In
the name of God Amen the twenty fifth day of January in the year of
our Lord God one thousand seven hundred and twentynine I Richard
Reynolds of Burscough in the county of Lancs, yeoman, knowing the
uncertainty of this transitory life and being desirous to set peace
& unity amongst my wife and children after my decease Do make and
publish this my last will and testament in manner and form as
followeth.
Imprimus it is my will and mind that my debts, funeral expenses and
the charges of the probate of this my last will and testament be
taken and paid out and forth of all my goods and personal estate and
wheras I am lawfully possessed and seized of several messuages and
tenements and leasehold estates situate lying and being in Burscough
aforesaid which I hold by several indentures of lease under the
Right Hon James Earl of Derby and as touching and concerning the
same my will and mind is that my Executors hereof hold all the same
for the terms of such years until such a time as by the clear rent?
ssour? and profits there from arising shall amount to so much money
as will pay for the fine and the filling up of the lease that
belongeth to that estate where I now dwell And also as in case as
there be occasion of fineing and that little estate which James
Scarisbrick now farmeth under me happen to come and be holden by one
life That then my executors hereof contine to hold all the aforesaid
leasehold estates for the raising of such a sum of money as will
discharge for the rerrowing? of that lease belonging to that estate
which James Scarisbrick now farmeth under me which estate I do give
direct and order for my beloved wife Mary Reynolds to hold to her
for and during her natural life Then and at after her decease I do
give all the same unto my son John Reynolds his heirs executors
nominates and all his assigns withall the right title and interest
in the same to hold to him the said John Reynolds his heirs
executors nominates and all his assignsfor during the remainder of
all the time and term then to come or as remains unexpired in any
term and estate thereof.
Item it is my will and mind that at after such money is raised for
fineing as aforesaid Then I do give all that my other messuage and
tenement and leasehold estate with all its appurtenances where I now
dwell unto my said son John Reynolds his heirs executors
administrators and all his assigns for and during all the remainder
of all the time and term then to come or as remains unexpired in any
term and estate thereof neverthe less subject charged and chargeable
with the true payment of the sum of one hundred and twenty pounds
current money which I do give direct and order for to be paid unto
my daughter Margaret Reynolds when she shall attaine to and come of
the full age of twenty and one years old
Item I do give all that my other messuage and tenement and
leasehoild estate situate lying and being within Higgins Lane where
Elizabeth Wainwright widow now farmeth under me unto my daughter
Jane Reynolds her heirs executors nominates and all her assigns for
and during all the remainder of all the time and term then to come
or as remains unexpired in any term and estate thereof and for to
possess and enter upon the same if the sums of money beraised for
the user aforesaid When shee doth attain to and come of the full age
of twenty and one years old and not before. And it is my further
will and mind that if my son John Reynolds happen to die before he
doth come of the age of twenty and one years old that then and in
such a case my daughter Jane Reynolds her heirs executors nominates
and assigns for to have all that which was given unto my said son
John Reynolds as aforesaid excepting that estate where James
Scarisbrick now farmeth under me which shall go and go equall
between my two daughters and my daughter Margaret Reynolds for to
have Higgins Lane leasehold estate and the half of the other as
aforesaid and my daughter Jane Reynolds for to have that where I now
dwell and the other half of that mentioned as aforesaid.
Item it is my further will and mind that my wife and my childrenn
have their maintenance out of my leasehold estate while the
aforesaid money is in raising and and that my wife have the tuition
and management of my children if she keep herself sole chaste and
unmarried but if she happen to remarry or miscarry at after my
decease that then and in such a case it is my will and mind that my
executors hereof take my children from her and have the tuition and
management thereof. And it is my further will and mind that if my
son John Reynolds happen for to marry before he come of the age of
twenty one years or at any age whatsoever within the term of his
lifetime and have lawfull issue that then and in such a case for
want of him for such issue or child or children for to have all that
which was given to my said son John Reynolds.
Item it is my will and mind and I do give unto my daugter Margaret
Reynolds her heirs and assigns all that close of moss ground which I
purchased of William Wallas And lastly I do hereby constitute ordain
and make my brother John Reynolds, John Fazackerly and Edward
Peterson executors of this my last will and testament hoping that
they will see this truly performed as my trust is in them reposed In
witness whereof I the said Richard Reynolds the testator have
hereunto set and put my hand and seal the day and year first above
written.
