The Will of Isaac Porter

 

In the Name of God Amen I ISAAC PORTER of Carshalton in the County of Surry [sic] Gentleman being of sound mind memory and understanding Praised be God for the same Do make and publish this my last Will and Testament in manner and form following that is to say, First I recommend my soul to Almighty God my Creator hoping for his Mercy through Jesus Christ and I desire that my Body may be buried in the Vault by me lately built in the West Aile adjoining to the Vestry in the Parish Church of Carshalton aforesaid for the Internment of my late deceased wife Wilhelmina and as to what Worldly Estate it has pleased Almighty God to bestow upon my I dispose thereof as follows. I direct that all my just debts Funeral Expences and the Charges of proving this my will shall be paid out of my Personal Estate by my Executors hereinafter named and I do hereby subject and charge the same with the payment thereof.

I give and devise unto WILLIAM FAWKENER Esquire (one of the Clerks of his Majesty’s Privy Council) and WILLIAM ROSE clerk Rector of Beckenham in the County of Kent and of Carshalton aforesaid and their heirs All that my Customary or Copyhold Messuage Lands and Hereditaments with the Appurtenances situate in the Parish of Hesket in the County of Cumberland upon Trust that they the said WILLIAM FAWKENER and WILLIAM ROSE do and shall as soon as conveniently may be after my decease sell and dispose of the same premises to any Person or Persons who shall be willing to Purchase the same for the most money which can be reasonably had or gotten for the same and also do put and place out the monies which shall arise by such sale or sales the clear Rents and Profits thereof until such sale or sales shall be thereof made in the Public Funds and pay and apply the same and Interest and dividends thereof in manner hereinafter mentioned and directed ...

And I give and bequeath unto the said WILLIAM FAWKENER and WILLIAM ROSE the sum of £21 for a Ring a piece of lawful money .... for their care and trouble in the execution of this my Will and the trusts hereby in them reposed . And I give and devise unto the said WILLIAM FAWKENER and WILLIAM ROSE .... all my freehold and leasehold messuages lands tenements and hereitaments whatsoever and all monies standing in my Name or in the Name of any person In trust for me in the Public Funds and all the residue of my Personal Estate whatsoever (Except such goods plate or other things as belong or are reputed to belong yo my Children and which are mentioned and described in an Inventory thereof written with my own proper hand and which Inventory bears reference to this my last Will and testament) Upon trust to pay and apply the rents... and profits of my said freehold and leasehold premises (until the sale thereof herein after by me directed to be made shall be made) and the interest and dividends of my monies now in the Public Funds and of the Monies to arise by the sale of my said Copyhold hereditaments herein before directed to be sold and of the monies to arise from my said Personal Estate in the first place in payment and discharge of the Expences and Charges which may be incurred by reason of the execution of this my Will and after payment thereof then upon Trust to pay and apply the rents issues profits interests adn dividends for and towards the maintenance of my five Children namely ROBERT, ALLAN, GEORGE JAMES, JOHN YOUNG and HARRY in such manner as they ... shall think proper until all my said Children shall respectively attain the age of 21 years

And my meaning is that it shall and may be lawful to and for my said trustees .... are hereby empowered when they shall set an opportunity of putting out Apprentices or placing out to any Business or employment or otherwise advancing the fortunes and estates of any of my said Children to Adventure any Sum of Money not exceeding the sum of £100 to be paid as a premium with or for the benenfit and advancement of any one of my said Children.

And upon further trust that when any one of my said Sons shall attain his age of 21 years then my said trustees .... shall out of the monies hereby vested in them pay unto such Som ... the sum of £500 ....

And upon Further Trust shall when they shall see occasion and think proper sell and dispose of my said Freehold and Leasehold Premises for the purposes aforesaid to any person or persons who shall be willing to purchase the same for the most Money which can be resonably had or gotten ... and shall put and place out the Monies which shall arise from such sale and pay and apply the same for the purposes aforesaid .... for the benenfit of all my said Sons until the youngest of my said Sons for the time being shall attain his age of 21 yerars.

And when the youngest of my said sons for the time being shall have attained the said age upon Trust to pay apply and divide all the Monies which shall then remain of the Monies to be produced from my real and Personal estates unto and amongst my said five sons equally share and share alike if they shall be then all living and if any one or more of my said sons shall at the time my said youngest son for the time being shall attain his age of 21 years be dead without leaving lawful Issue Then upon Trust to pay the part of share of him or them so dying unto the Survivors of them equally share and share alike And if there shall then be but one such survivor then upon trust to pay the whole of the said Monies so remaining unto such survivor, but if any one or more of my said sons shall die before my youngest son for the time being shall attain his age of 21 years as aforesaid and leaving lawful issue then upon Trust to pay the part of share of him or them so dying and leaving Issue unto his or their respective Issue equally share and share alike .....

And if all my sons shall die witrhout leaving lawful issue Then Upon Trust to pay the whole of my Monies so remaining unto my Brother ROBERT PORTER now or late a Merchant at Civita Vachia in Italy his Executors and Administrators Provided Always and my meaning is and I do hereby direct that my messuage or tenement in Carshalton aforesaid wherein I now dwell with the lands and Appurtenances thereunto belonging being part of my real Estate may be ?last? offered to Sale To the Intent that any of my Sons may purchase the same if he or they shall think Proper

And I do hereby make nominate and consitute and appoint the said WILLIAM FAWKENER and WILLAM ROSE joint executors of this my Will and when my oldest son for the time being shall attains his age of 21 years Then I do hereby make and nominate and constitute and appoint such oldest son executor of this my Will jointly with the said WILLIAM FAWKENER and WILLIAM ROSE and I do give devise and bequeath unto such Son and his heirs and executors jointly with my said other trustess All my said Real and Personal Estates and the Monies to arise from the same upon the like trusts and with the like Powers .... as if such Son had been now named and appointed a trustee with the said WILLIAM FAWKENER and WILLIAM ROSE and I do hereby give and devise the Tuition and Guardianship of all my said Sons unto my said Trustees until my said Sons shall severally attain the age of 21 years .....

In witness whereof I the said ISAAC PORTER have to this my Last will and Testament set my hand and seal this 12 March in the 4th year of our Sovereign Lord George the Third 1784

This Will was proved at London 5 September 1785 ..... by the oaths of William Fawkener Esq and the Reverend William Rose, clerk, executors.... having first sworn duly to administer Power reserved of making the like grant to ROBERT PORTER the eldest son of the deceased when he shall have attained his age of 21 years and apply for the same.
