In the name of God Amen the fifth day of May
one thousand seven hundred and thirty eight I Thomas Prescot of
Scarisbrick in the county of Lancaster linen weaver being weak in
body but of perfect disposeing mind and memory thanks be given to
unto almighty god for the same and, calling unto mind the mortality
of my body and knowing it is appointed for all men once to dye doe
make and ordain this my last will and testament
first of all I give and recommend my soul into
the hands of god that gave [it] and my body I recommend to the earth
to be buried in decent Christian burial at the discretion of my
Executors hereafter named and as touching such worldly estate as it
hath pleased god to bless me in this life I give devise and dispose
of the same in manner and form following
first it is my will and mind that all my just
debts funeral expenses and the probate hereof be paid out of my
personal estate
also I give and dispose to my daughter Mary
Prescot a hundred pounds to be paid to her at twelve months end
after my decease
as to all the rest residue and remainder of my
personal estate bills bonds ready money and all my household goods
brass pewter and beding beast horse corn hay and all other things
that belongs to my personal estate I give and bequeath to my wife
Mary while she lives---
and whereas [I] stand possessed of a freehold
estate of tenement that I hold from Robt Scarisbrick of Scarisbrick
Esqr wherein there is now three lives in being I give & dispose of
the same in manner and form following first I give and dispose of
the same estate of tenement to my dear and loving wife Mary during
her natural life and no longer but if my said wife Mary happen to be
with child at my decease I give and dispose of the same estate of
tenement after my wife Mary decease to the said child or children
during the indenture of lease but provided my wife happen not to
have a child in fourty weeks time after my decease I give and
dispose of the same tenement after my wife Marys decease to my
daughter Mary Prescot and her heirs during the Indenture of lease
further it is my will and mind that the house
that I hold by virtue of lease as aforesaid that if my wife Mary
renew the said lease and add her own life that the said lease be not
taken to frustrate or make void my said will and Testament but that
it goe to the persons as before mentioned during the new Indenture
of lease
also it is my further will and mind that the
household goods brass pewter and beding and all my household goods
that I have given to my wife Mary during her life after decease I
give and dispose of the same household goods to my child or children
if Mary my now wife happen to have any within fourty week after my
decease and for want of such issue I give and dispose of the
household goods brass pewter and beding to my daughter Mary Prescot
at my wifes decease
lastly I nominate constitute and appoint my
dear and loving wife Mary and my friend John Barton of Birsker my
Executors of this my last will and testament hopeing they will
perform the same of my great trust is in them reposd and I doe
revoke disanul and make void all former and other will and wills by
me heretofore made
