The Will of Thomas Phipps

 

In the Name of God Amen I Thomas Phipps of Chipping Campden in the County of Gloucr Ironmonger being at present surprised with sickness and not knowing how it will please God to dispose of me for Life or Death but wholly submitting my selfe to his blessed Will and humbly with hearty sorrows for my sins recommending my soul to the hands of my gracious God trusting for Salvation by and thro’ the Meritts of the Death and passion of my Lord and only Saviour Jesus Christ as touching my Worldly Estate doe make this my last Will and Testament as followeth Imprimis I give unto my eldest son Thomas Phipps the Sume of One Hundred Pounds to be paid to him att his Age of two and twenty years. Item I do give and appoint to be paid to my said son Thomas by my loveing Wife out of my effects One Annuity or Yearly Rent of ten pounds of lawfull money of Great Britain at the place of her Dwelling for the time being all the time of her natural Life at two payments in every year (that is to say) upon the Nine and twentieth Day of September and the ffive and twentieth Day of March by equall portions the ffirst payment thereof to be made at such of the said Days as shall first happen after my decease and that the same shall not be paid unto any other or persons who may claime the same by vertue of any bargaine sale or Assignement but only to his own proper hands. Item I give and bequeath unto my Son Mathew All that my halfe yard Land with the Appurtenances lying and being in the Comon ffeilds of Westington in the Parish of Chipping Campden aforesaid which I hold by Lease for Lives under the Countess of Gainsborough To have and to hold the same during all the terme and Estate I have therein And my Will nevertheless is that my loveing Wife shall receive the rents of the said halfe yard Land until my son Mathew shall attaine to his Age of One and twenty years towards his Maintenance and Education And that my Wife shall the lives in the said Lease in case any or either of them shall dye before my said Son Mathew shall come to Age. Item I give unto my said son Mathew the sume of two Hundred pounds to be paid to him at his Age of one and twenty years. Item I give unto my Daughter Mary the sume of three Hundred Pounds to be paid to her at her Day of Marriage or Age of one and twenty years which shall first happen. Item I give unto my Daughters Jane and Susanna and to my son John the sume of three hundred pounds to be paid to them severally and respectively at their respective Ages of one and twenty years And my Will farther is that in Case any or either of my said Children shall happen to dye before his her or their Legacy or Legacys shall become due and payable I doe order and Appoint that the Legacy or Legacys of such Child or Children so dying shall be equally divided amongst the surviving Children Item I give and bequeath unto my Sister Mary the Sume of ten pounds. Item I give Devise and bequeath unto my loveing Wife at her own disposal And to her Heirs and Assigns for ever All that my Messuage or Tenement wherein I now live situate and being in Chipping Campden aforesaid together with all Barnes Stables Gardens Backsides Wages Passages Waters Easements Profitts Comoditys and Appurtenances thereunto belonging or in anywise appurteyning. Item I give Devise and bequeath unto my said loveing Wife All those my several pieces and parcels of arable Meadow and pasture ground lying and being in Gretton in the Parish of Winchcomb in the said County of Gloucr which I purchased of John Greening and his Wife to hold unto my said loveing Wife and her Assigns for and during the terme of her natural Life and imediately from and after her decease I give Devise and bequeath the same Lands and Premises purchased of Greening as aforesaid with their and every of their appurtenances unto my said son Thomas Phipps his Heirs and Assignes for ever Item I give and bequeath unto my said loveing Wife All and singular my Plate Pewter brass Linnen Goods Houshold Stuff and Implements of Houshold Bonds Bills Writings Obligatory Goods and Chattels Shop goods and moneys due upon Shop Book and all my Personal Estate whatsoever and wheresoever chargeable with the Legacys and Annuity before by me given and Appointed to be paid Whereas I have left my said loveing Wife a very handsome provision for her maintenance that She may be the better able to make an Addition to my said Childrens fortunes my Will is that in case my said Wife shall Marry again That then within Six months next after such her said Marriage agaoin my said Wife shall pay unto my said Children which shall be then living the sume of three hundred pounds equally amongst them over and above their aforesaid Legacys And I doe hereby upon that Condition charge my said personal Estate with the payment thereof And I do hereby constitute and appoint my said loveing Wife sole Executrix of this my Will and desire Mr Edmund Pembruge of Campden aforesaid and Barnaby ffletcher of Mickleton to be Overseers of this my Will to see the same be performed according to the true intent and meaning thereof In Witness whereof I the said Thomas Phipps have to this my last Will and Testament sett my hand and seale the second Day of July Annoq Dom 1722 Thomas Phipps his marke
