The Will of William Penny

 

I William Penny of Bengeworth in the County of Worcester Innholder in order to....my Worldly Affairs make this as And for my last Will and Testament ffirst my Will is that all my just Debts be paid And after Payment thereof I give the remainder of my Real and Personal Estate in manner following ffirst I Give Devise and Bequeath all my ffreehold Messuages Lands and Hereditaments unto my Brother Peter Penny and my Brother in Law John Stickley To hold the same to them the said Peter Penny and John Stickley their Heirs and Assigns In Trust to sell the same if they shall think proper and to dispose of the Money arising therefrom to and among my Children in equal Shares or Proportions at such time as they shall think proper either before or at their several Ages of twenty one Years Item as to my Personal I Give devise and bequeath the same after Payment of all my just Debts unto my Wife Sarah and to my said Brother Peter Penny and my Brother in Law John Stickley their Executors Administrators and Assigns In Trust that the same may be applied by them in carrying on the Business I now carry on or such parts thereof as they or any two of them shall think Proper and from time to time to dispose of the Profits thereof for and towards the Maintenance and Education of my Children as they or any two of them shall think Proper and upon this further Trust that my said Wife Sarah shall have for her Natural Life such Support and Maintenance thereout as she shall think sufficient Provided she does not Marry again but if she shall Marry after my decease then my Will is that she shall only have such Allowance thereout or therefrom as my said Brother Peter Penny and my Brother in Law John Stickley or the Survivor of them or the Executors and Administrators of such Survivor shall think proper and my Will is that my Wife Sarah my Brother Peter Penny and my Brother in Law John Stickley and the Survivor or Survivors of them shall have Power and they are hereby authorized to dispose of my Personal Estate to and amongst my Children in equal shares and proportions at such time or timesat or before they attain their respective Ages of twenty One Years as they or any two of them shall think Proper And of this my Will I hereby Nominate and appoint my Wife Sarah Brother Peter Penny and my Brother in Law John Stickley Executrix and Executors In Witness whereof I the said Testator William Penny have to this my Will set my Hand and Seal this twenty third day of April 1773 William Penny
