The Will of Charles Parsons

 

I Charles Parsons of Marston Magna in the County of Somerset Yeoman make my last Will and Testament in manner following that is to say I give devise and bequeath all my real and personal estate whatsoever and wheresoever unto my cousin James Parsons of Horsington in the County of Somerset Gentleman and my Nephew Charles Parsons of Stalbridge Park in the County of Dorset Gentleman To hold to them their heirs executors and administrators respectively Upon the Trusts following that is to say Upon trust to permit and suffer Ann my wife to occupy and enjoy or receive and take the rents issues and profits of my dwelling house garden and orchard at Marston Magna aforesaid for and during the term of her natural life in case she shall so long continue my Widow and unmarried and from and after her decease or second marriage which shall first happen Upon trust for my son Charles Parsons his heirs and assigns he paying thereout to my sons Richard and Uriah and to my daughters Ann Elizabeth and Mary the sum of Forty pounds sterling apiece but in case my said son Charles shall decline to accept the said premises on such terms then Upon trust for my said son Richard his heirs and assigns he paying thereout to his other brothers and sisters (except his brother Edward Parsons and his sister Harriet Willis) the sum of Forty pounds sterling a piece And in case the said Richard Parsons shall refuse to accept the said premises on such terms Then upon trust for my said son Uriah his heirs and assigns he paying thereout to his other brothers and sisters (except the said Edward and Harriet) the sum of Forty pounds sterling a piece And in case all my said sons Charles Richard and Uriah shall refuse to take the said premises on the above mentioned terms Then upon trust to sell the same either publicly or privately as my said Trustees or the survivor of them his heirs executors or administrators shall think fit And out of the monies arising therefrom to pay each of my said daughters Ann Elizabeth and Mary the sum of Forty pounds a piece and to pay the residue of such monies equally between my said sons Charles Richard and Uriah and as to my said personal estate Upon trust that my said Trustees do and shall pay thereout to my said daughter Harriet Willis for her separate use and so that her receipt alone shall be a sufficient discharge the sum of Eighty pounds sterling in one year after my decease And do and shall apply the remainder of my personal estate at their discretion for the benefit of the said Ann my Wife my said sons ...... Richard and Uriah and my said daughters Ann Elizabeth and .... during the life of my Wife if she shall so long continue my ..... and unmarried And from and immediately after her decease or second marriage which shall first happen Upon trust to pay thereout .... sixty pounds sterling to each of my said daughters Ann Elizabeth and Mary and to pay the residue thereof in equal shares between my sons Charles Richard and Uriah Provided always that my ... shall not be controled in any way in the execution of the trusts ...reposed in them but shall and may act in all things at their discretion and as they shall deem best for my said wife and children .. and dispose and convert into money my personal estate as they think fit or otherwise And I appoint my said cousin James Parsons and my said nephew Charles Parsons executors of this my Will I give to my said Trustees all protections and indemnities and power of reimbursing themselves out of the Trust Estate .. are usual in like cases InWitness whereof I have hereto signed and subscribed my name the sixth day of August 1846 Charles Parsons signed by the said Testator Charles Parsons in the presence of us who .... presence and in the presence of each other have hereunto subscribed .... .... as Witnesses -------- Thos Fitzherbert Vicar of Marston Magna John Nicholetts South Petherton Solr

This is a Codicil to my above written Will I revoke ..... appointment of my Cousin the above named James Parsons ... ..... Trustees and Executors of my said Will and in lieu thereof ...... my son Charles Parsons one of my Trustees and Executors ... ... my above named nephew Charles Parsons And I give devise .... all my real and personal Estate unto my said Nephew Charles Parsons and my said son Charles Parsons their heirs executors and administrators respectively accordingly Upon the trusts ... several ... intents and purposes mentioned in my above Will In witness whereof I have hereunto set my hand the twenty second day of August 1846 --Charles Parsons - signed by the said Testator Charles Parsons in the joint presence of us who in his presence and in the presence of each other have hereunto subscribed our names as witnesses the words "of my said Will" having been first underlined - Charles Parsons of Sandford - Simeon Baker
