This is the Last Will and Testament of me
Thomas PINNELL of the Parish of Saint Owen in the City of
Gloucester gentleman who am in health of body and of sound
disposing mind memory and understanding. First I will and
direct that all my just debts and funeral expenses and the
expense of proving this my Will be paid and distributed by my
Executors hereinafter named. I give devise and bequeath to my
nephew Nathaniel SHIPTON and to Mr William POWELL of Berkeley in
the County of Gloucester, shopkeeper all those my two several
messuages or tenements with the appurtenances thereunto
belonging situate lying and being in the Parish of Saint Owen
aforesaid and now in the occupation of myself and John PRICE to
hold the said several messuages with their appurtenances unto
them the said Nathaniel SHIPTON and William POWELL their heirs
and assigns and the heirs and assigns of the survivors of them
upon the terms to and for the purposes next hereinafter
mentioned. That is to say in trust as soon as conveniently can
be after my decease absolutely to sell by public auction or
private contract all and singular the said several messuages
tenements and premises to any person or persons for the most
money that can be had or obtained for the same. And after
paying and satisfying the expenses attending such sale I will
and direct that the remainder of such purchase money shall be
divided into six equal parts, five parts whereof in equal
proportions I give to the said Nathaniel SHIPTON and to my
nieces Sarah BENDALL widow, Mary the wife of William ODY,
Elizabeth the wife of the said William POWELL and my nephew
Thomas FFRYER and the remaining sixth part thereof I give in
equal shares and proportions to Thomas and Joannah the son and
daughter of my late niece, Joannah the wife of Thomas HARRIS.
And it is my will and I do hereby request and desire that they
the said Nathaniel SHIPTON and William POWELL and the survivor
of them shall and do put and place out the said share of them
the said Thomas and Joannah HARRIS and also their share and
proportion of and in the residence of my personal estate
hereinafter given and bequeathed to them respectively upon some
good security or securities in the names of them the said
Nathaniel SHIPTON and William POWELL or the survivor of them
until the said children shall respectively attain the age of
twenty one years. And I will and direct that the interest
arising and to be made from such security or securities in the
meantime shall be paid to or retained and enjoyed by their
father towards the maintenance and education of his said
children during their minority and as soon as the youngest of
both children shall attain the said age of twenty one years then
in trust that they the said Nathaniel SHIPTON and William POWELL
or the survivors of them or the executors or administrators of
such survivor shall and do pay such principal money or transfer
the securities in which the same shall be invested into such
children or the survivor of them his or her executors or
administrators but in case both the said children shall die
before they shall attain the said age of twenty one years and
without issue, then I will and direct that their respective
shares hereinbefore and hereinafter mentioned to be given and
devised to them shall be considered as part of the residue of my
personal estate. I give to my sister Lydia, the wife of Thomas
LYDIATT the sum of two hundred pounds. And as for and
concerning all my goods chattels and effects ready monies in the
funds securities for money and all the rest residue and
remainder of my personal estate of what nature or kind soever
and in wheresoever. It is my will and I hereby direct that the
same shall be divided into six equal parts, five parts or shares
whereof I give and devise to them the said Nathaniel SHIPTON,
Sarah BENDALL, Mary ODY, Thomas FFRYER and Elizabeth POWELL in
equal shares and proportions and the other remaining sixth part
thereof I give to them the abovenamed Thomas and Joanna HARRIS
the son and daughter of my said late niece in equal proportions
and do hereby make nominate constitute and appoint them the said
Nathaniel SHIPTON and William POWELL joint Executors of this my
last Will and Testament hereby invoking and making void all
former and other wills by me at any time heretofore made and do
declare this only to be and contain my Last Will and Testament
provided and my will is that my said Trustees and Executors
hereinbefore named and the survivor of them their and his heirs
executors and administrators shall and lawfully may reimburse
and indemnify themselves and himself and
deduct
and retain out of the said trust
promises all such costs charges damages and expenses as they or
other of them shall or may expend lay out and be put into for or
by reason of all or any of the trusts hereby in them reposed and
that neither of them shall be answerable for any loss which may
happen to any of the said trust monies and premises unless such
loss happen through their or his wilful neglect or default nor
the one for the other of them nor for more monies than shall
actually come to each of their hands respectively but each and
every of them for their or his own acts deeds scripts neglect &
defaults only. In witness whereof I the said Thomas
PINNELL the said Testator have to this my last Will and
Testament contained these sheets of paper to the two first
sheets thereof set my hand and to this the third and last sheet
thereof set my hand and affixed my seal this eighteenth day of
April 1822. Signed sealed published and declared by the said
Testator Thomas PINNELL as and for his last will and testament
in the presence of us who at his request and in his presence and
also in the presence of each other have hereunto subscribed our
names as in witnesses.
