The Will of John Pampion
In the Name of God amen I John Pampion of
Eastcote in the parish of Patishall in the County of Northampton yeoman
being weak in body but of Sound and Disposing mind and memory thanks be
given unto Almighty for the same Doe make and ordain this my last Will
and Testament in manner and form following ffirst and principally I
commend my soul into the hands of Allmighty God my Creator relying
wholly on the meritorious Death and Passion of my blessed Redeemer for
the remission of all my Sinns my body I committ to the Earth to be
decently buried at the discretion of my Executors hereinafter named and
as for my temporall Estate which it hath pleased Almighty God to bestow
upon me I give and dispose thereof as followes Imprimis I give and
bequeath unto Anne my Loving Wife the sume of three hundred pounds of
good and lawfull money of England to be paid to her by my Executors
hereinafter named Twelve Months after my Decease upon this express
condicon that she my said Loving Wife Anne shall yeild and Surrender up
her joynture of or in my house Close of pasture or inclosed ground in
Eastcoate aforesaid commonly called the Pinfold Close unto my Brother
William Pampion and to my wellbeloved ffriend Richard ffolwell of
Eastcote aforesaid item I give and devise unto my said Brother William
Pampion and to my said ffriend Richard ffolwell all my said Close of
pasture or inclosed ground with the appurtenenances to hold to them
their heires and Assigns for ever to the intent and purpose that they
shall sell the same for the best price they can gett or obtaine upon
this express condition that if my personall Estate goods and chattells
cannot be sold by them to fully pay the said sume of three hundred
pounds to my said Loving Wife Anne as aforesaid and my debts Legacys and
ffunerall expences then the said Sume of three hundred pounds and my
debts Legacys and ffunerall expences shall be made up and paid out of
the money as shall be raised by such Sale out of my said Close and the
overplus if any be after the said Sume of three hundred pounds be fully
paid to my said Loving Wife as aforesaid and my debts and Legacyes and
ffuneral Expences shall be made up and paid my Executor shall pay the
same unto my Dear ffather William Pampion Item I doe declare and my will
and intention is that if in case it shall happen that my personall
Estate goods and chattells and my said Close cannott be sold for to
raise the said Sume of three hundred pounds to be paid to my said Loving
Wife Anne as aforesaid and my debts Legacys and funeral Expences that
then and in such case my said Loving Wife Anne shall have and receive of
my Executors hereinafter named what Money they can sell my Personall
Estate goods and chattells and alsoe in full satisfaction of the said
Sume of three hundred pounds to be paid to my said Loving Wife
hereinbefore bequeathed unto her anything hereinbefore contained to the
contrary notwithstanding Item I doe further Declare and my Will and
intention is that if in Case my Executors hereinbefore named shall
refuse or be negligent to take upon them to be my Executors upon Trust
as is hereinafter mentioned to sell my personal Estate goods chattells
and ....to raise the the said sume of three hundred pounds or to sell
the same for what they can gett to pay my said Loving Wife in manner
aforesaid and to pay my debts and Legacys and ffunerall Expences that
then and in such case the said gift and devise of the said close with
its appurtenances to my said Loving Brother William Pampion and my said
ffriend Richard ffolwell their heires and Assignes for ever And my gift
and bequeath to them in makeing them my sole Executors upon trust for
the uses intents and purposes aforesaid shall cease determine and become
utterly void for all intents and purposes whatsoever anything herein
contained to the contrary thereof notwithstanding and then and in such
case but not other I doe give and Devise the said close with the
appurtenances to my said loving Wife Anne and to her heires and Assignes
for ever and alsoe then but not otherwise I doe give and bequeath unto
my said Loving Wife Anne all my personall Estates goods and chattells
whatsoever and I doe make her sole Executrix of this my Will she paying
my debts Legacys and ffunerall expences Item I give and bequeath unto my
said Loving Brother William Pampion and to my ffriend Richard ffolwell
ten shillings apiece for their trouble and alsoe all the rest and
residue of my personall Estate goods and chattells whatsoever
unbequeathed I doe give and bequeath untoe my loving Brother William
Pampion and to my ffriend William ffolwell whom I doe thereby make sole
Executors joyntly of this my Will upon trust to pay my said Loving Wife
Anne in manner aforesaid and my debts Legacys and ffuneral Expences and
I doe declare this to be my last Will and Testament hereby revoaking all
other Wills and Testaments by me heretofore made in Witness whereof I
have hereunto sett my hand and seal the three and twentieth day of
September in theseventh year of the reigne of our Sovreigne Lady Anne by
the grace of God of great Britain ffrance and Ireland Queen Defender of
the ffaith Anno Domini one thousand seaven hundred and eight John
