This is the last Will and Testament of me John Dale Owston late of Scarborough in the County of York Mast Maker and now of No 14 Wapping Dock Street Wapping in the County of Middlesex Gentleman in the first place I direct that all my just debts and funeral and testamentary expences to be paid as soon as convenient after my decease out of my personal estate I give devise and bequeath unto my Sister Jane Hinderwell of No 14 Wapping Dock Street aforesaid Widow her heirs executors administrators and assigns all that my freehold messuage or tenement shop hereditaments and premises with the appurtenances situate and being in Merchants Row Scarborough in the County of York and all other my real estate whatsoever and wheresoever And also all the Rest and Residue of my personal estate Upon the Trusts following that is to say upon trust to sell and convert such part or parts of my personal estate as do not consist of money into money and to invest the same and all other my personal estate in the Public Stocks or funds or upon Government or real security with power to alter vary and transpose the said Stocks funds and securities as my said Sister from time to time shall think and I do hereby declare that the receipt or receipts in writing of my said Sister shall at all times be a good and sufficient discharge or discharges for such sum or sums of money or security for money as shall therein respectively be expressed or acknowledged to have been received or given And upon this further trust to pay the rents issues or profits of my said real estate and the interest dividends and annual produce of the whole of my personal estates to the proper hands of my Niece Mary Jane Hampshier the Wife of William Hampshire of No 54 Spring Street Shadwell Middlesex bricklayer or her assigns for and during the term of her natural life And I hereby declare and direct that the same shall not be subject or liable to the debts controul or engagements of her said present or any future husband and that her receipt alone notwithstanding her coverture shall be a good and sufficient discharge for the value And from and after the decease of the said Mary Jane Hampshier I hereby give devise and bequeath the whole of my said real and personal estate unto the said Jane Hinderwell her heirs executors administrators and assigns and I hereby declare that she shall and may reimburse herself all reasonable costs charges and expences attending the execution of the trusts of this my Will and that she shall not be answerable for any involuntary losses And I hereby nominate and appoint the said Jane Hinderwell sole Executrix of this my Will And hereby revoking all former wills by me heretofore made I declare this to be my last Will and Testament In Witness whereof I have hereunto set my hand and seal this tenth day of ffebruary in the Year of our Lord one thousand eight hundred and twenty nine _ John Dale Owston

This is a Codicil to be added to and taken as part of the last Will and Testament of  John Dale Owston late of Scarborough in the County of York mast maker and now of No 14 Wapping Dock Street Wapping in the County of Middlesex Gent I give and bequeath unto my Sister Jane Hinderwell widow the whole of my Property of what nature or kind soever to hold the same or to dispose of it by sale or in any other way she may think proper for the benefit and to assist herself and her family as follows in lieu or instead of giving the interest and profits arising from rents or any thing else to the said Mary Jane Hampshier the Wife of William Hampshier for life that the said Jane Hinderwell (being sole Executrix) do give it in such manner and in such way as she may think proper to all or any of her children as they may appear to her through necessity to require any part of my property thus disposed of taking particular care to the necessities and necessaries and relief of the therein mentioned Mary Jane Hampshier And I hereby ratify and confirm my said last Will and Testament except as in this Codicil expressed In Witness whereof I have hereto set my hand and seal this fifteenth day of April one thousand eight hundred and thirty one John Drake Owston
