The Will of Charles Parsons

 

The last Will and Testament of me Charles Parsons of Marsh Farm, Wincanton in the County of Somerset Yeoman made the seventh day of February in the year of Our Lord one thousand eight hundred and seventy four as follows I give devise and bequeath unto my son William Parsons and my friend William Herridge the younger of Marsh Court Farm in the same Parish Yeoman all my real estate whatsoever and wheresoever including the farm and lands at Stoke Trister which I have recently contracted to purchase of Mr Phelps save as after mentioned. And also all my personal estate of every kind and description upon trust as soon as conveniently may be after my decease to sell and convert the same into money either by public auction or private contract in their discretion and after paying therebut all my just debts funeral and testamentary expenses to pay to my daughter Mary Izit the wife of Henry Burfitt the sum of four hundred pounds to make up with the hundred pounds she has already had five hundred pounds and to pay and divide the rest and residue of such my estate unto and equally between my five other children to whom respectively I give and bequeath the same for their own absolute use and benefit. I give and devise my orchard called the Mead Orchard situate at North Cheriton within the same County unto my said daughter Mary Izit Burfitt upon condition that it be not sold out of the family. I give unto my wife Elizabeth Parsons an annuity of thirty pounds for her own absolute use and benefit provided she continues my widow and I charge the same on my other two orchards situate at North Cheriton aforesaid and should the rents or income thereof fall short of that amount then I direct my said trustees to make up the deficiency from my other estate bequeathed to them and subject thereto or in the event of my said wife marrying again or of her death I direct my said trustees to sell the said orchards to any member of the family willing to make the purchase it being my express wish that the same should be retained in the family as long as possible and to pay and divided the proceeds of such sale together with the rest and residue of any personal estate unto and equally between all my children excepting Mary Izit Burfitt who is otherwise provided for. I give all the legal interests vested in me as trustee or mortgagee in any real or personal estate unto the said William Parsons and William Herridge subject to the trusts and equities affecting the same. I declare that the receipt of my said trustees and of the survivor of them and of the executors administrators or assigns of such survivor shall be sufficient discharges for all monies therein expressed to be received. I appoint the said William Parsons and William Herridge the younger executors also of this will and I declare that if my said trustees herein before named or either of them shall die or be unwilling or incompetent to accept or execute the trusts of this my will it shall be lawful for the competent accepting trustee for the time being if any whether retiring from the office of trustee or not if none for the executors or administrators of the deceased trustee to substitute by any writing under … or his hands or hand any person or persons in whom alone or (as the case may be) jointly with any surviving or continuing trustee my trust estate shall be vested. And that the trustees or trustee for the time being of this my will shall be responsible only for their or his own respective acts defaults and receipts and shall be exempt from liability for involuntary losses and shall be at liberty to retain and allow to each other out of the respective trust monies all expenses incurred in the execution of the trust and powers of my will. In witness whereof I have hereunto set my hand the day and year first before written

Charles Parsons signed by the said testator as and for his last will and testament in the joint presence of us who at his request in his presence and that of each other subscribe our names as witnesses Richard Parsons John Messiter

Proved at London 13th May 1876 by the oaths of William Parsons the son and William Herridge the younger the executors to whom Admon was granted.

On the 13th day of May 1876 Charles Parsons late of Marsh Court Farm in the parish of Wincanton in the County of Somerset Yeoman deceased, who died on the 28th day of December 1875 at Stoke Trister in the said County was proved in the Principal Registry of the Probate Division of the High Court of Justice, by the Oaths of William Parsons of Cucklington in the said County Yeoman the son and William Herridge the younger of Marsh Court in the said parish Yeoman Executors named in the said Will They having been first sworn duly to administer
