This is the last Will and Testament of me
James Peck of Addiscombe in the Parish of Croydon late ffarmer
Bailiff to Lord Ashburton I give to each of my Executors
hereinafter named the sum of ten pounds as an acknowledgement of
their kindness in accepting the office of Executor and trustee
of this my Will and I bequeath all the rest and residue of my
monies goods personal estate and effects to James Turner of
Elmers End Beckenham in the county of Kent Maltster and Brewer
and John ffrancis the Younger of Croydon Ironmonger their
executors administrators and assigns Upon the trusts following
namely as soon as conveniently may be after my decease to sell
and convert into money all such parts of my said residuary
Estate as shall not consist of money or funded property and to
convert & get in the remaining parts of my said Residuary estate
And I hereby declare that my said Trustees shall be possessed of
the monies to arise from such sale and all my monies in the
public funds and all the rest of my said residuary Estate upon
trust to pay and divide the same to and amongst all my Children
in equal shares Provided that if any of my children should die
during my lifetime leaving and children of child then the share
or shares both original and by......of such children or child so
dying shall be In trust for such of his or her children as shall
attain the age of twenty one years in equal shares if more than
one and I direct my said trustees to pay and apply the Income of
the shares of such of my grandchildren as shall be under the age
of twenty one years in and towards their maintenance and
education or otherwise to them or for their benefit as my said
trustees shall deem proper during their respective minorities
Provided always that my said trustees shall not be answerable
for each other nor chargeable for any other Monies than they
respectively shall actually receive by virtue of the trusts
hereby in them reposed (notwithstanding their joining in any
receipt or other act for the sake of conformity only) nor be
answerable for involuntary losses and that they may retain or
allow to each other all costs charges and expences which may
occur in the execution of their trusts or in relation thereto I
appoint the said James Turner and John ffrancis Miller Executors
of this my Will In Witness whereof I have at the foot of this my
last Will and Testament set my hand this fifteenth day of June
one thousand eight hundred and thirty eight James Peck
