The Will of Samuel Potter

 

This is the last Will and Testament of me Samuel Potter of Ilkeston Park in the County of Derby Gentleman I direct all my just debts funeral and testamentary expences be fully paid and satisfied by my Executors as soon as conveniently may be after my decease I give devise and bequeath unto my sons Samuel Potter and Philip Potter their heirs executors administrators and assigns in equal shares as Tenants in common all my real estates lands messuages and hereditaments both freehold and copyhold of whatsoever tenure and wheresoever situate subject nevertheless to the payment of the sum of four thousand pounds to my daughter Sarah the wife of George Blake Norman to be a vested legacy immediately on my decease and to be paid by the said Samuel Potter and Philip Potter within eight years from the time of my decease by instalments of not less than five hundred pounds a year but I direct interest to be paid by them on the said legacy commencing immediately on my decease at four per cent per annum until the whole amount of the said legacy has been paid I give devise and bequeath unto my said son Philip Potter for his own absolute use and benefit all the household furniture plate linen china books and other goods in the house I now reside in and it is my will that he immediately on my decease take possession of the house I now reside in and also the farm attached thereto with the approbation of my Landlord His Grace the Duke of Rutland all the rest residue and remainder of my real and Personal Estate not herein devised or bequeathed which I may die possessed of or entitled to at the time of my decease I give devise and bequeath unto my said sons Samuel Potter and Philip Potter their heirs executors administrators and assigns in equal shares and proportions as Tenants in Common and I declare that the provisions and gifts I have made and bestowed on my said sons and my said daughter shall not in any manner interfere with the construction of this my Will or be taken into account in relation thereto or noticed in any way whatsoever I nominate constitute and appoint the said Samuel Potter and Philip Potter and Samuel Potter of Elmsley Lodge in the County of Nottingham ffarmers Executors and Trustees of this my Will to whom I give devise and bequeath all estates now vested in me as trustee or mortgagee subject to the trusts and equities affecting the same and whom I empower to execute such conveyances of the legal estate of the mortgaged hereditaments as the nature of the case shall require and I hereby declare and direct that the receipt of the said Samuel Potter Philip Potter and Samuel Potter of Elmsley Lodge aforesaid and the survivor of them his heirs and their heirs and assigns shall be a discharge for all monies which in such receipt shall be expressed to be received and that all persons paying any moneys to my sons trustees or the survivor of them or their assigns for the purpose of this my Will and taking a receipt from him or them accordingly shall not be obliged to the application of the same monies nor be answerable for the misapplication thereof I direct that my said trustees shall retain and allow each other all expences which any of them may incur or be put unto in or about the execution of this my Will In witness whereof I have to this and the preceding sheet of this my Will hereunto set my hand this thirteenth day of January in the Year of our Lord one thousand eight hundred and fifty four Saml Potter

This is a Codicil to the last Will and Testament of me Samuel Potter of Ilkeston Park in the County of Derby Esquire Whereas it was my intention to have presented to my son the Reverend Alfred Potter during my lifetime with the Advowson in fee and Presentation of the living of Keyworth which I have lately purchased as provision for him in lieu of any bequest Now therefore not having already done so and considering the uncertainty of life I give devise and bequeath unto my said son the Reverend Alfred Potter or his heirs and assigns all that perpetual Advowson donation nomination collation presentation and right of Patronage of and in and to all that the Rectory and Parish Church of Keyworth in the said County of Nottingham together with all other the hereditaments profits and emoluments of what nature or kind to the said Advowson Rectory or Parsonage belonging freed and discharged from any debt or mortgage that at the time of my decease might be existing thereon but in all other respects I ratify and confirm my said Will In witness whereof I have hereunto set my hand the thirtieth day of November in the Year of our Lord one thousand eight hundred and fifty four _ Samuel Potter
