This is the last Will and Testament of me John Phipps of Stratford upon Avon in the County of Warwick Butcher First I Give and bequeath all my wearing Apparrel unto and equally between my two Brothers William Phipps and James Phipps All the rest and residue of my Personal estate and Effects of what Nature or kind whatsoever I Give and bequeath unto my Brother William Phipps and my two friends Edward Stanley of Tiddington in the County or Warwick gentleman and Thomas Dadley of Stratford upon Avon aforesaid Cutler their Executors and Administrators Upon Trust that they the said William Phipps Edward Stanley and Thomas Dadley their Executors and Administrators do and shall in the first place pay and satisfy all my just Debts Funeral Expences and the Charge and Expence of proving this my Will and fro and after Payment and Satisfaction thereof Then upon further Trust that they their Executors and Administrators do and shall put and place out at interest upon good and sufficient Security or Securities all and every Sum and Sums of Money then remaining and pay apply and dispose of so much of the Interest arising therefrom as may be wanting towards maintaining educating and breeding up my Son Thomas Phipps untill he attain his age of Twenty one Years and immediately upon his attaining that age Then my Will and Desire is that my said Trustees their Executors or Administrators do and shall pay all such Principal Money to my said Son Thomas Phipps Together with all Arrears of Interest But if in Case my said Son Thomas Phipps shall happen to die before he attains his Age of Twenty one Years and Then and in such Case my Will and desire is that my said Trustees their Executors or Administrators do and shall pay all such Principal Money and all Arrears of Interest due thereon unto and equally between my Two Brothers William Phipps and James Phipps their Executors or Administrators share and share alike And I do hereby appoint my said Trustees Executors of this my last Will and Testament hereby revoking all former Will or Wills whatsoever by me made and my Will and mind further is that neither of my said Trustees or Executors or their Executors or Administrators shall be charged or chargeable with or accountable for any more of the Trust Monies and Effects which shall come to his or their Hands by Virtue of this my Will than what they shall actually receive nor for any loss thereof or any part thereof so as such loss happen without their wilfull neglect and that each of them shall be answerable and accountable for his and their acts Deeds receipts and Disbursements only and that it shall and may be lawful to and for them and each of them to satisfy and reimburse himself and themselves all Costs Charges and Expences which they or either of them shall sustain or be put unto in the Execution of the Trusts hereby in them reposed. In Witness whereof I the said John Phipps the Testator to this my last Will and Testament written and contained on Two Sheets of Paper to the first Sheet set my hand and to this last Sheet have put my Hand and Seal this first day of April In the Year of our Lord One Thousand eight hundred their Executors or Administrators their Executors or Administrators John Phipps
