The Will of Meshach Parsons

 

This is the last Will and Testament of me Meshach Parsons of Bayford in the Parish of Stoke Trister in the County of Somerset made the thirteenth day of July one thousand eight hundred and sixty one that is to say I give devise and bequeath unto my friends George Pitman of North Cheriton Somerset Butter dealer and Thomas William Lush of Trent in the same County Yeoman All and singular my real and personal estate whatsoever and wheresoever upon trust to convert into money such part of my personal estate except my household goods and furniture which I hereby give and bequeath unto my wife and daughter Jane to be equally divided between them as shall not consist thereof and after payment of my debts funeral and testamentary expenses to invest the sum of two hundred pounds in their names for the benefit of my grandson Frederick William Perman to be paid to him on his attaining twenty one years of age to whom I give and bequeath the same the interest to arise therefrom in the mean time I direct to be paid to his father Alfred George Perman if my said grandson shall so long reside with and be under his protection for his benefit but in case my said grandson shall die under the age of twenty one years without leaving lawful issue I direct that such legacy shall thereupon sink into and form part of my residuary estate and to pay a sum of two hundred pounds to my said daughter Jane Parsons for her own absolute use and as to the residue of my personal estate I direct my said Trustees to invest the same in their names and to accumulate the interest therefrom arising until the conversion of my real estate hereinafter directed And as to my said real estate I will and direct that my wife shall have a residence in either of my dwelling houses at Charlton Musgrove Somerset she may chose for and during the term of her natural life provided she shall so long continue my widow and as to the residue of my said real estate upon trust to receive the rents therefrom arising and pay thereout to my said wife the sum of six shillings per week during the term of her natural life provided as aforesaid and the residue of such rents to invest and accumulate in their names in like manner as my personal estate is thereinbefore directed to be invested and from and after the death or second marriage of my said wife I direct my said trustees to make sale either by private contract or public auction of the whole of my real estate and the clear amount therefrom arising after defraying the expenses of and incident to such sale together with the residue of my personal estate and the accumulations of interest and rents before directed to be made to invest the whole thereof in their names upon Government or Real security with power to alter and vary such investment from time to time as they may think expedient or necessary and receive the interest dividends and annual interest therefrom arising and pay the same unto and equally between my two daughters Keturah the wife of Mr Edward Smith and the said Jane Parsons for and during the term of their natural lives and from and after the death of my said daughter Keturah I give and bequeath one moiety of such principal money unto and equally between her children to be payable to them on their respectively attaining twenty one years of age with benefit of survivorship to and amongst them and as to the other moiety of such principal money in case my said daughter Jane shall marry and die leaving lawful issue at her decease I give and bequeath the same to such issue share and share alike if more than one payable to him her or them on attaining twenty one years with benefit of survivorship as aforesaid but in case my said daughter Jane shall depart this life without leaving lawful issue then I give the portion intended for her issue unto the children of my said daughter Keturah in like manner as the other portion is hereinbefore devised to them I declare that if my said Trustees hereinbefore named or either of them shall die or be unwilling or incompetent to accept or execute the trusts of this my Will it shall be lawful for the competent accepting Trustees or Trustee for the time being if any whether retiring from the office of Trustee or not or if none for the executors or administrators of the last deceased Trustee to substitute by any writing under their or his hands or hand any person or persons in whom about or as the case may be ….. with any surviving or continuing Trustees or Trustee my Trust estate shall be vested I authorize and direct my said Trustee and the Trustees for the time being acting under the trusts of this my will to retain and reimburse themselves and to allow each other all costs charges and expenses they may sustain incur or be put unto in and about the trusts of this my will All trust estates vested in all I give and devise unto the said George Pitman and Thomas William Lush and appoint them Executors also of this my will in witness whereof I hereunto set my hand the day and year first before written _____ the mark X Meshach Parsons _________ signed by the said testator Meshach Parsons (by his affixing his mark hereunto) in the joint presence who in his presence and in the presence of each other hereunto subscribe our names as witnesses the same having been first read over and fully explained to the said testator
