Will:
In
the name of God Amen.
I, Paul Pedder, of
Preston in the County of
Lancaster, barber, do
for settling my temporal
affairs, make this my
last will and testament
in manner following:
First I will that all my
just debts, funeral
expenses and probate of
this my will be first
paid and satisfied
And then I give and
bequeath to my son
Robert the sum of one
hundred and sixty pounds
To
my daughter Margaret the
sum of sixty pounds
To
my son Thomas the sum of
one hundred pounds
To
my daughter Jane the sum
of one hundred pounds
To
my daughter Ann the sum
of one hundred pounds
To
my daughter Mary the sum
of one hundred pounds
To
my daughter Margery the
sum of one hundred
pounds
To
my daughter Ruth the sum
of one hundred pounds
To
be paid to them
respectively as they
shall severally attain
the age of twenty one or
marry whether shall
first happen
And I do hereby further
will and direct that if
any of my said children
shall die before they
are entitled to their
said respective legacy
so given as aforesaid
that the share of him or
her or them so dying
shall be equally divided
amongst my said children
share and share alike
And if it shall happen
that my wife shall be
enceinte and with child
at the time of my death,
I give and bequeath to
such after born child
the sum of one hundred
pounds to be paid when
such child shall marry
or attain the age of
twenty one, but if it
should die before it
became entitled to such
legacy, I will and
direct that the sum be
equally divided amongst
my said children or the
survivors or survivor of
them, and that such
after born child shall
in case any of my said
children shall happen to
die as aforesaid be
entitled to take by
survivorship a
proportionable share of
the legacies of him, her
or them so dying before
marriage or attainment
to twenty one years of
age as aforesaid
And I do hereby will,
order and direct that my
executors hereafter
named will continue or
put out at interest the
said several sums of
money so given and
bequeathed and pay and
apply the interest and
produce of each of my
said children legacies
respectively to and for
his her or their several
and respective
maintenance and
education
And whereas I am
entitled unto one
hundred and twenty six
pounds thirteen
shillings and four pence
in right of my wife, I
hereby give and bequeath
the same unto my said
wife and also the
further sum of eighty
pounds
And I give unto my
daughter Elizabeth
Cowband the sum of ten
pounds to be paid unto
my said daughter within
one year after my death
And I do further will
and direct for the
better bringing up and
education of my children
that my said wife shall
have the use of my
household goods during
her widowhood, and that
after her death or
marriage again whether
shall first happen, the
same shall be sold by my
executors and that the
money arising by such
sale shall be equally
divided amongst all such
of my children as shall
be then living share and
share alike
And I do further will
and direct that if there
should happen to be any
losses in recovering or
collecting the money or
any part thereof for
payment of the said
several legacies before
given and bequeathed
(except in recovering
the said sum of one
hundred and twenty six
pounds thirteen
shillings and four pence
so given as aforesaid to
my said wife that all
such losses and
deductions shall be paid
and allowed
proportionable out of
the said several
legacies before given
and bequeathed
And all the rest and
residue of my goods,
chattels and personal
estate whatsoever I give
to my executors to be by
them distributed and
divided to and amongst
such of my children when
and as they or the
survivors in his or
their discretion shall
think most necessary and
needful
And hereby revoking all
former wills, I nominate
and appoint my brother
Richard Pedder and Peter
Hodgkinson of Preston
aforesaid, butcher,
executors of this my
will in trust for the
intent and purposes
herein contained

sworn well and
faithfully to execute
and perform the same and
so forth before me

Know all men by these
presents that we Richard
Pedder, linen draper,
and Peter Hodgkinson,
butcher, both of Preston
in the County of
Lancaster are holden and
firmly bound unto the
Right reverend Father in
God Samuel, by divine
permission Lord Bishop
of Chester, in two
thousand pounds of good
and lawful money of
great Britain to be paid
to the Right Reverend
Father or to his certain
attorney, his executors,
administrators or
assigns; to which
payment, well and truly
made, we bind ourselves
and each of us our
heirs, executors and
administrators firmly by
these presents, sealed
with our seals, dated
the second day of
November in the year of
our Lord one thousand
seven hundred and forty
two.
The condition of this
obligation is such, that
if the above bounden
Richard Pedder and Peter
Hodgkinson, executors of
the last will and
testament of Paul Pedder,
late of Preston
aforesaid, barber,
deceased shall and do
well and truly execute
and perform the last
will and testament of
the said Paul Pedder,
deceased, and do pay all
his debts and legacies,
so far as his goods and
personal estate will
extend, and the law
shall bind them if also
they do exhibit into
court a true and perfect
inventory of the said
deceased’s goods and
personal estate, and
give a true and just
account of their acting
in the premises, when
they shall be thereunto
lawfully called, that
then this obligation to
be void, or else in
force.
