tenement & premises at fforresthill aforesaid unto my Nephew Richard
Rippington of Marston in the said County of Oxford ffarmer Eldest
Son of my late Brother Richard Rippington deceased his Heirs &
Assigns for ever & from & after the decease of my said Wife I give &
devise the said Messuage or Tenement or Public house & premises in
Wheatley aforesaid unto my Nephew John Rippington Eldest Son of my
Brother John Rippington of Thumbley in the Parish of Waterperry in
the said County of Oxford Salesman his Heirs & Assigns for ever I
give unto my Brother the said John Rippington my friend Thomas
Spiers of Thame in the said County of Oxford Gentleman & my said
Wife Rebecca All my Household Goods Implements & Utensils of
Household whatsoever Plate Linen & China to the Intent that my said
Wife should have the use thereof during her natural life & from &
after her decease I give & bequeath the same unto my Nephew the said
Richard Rippington & to William Thomas John Jeremiah Mary Martha &
Ann the other Sons & Daurs of my said Brother Richard Rippington &
my Nephews the said John Rippington Richard Henry & George the Sons
of my said Brother John Rippington to be equally divided between
them Share & Share alike I give & bequeath unto my Brother the said
John Rippington & to the said Thomas Spiers All my Money &
Securities for Money debts to me owing & all other the rest residue
& remainder of my Personal Estate & Effects whatsoever & wheresoever
& of what nature or kind soever the same may be at the time of my
decease upon the Trusts & for the Purposes hereinafter mentioned
that is to say In trust in the first place to collect & call in the
same & thereout to pay satisfy & discharge all my ffuneral &
Testamentary Expences & all such Debts as I shall owe at the time of
my decease & after payment thereof & subject thereto to stand
possessed of & in the Residue arising from my said Personal Estate
In Trust that they my said Trustees or the Survivors of them his
Exors & Admors do & shall invest the same in their or his Name or
Names in the Public ffunds Parliamentary Stocks or upon any real or
Government Securities or & in Great Britain at Interest & do & shall
pay & apply the dividends Produce & Interest thereof & every part
thereof for my said Wife for & during the term of her natural life &
from & immediately after the decease of my said Wife upon trust that
they my said Trustees or the Survivor of them his Exors & Admors do
& shall pay assign & transfer the said Trust Monies & every part
thereof unto & amongst my said Nephews & Nieces the said Richard
William Thomas John Jeremiah Mary Martha & Ann the Sons & Daurs of
my said Brother Richard Rippington & to John Richard Henry & George
the Sons of my said Brother John Rippington in equal Shares &
Proportions & to be paid assigned & transferred to each of them as
shall have attained his or her Age or respective Ages of twenty one
years at the time of the death of my said Wife immediately after her
decease & to such of them as shall then be Minors or a Minor when &
as soon he she or they shall attain the Age of twenty one Years
respectively But in case any one or more of my said Nephews & Nieces
shall happen to depart this life under the Age of twenty one Years
leaving lawful Issue then upon trust that they my said Trustees &
the Survivor of them his Exors & Admors do & shall pay assign &
transfer the part & share or parts & shares of him her or them so
dying & leaving Issue & also all such other parts & shares which
might or would have accrued or come to such Child or Children by
Survivorship if living unto the Issue of him her or them so dying &
leaving Issue as aforesaid in equal shares & Proportions if more
than one & if but one to such one or to his or her respective Exors
or Admors & to be paid assigned or transferred to them respectively
at such time or times as the same would have been paid assigned or
transferred to their respective ffather or Mother if living But if
any one or more of my said Nephews & Nieces shall depart this life
under the Age of twenty one Years without leaving such Issue as
aforesaid him her or them surviving then & in such case upon trust
that they my said Trustees & the Survivor of them his Exors & Admors
shall & do pay assign & transfer the part & share or parts & shares
of him her or them so dying & also all such other parts & shares
which might or would have come to him her or them under & by virtue
of this my Will by Survivorship unto the Survivors or Survivor of my
said Nephews & Nieces who shall live to attain the Age of twenty one
Years & the lawful Issue of such of them as shall die under such Age
in equal parts & shares & proportions if more than one (such Issue
nevertheless standing in the place of & taking only the part or
share parts and shares which his her or their parent or parents
would have taken or been entitled to if living) provided always & my
Will and meaning is that it shall be lawful to & for my said
Trustees & the Survivor of them his Exors & Admors to alter transfer
& change any ffunds or Securities upon which all or any part of the
said Trust Money shall be placed or invested for or to other ffunds
or Securities of the like nature when & so often it shall appear to
him or them proper & advisable to do And I do hereby nominate
constitute & appoint my said Brother John Rippington & the said
Thomas Spiers Exors of this my last Will and I do here expressly
declare that they my said Trustees & Exors & the Survivor of them
his Exors & Admors shall not be charged & chargeable with or
accountable for more of the said Trust Monies or the Dividends
Interest & Produce thereof than he or they shall respectively
actually receive nor with or for any Loss which may happen thereto
or to any part thereof if such Loss happen without his or their
wilful default neglect or collusion & that the one of them shall not
be answerable or accountable for the other or others of them or for
the Acts Deeds Defaults Receipts or Disbursements of the other or
others of them the joining in any Receipt or Receipts for conformity
notwithstanding but each of them for the Acts Deeds Defaults
Receipts or Disbursements of himself only & that it shall be lawful
for him & them in the first place out of the said Trust Monies to
deduct & reimburse himself & themselves respectively all such Loss
Costs Charges & Expences as he or they shall sustain or expend or be
put unto by reason of the performance of this my Will or the Trusts
hereby reposed & I do hereby revoke all former & other Wills by me
at any time heretofore made all former & other Wills by me at any
time heretofore made & declare this to be my last Will & Testament
only In Witness whereof I the said Thomas Rippington the testator
have to this my last Will & Testament contained in three Sheets of
Paper to each Sheet thereof set my hand & Seal the fifth day of
April in the Year of our Lord 1809 Thos Rippington
