The Will of Uriah Parsons
This is the last Will and Testament of me Uriah
Parsons of Kington Magna in the County of Dorset Yeoman that is to say I
give and devise unto my nephew Richard Parsons son of my brother Charles
Parsons and to my nephew Benjamin Parsons son of my brother Isaac Parsons
all that my moiety of and in the messuages and lands at Holton Kington Magna
and North Cheriton of which I am jointly seized with my brother Henry
Parsons together with all and singular my monies securities for money
farming stock household goods and all other my personal estate to hold to
them the said Richard Parsons and Benjamin Parsons and their heirs to the
uses and upon the trusts thereinafter expressed and contained of and
concerning the same that is to say To the use of my brother Henry Parsons
and his assigns during his life without impeachment of waste and after the
determination of that estate by forfeiture or otherwise in his lifetime to
the use of the said Richard Parsons and Benjamin Parsons and their heirs
during the life of the said Henry Parsons In trust for him and his assigns
and after the decease of the said Henry Parsons as to for and concerning my
moiety of and in the messuages and lands at Kington Magna and the household
goods stock on the farm and all other my personal estate I give devise and
bequeath the same unto the said Richard Parsons and Benjamin Parsons to hold
to them their heirs executors administrators and assigns in equal and
undivided moieties as tenants in common and not as joint tenants charged
nevertheless as to the moiety thereof devised and bequeathed to my said
nephew Richard Parsons with the annual payment thereout of the sum of five
pounds which I hereby give and bequeath unto Isaac Parsons the brother of
the said Benjamin Parsons for and during the term of his natural life and
also charged equally with the other moiety thereof devised and bequeathed to
my said nephew Benjamin Parsons with the annual payment thereout of the sum
of five pounds which I hereby give and bequeath unto Martha Weare a servant
now in my employ for and during the term of her natural life And as to for
and concerning my moiety of and in the messuage or dwelling house and Inn
with the garden orchard and appurtenances thereto belonging situate at
Holton aforesaid I give and devise the same unto my nephew Charles Parsons
the son of my brother Charles Parsons to hold to him his heirs and assigns
forever charged nevertheless with the annual payment thereout of the sum of
two pounds and ten shillings which I hereby give and bequeath unto his
brother Uriah Parsons for and during the term of his natural life And as to
for and concerning my moiety of and in the lands and hereditaments situate
at North Cheriton in the said County I give and devise the same unto my
nephews Uriah Parsons and Henry Parsons sons of my brother George Parsons to
hold to them their heirs and assigns forever as tenants in common and not as
joint tenants charged nevertheless with the annual payment thereout of the
sum of five pounds which I hereby give and bequeath unto my niece Anne
Parsons daughter of my brother Isaac Parsons for and during the term of her
natural life and I direct the said several annuities to be paid by quarterly
payments the first quarterly payment thereof to be made at the expiration of
three calendar months next after my decease And I direct the annuities
bequeathed to the said Martha Weare and Anne Parsons to be paid to them for
their separate use and benefit independently and exclusively of any husband
with whom they may respectively intermarry and without being in any wise
subject to their debts claims or demands and that the receipts of the said
annuitants not withstanding their respective covertures shall be good and
effectual discharges for the same And in case either of the said annuities
or any part thereof shall be unpaid for the space of fifteen days next after
any of the said days of payment it shall be lawful for the said annuitants
to enter upon all and every or any part of the said hereditaments charged
with the said annuities as aforesaid and to distrain for the same or for so
much thereof as shall be so in arrear and for all costs and charges
occasioned by the non-payment thereof and to sell such distresses in like
manner as per rent reserved by lease or common demise And I do declare that
my said trustees shall be chargeable only with such monies as they shall
actually receive by virtue of the trusts hereby in them reposed and the one
shall not be answerable for the other nor for involuntary losses And also
that it shall be lawful for them to retain and reimburse themselves
respectively all costs charges and expenses which they or either of them
shall or may incur or be put unto in or about the execution of the aforesaid
trusts or in relation thereto And I appoint the said Richard Parsons and
Benjamin Parsons Executors also of my said will and hereby revoke all former
Wills and declare this to be my last will and testament In Witness whereof I
have to this my last will and testament contained in three sheets of paper
subscribed my name to each sheet thereof this ninth day of June in the year
of our Lord one thousand eight hundred and forty two
