The Will of John Pass

 

In the name of God Amen I JOHN PASS of Little Wild Street in the Parish of Saint Giles in the ffields in the County of Middlesex Taylor and Clothier being of sound mind and industry do make this my last Will and Testament in the manner form following viz I most humbly recommend my Soul to the mercy of that Almighty being from whose bounty I recieved and from whose infinite goodness I presume to hope for the pardon of all my offences and for happiness in that state to which I am now approaching I desire to be buried in the Burying Ground beloning to ffulham Church as near to my late son as may be and that Mr. Buckland undertaker in Duke Street Lincolns Inn ffields may prepare my ffuneral in the same manner as was prepared for my deceased ffriend Mr. Rush I order and direct that all my just debts ffuneral and testamentary expenses shall by fully paid and satisfied and after and subject to the payment thereof I give and dispose of my Estate and effects as follows that is to say I give devise and bequeath unto my dear wife MARY PASS all that my Messuage or Tenement and Warehouse which

I now dwell in and occupy situate Little Wild Street aforesaid with the Appurtenances for and during the term of her natural life
And from and immediately after the decease of my said Wife I give and devise the said Messuage of Tenement and Warehouse with the Appurtenances unto my Nephew WILLIAM PASS Cabinet Maker son of my Brother RICHARD PASS his heirs and assigns Also I give and devise unto my said Nephew WILLIAM PASS all that Messuage or Tenement Barn Stable and Outhouse with the Appurtenances together with sixty acres of land or thereabouts situate lying and being at Stonal in the parish of Shenstone in the County of Stafford now let to Mr. Joseph Waddams at the yearly rent of sixty pounds to hold to him his heirs and assigns forever I give and devise to my Nephew JOHN PASS Brother of the said WILLIAM PASS all that my Messuage or Tenement with the Outhouses and fifty acres of land or thereabouts with the Appurtenances situate lying and being at Abbots Bromley in the said County of Stafford and let to Mr. Thomas Cope at the yearly rent of fifty two pounds ten shillings to hold to him his heirs and assigns forever I give and devise to my Niece SARAH EMMORY now the wife of ------- ASH of Stonal aforesaid Butcher all that my Messuage or Tenement Buildings Lands and Appurtenances situate lying and being at Stonal aforesaid let to Mrs. Thomas Ashmoal at the yearly rent of seventeen pounds Also all that my Messuage or Tenement Buildings Lands and Appurtenances situate lying and being at Stonal aforesaid let to Mrs. Elizabeth Mills at the yearly rent of fourteen pounds And also all that my Messuage or Tenement Buildings Land and Appurtenances at Hogley adjoining the parish of Shenstone in the said county of Stafford let to James Sedgwick at the yearly rent of eight pounds eleven shillings for and during the term of her natural life And from and after the determination of that Estate I give and devise the same Messuage or Tenement Buildings Lands and Appurtenances in the several occupations of Thomas Ashmoal Elizabeth Mills and James Sedgwick to WILLIAM WADDAM COX of Stourbridge in the County of Worcester Surgeon and his heirs during the life of my said niece SARAH ASH in trust to support and preserve the Contingent Estates and remainders herinafter limited from being defeceated or destroyed and for that purpose to make entries and bring actions as the case shall require yet nevertheless to permit and suffer my said Niece SARAH ASH and her assigns during her life to recieve and take the rents and profits thereof to and for her and their own use and benefit And from and after her decease I give and devise the same messuage or Tenements Buildings Lands and Appurtenances in the several occuparions of Thomas Ashmoal Elizabeth Mills and James Sedgwick to the children of my said Niece SARAH ASH in such shares and proportions and in such manner as she by deed or will executed in the presence of three credible witnesses shall direct and appoint And for want of such direction and appointment I give and devise the same unto all the children of my said Niece SARAH ASH if more than one and their heirs and if there should be but one I give and devise the same to such child and his or her heirs But in case my said Niece SARAH ASH shall die without having any children or child lawfully begotten then I give and devise the Messuages or Tenements Buildings Lands and Appurtenances in the several occuptions of Thomas Ashmoal Elizabeth Mills and James Sedgwick unto my said Nephew WILLIAM PASS for and during the term of his natural life And from and after the dermination of that estate I give and devise the same unto WILLIAM WADDAM COX and his heirs during the life of my said Nephew WILLIAM PASS in trust to support and preserve the contingent Estate and Remainders herinafter limited from being defacated or destroyed and for that purpose to make entries and bring actions as the case shall require yet nevertheless to permit and suffer my said Nephew WILLIAM PASS and his assigns during his life to recieve and take the rents and profits thereof to and for his own should be but one I give and devise to such child and his or her heirs But in case my said Nephew WILLIAM PASS shall die without leaving any children or child lawfully begotten then I give and devise the said Messuages or Tenements Buildingd Lands and Appurtenances in the several occuptions of the same Thomas Ashmoal Elizabeth Mills and James Sedgwick unto my said Nephew JOHN PASS for and during the term of his natural life and from and after the determination of that Estate I give and devise unto the said WILLIAM WADDAM COX and his heirs during the life of my said Nephew JOHN PASS in trust Tenements buildings lands and appurtenencs in the several occupations of Thomas Ashmoal Elizabeth Mills and James Sedgwick to the children of my said Nephew JOHN PASS in such shares and proportions and in such manner as he by deed or will duly executed in the presence of three credible witnesses shall direct or appoint and for want of such direction or appointment I give and devise the same unto all the children of my said Nephew JOHN PASS if more than one and their heirs and if there should be but one I give and devise the same to such child and his or her heirs In case my said Niece SARAH EMMORY now the wife of ASH and my said nephews WILIAM PASS and JOHN PASS shall all happen to depart this life without leaving any lawful issue behind them then I do hereby direct that the Estate last before given shall go and descend to my own Right Heirs I give and bequeath to my said wife MARY PASS ffive hundred pounds three per cent Consolidated Bank annuities now standign in my name in the Books of the Bank I also give and bequeath unto my said wife MARY PASS all my household goods and furniture plate linen china glass and wearing apparel of what nature or kind soever and wheresoever the same may be I give and bequeath unto the said WILLIAM WADDAM COX ten pounds for Mourning if he will please to accept the same All the Rest and Residue of my estate and effects of what nature and kindsoever I give unto my Dear Wife MARY PASS to my two nephews WILLIAM PASS and JOHN PASS and my niece SARAH EMMORY now the wife of ----- ASH in equal shares parts and proportions And I do hereby direct that what I have given by this my Will to my said Niece SARAH ASH shall not be subject to the debts or control intermeddling or engagements of her present or any future taken husbands and that her reciepts also shall be good and sufficient discharge for the Monies she shall recieve under and by virture of this my Will I do hereby appoint my said Wife MARY PASS and my said Nephew WILLIAM PASS Executrix and Executor of this my last will and Testament hereby revoking all former and other wills by me at any time heretofore made In witness whereof the said JOHN PASS the Testator have to this my last Will and Testament contained in this and the four preceeding sheets of paper annexed together at the top of the first sheet and sealed with my seal set my hand and seal that is to say at the bottom of the four first sheets my hand only and to this fifth and last sheet my hand and seal this fourteenth day of March in the year of our Lord one thousand seven hundred and ninety five JOHN PASS Signed sealed published and declared by the said JOHN PASS the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the prresence of each other heve subscribed our names as witnesses thereto

This will was proved at London the tenth day of April in the year of our Lord one thousand seven hundred and ninety five before the worshipful George Harris Doctor of Laws Surrogate of the Right Honourable Sir William Wynne Knight also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of William Pass the Nephew of the deceased and one of the Executors named in the said will to whom admisitration was granted of all and singular the goods chattels and credits of the said deceased having been first sworn duly to administer power reserved of making the like grant to Mary Pass widow the relict of the said deceased and the other Executor named in the said will when she shall apply for the same.
