This is the last Will
and Testament of me Susanna Parsons of Horsington in the County
of Somerset Spinster made the first day of September in
the year of our Lord one thousand eight hundred and fifty one
that is to say I give devise and bequeath unto my Friends Samuel
Newton Parsons Surgeon and Charles Parsons Yeoman both of
Wincanton All my real and personal Estate whatsoever and
wheresoever To hold to them their heirs executors administrators
and assigns respectively Upon Trust that they the said Samuel
Newton Parsons and Charles Parsons and the survivor of them and
the heirs executors administrators and assigns respectively of
such survivor do and shall pay and discharge all my just Debts
Funeral and Testamentary expences and after retaining for
themselves the said Samuel Newton Parsons and Charles Parsons
the sum of Ten pounds apiece which I hereby give and bequeath to
each of them for the trouble hereby occasioned them and setting
apart a sufficient sum of money to meet the Legacies hereinafter
by me bequeathed and such other Legacies as I may by any Codicil
or Codicils to this my Will hereafter bequeath Upon Trust to pay
over and divide the rest and residue of my personal estate
(except certain Articles of Furniture hereinafter otherwise
disposed of) unto and equally between my two Brothers James
Parsons and William Parsons absolutely for their own use and
benefit to whom respectively I give and bequeath the same
accordingly and as to the amount so retained as aforesaid Upon
trust to lay out and invest the same in their or his Name or
Names upon Government or Real Securities with power to alter and
vary the same from time to time as they or he in their or his
discretion shall think fit and to pay or apply the Interest
Dividends and annual proceeds thereof together with the rents
issues and profits of my Real Estate unto and for the benefit of
my said Brothers James Parsons and William Parsons or permit
them to receive and take the same for and during the term of
their joint natural lives and the life of the survivor of them
for his and their own equal use and benefit And from and after
the decease of the survivor of them my said Brothers as to my
Dwelling house and Lands situate at Stoke Trister in the said
County now in the occupation of John Wake I direct my said
Trustees and the survivor of them and the heirs executors
administrators and assigns respectively of such survivor
to pay or permit Thomas Williams Lush son of my nephew Thomas
Lush of Hook Farm in the parish of Charlton Musgrove Somerset to
hold and enjoy the same and to receive and take the rents issues
and profits thereof for and during the term of his natural life
subject nevertheless to the payment by the said Thomas Williams
Lush of the sum of fifty pounds and Robert Dike the son of
Catherine Dike of Wincanton aforesaid Widow to be paid to him on
his attaining the age of twenty one years with Interest in the
meantime in such manner as they my said Trustees shall think
best in case the said Thomas Williams Lush shall have previously
come into possession of the said Dwellinghouse and Lands And
from and after the decease of the said Thomas Williams Lush I
give and devise the same Dwellinghouse and Lands unto and
equally between and amongst all and every the Children or Child
of the said Thomas Williams Lush who may be living at the time
of his decease To hold to them as Tenants in Common and not as
joint tenants their or his heirs and assigns for ever And as to
my Dwellinghouse and Lands situate at Buckhorn Weston Dorset now
in the occupation of William Weare I direct my said Trustees and
the survivor of them and the heirs executors administrators and
assigns of such survivor to pay to or permit my faithful servant
Mary Shutt to hold and enjoy the same and to receive and take
the rents issues and profits thereof for and during the term of
her natural life And from and after her decease I direct my said
Trustees and the survivor of them and the heirs executors
administrators and assigns respectively of such survivor to pay
to or permit Samuel Lush another son of the said Thomas Lush to
hold and enjoy the same and to receive and take the rents issues
and profits thereof for and during the term of his natural life
And from and after his decease I give and devise the same
Dwellinghouse and Lands unto and equally between all and every
the Children or Child of the said Samuel Lush who may be living
at the time of his decease To hold to them as Tenants in Common
and not as joint Tenants their or his heirs or assigns for ever
And with regard to the disposition of the sum so set apart as
aforesaid I give and bequeath unto Sabina Lush and Selina Lush
the two Daughters of the said Thomas Lush the sum of Two hundred
pounds apiece and to the said Samuel Lush the sum of One hundred
Pounds and I declare that in the event of the death of either of
the Children of the said
Thomas Lush before they
shall come into possession of the share or interest intended for
them by this my Will and without leaving lawful issue him her or
them surviving the share or interest intended for such Child or
Children so dying as aforesaid shall go to and be devisible unto
and equally between and amongst the survivor and survivors of
the beforementioned Children I give and bequeath unto Naomi
Parsons the sum of One hundred Pounds together with my bedstead
with the White Furniture and the Bed and Bedding thereto
belonging and my Mahogany Chest of Drawers for her own absolute
use and benefit I give and bequeath my Sofa unto the said Thomas
Williams Lush for his own absolute use and benefit I give and
bequeath my Oak Bureau and best Looking Glass unto James Parsons
son of the said Mary Shutt for his own absolute use and benefit
I give and bequeath my Ash Bedstead with the Blue Furniture and
the Bed and Bedding thereto belonging unto the said Mary Shutt
for her own absolute use and benefit I declare that the said
Trustees hereby appointed and each of the heirs executors
administrators and assigns of them and each of them shall be
charged and chargeable respectively for such monies only as they
respectively shall actually receive by virtue of the trusts
hereby in them reposed notwithstanding either of their giving or
signing or joining in giving or signing any receipt or receipts
for the sake of conformity And either of them shall not be
answerable or accountable for the other of them or for
involuntary losses And also that it shall and may be lawful for
them with and out of the Monies which shall come to their
respective hands by virtue of the trusts aforesaid to retain to
and reimburse themselves respectively and also to allow each
other all costs charges damages and expences which they or
either of them shall or may suffer sustain expend disburse be at
or be put unto in or about the execution of the aforesaid trusts
or in relation thereto And I do hereby further declare and
direct that the receipt and receipts of my Trustees and Trustee
for the time being shall be a sufficient discharge and effectual
discharges for all Monies thereon expressed to be received and
hereby appoint them Executors of this my Will In Witness
whereof I have to this and the three preceding sheets affixed my
name the day and year aforesaid S. Parsons

Testatrix as and for her last Will and Testament in the joint
presence of us who in her presence and in the presence of each
other have subscribed our names as Witnesses the above

The will was proved in
the Consistorial Archidiaconal Court of Wells on 18th July 1855.
The Executor's sworn
statement prior to probate states the date of death as 5th
October 1854, that the Personal Estate and Effects of the
deceased was less than £1,000, and that the deceased was not
possessed of any leasehold estate for years either absolute or
determinable on a life or lives to his knowledge.
The Executor was
Charles Parsons of Wincanton, Somerset, Yeoman. Power was
reserved for Samuel Newton Parsons of Milborne Port, Somerset,
Surgeon, the other Executor named in the will. |
