The Will of Thomas Poynter

 

In the Name of God Amen I Thomas Poynter of Stanford in the Vale in the County of Berks Yeoman do make this my last Will and Testament whereby after humbly Surrendering my Soul into the hands of Almighty God whensoever it shall please him to take me out of this mortall life, And my body to the Earth to be decently buried I dispose of my Worldly Estate as followeth, (that is to say) Imprimis I give devise & bequeath unto Avery Tyrrell of Stanford aforesaid Gent William Shilton the Younger of the Same place, Yeoman and John Collins of Stanford aforesd Yeoman and to their Heirs for ever. All those my Six Acres of Arable Land lying dispersedly in the Comon ffields of Stanford aforesaid formerly purchased of one Thomas Alder. And all those my Nine Acres of Arable Land lying dispersedly in the Comon ffields of Stanford aforesaid which I purchased of Mr Edward Jennings with their and every of their rights members & Appurts To hold to them the said Avery Tyrrell William Shilton and John Collins and to their Heirs for ever Upon the trusts following (that is to Say) To pay the Sume of Thirty Shillings a year to my Son Thomas Poynter during his Natural life, by four quarterly payments in the year without any deduction whatsoever The first payment thereof to begin & to be made on the ffeast Day of St Michael the Archangel which shall be in the year of our Lord One Thousand Seven Hundred and Thirty Six, if I shall happen to dye before that time. But if I shall happen to Live till after that time , Then the first Payment thereof shall begin and be made at the first Quarter day next Coming after my decease, And upon the further Trust to pay the sume of Three pounds a year unto John Hester the younger of Stanford aforesaid Taylor the Husband of my Daughter Elizabeth for & during the term of his Natural life, in Case he shall Live and Cohabit with his said Wife but not otherwise And upon this further trust and Confidence to pay Apply & dispose of the residue of the Rents & Profits of the said Lands & premises towards the Support & Maintenance of my said Daughter Elizabeth and her Children during the life of my said Daughter, but so as the same shall not be Subject to or Liable to the Disposal or Intermeddling of her said Husband And I do hereby declare that the receipt of my said Daughter for any sume or sumes of money to be paid to her by my said Trustees or either of them shall be a sufficient discharge for the same And from and after the decease of my said Daughter Then upon trust for Margaret the Daughter of my said Daughter Elizabeth and the Heirs of her body Lawfully Issuing she & they paying thereout the yearly sum of Twenty Shillings to my grandson John Hester son of my said Daughter Elizabeth dureing his life And also the other Annuities herein before appointed to be paid And for want of Issue of the said Margaret Then in trust for my said Grandson John Hester and the Heirs of his & his Heirs body And for want of such Issues And in Case my said son Thomas shall be then liveing Then in trust for my said son Thomas Poynter & his Heirs And for want of such Issues Then in trust for Christian my Daughter (the Wife of William Woodley of East Hendred in the said County of Berks yeoman and the heirs of her Body And for want of such Issue In trust for my own right Heirs for ever And my mind and will is And I do hereby declare that in case my said son Thomas or my said Son in Law John Hester shall be troublesome & go to Law with my said Trustees or the Acting Person or Persons of them for any thing Contrary to the true meaning of this my Will That then the yearly sume of him or them so doing the same shall utterly Cease & determine and he or they shall from thenceforth be utterly debarred & Excluded from haveing any right or Title thereunto And in such Case the same shall be paid and applied for & towards the further Maintenance of my sd Daughter Elizabeth & and her said Children And my mind & will is That my said Trustees shall not be answerable the one for the other Nor for the Acts receipts or paymts of the other of them And that they shall deduct out of their said Trust Estate all such Costs Damages & reasonable Expences as they or any of them Shall sustain or be put unto for and upon Account of their said Trust And my will & mind further is that in case the said John Hester shall at any time Live from his said Wife and family Then I do hereby Appoint That my said Trustees shall apply his said Three Pounds a Year towards the further Maintenance of my said Daughter Elizabeth & her Children for so long time as they shall so live apart Item all my Goods Chattles money & personal Estate of what nature or kind soever I do give & bequeath unto my Loveing Wife Christian Poynter whom I do hereby make the Sole Executrix of this my will (hereby revokeing all former wills by me at any time made And I do appoint this to be my only Last Will and Testament In Witness whereof I the said Thomas Poynter have hereunto set my hand & seal (that is to say) to each of the two sheets of paper wherein this my Will in Contained I have set my hand & seal the Thirteenth day of June in the year of Our Lord One Thousand Seven hundred & Thirty two Thomas Poynter
