The Will of Rebecca Oliver

 

This is the last Will and Testament of me Rebecca Oliver of Southwick in the Parish of Monkwearmouth in the County of Durham I give and devise to my son in law Joseph ffancet his heirs and assigns my undivided moiety or equal half part of and in the dwellinghouse garden and premises situate in Silver Street Whitby in the County of York lately occupied by Ann Cooper deceased and all other my real estate whatsoever Upon trust as soon as conveniently may be to sell the same by public auction or private contract for the most money or best price that can reasonably be obtained for the same and to stand possessed of the money to arise by such sale as hereinafter mentioned I give and bequeath to the said Joseph ffancet all my stocks funds and securities and all other my personal estate on trust as soon as conveniently may be to collect & get in the same and to convert the saleable parts thereof into money And my will & mind is that the said Joseph ffancet shall stand possessed of the moneys to be collected and got in and the proceeds to arise from the sale of my said real estate and the saleable parts of my said personal estate and of my ready money Interest & thereout in the first place to pay and satisfy all my just debts and funeral and testamentary expences and in the next place to retain for his own use the sum of twenty five pounds And as to the Residue to divide and pay the same to and amongst my three daughters Rebecca the wife of the said Joseph ffancet Mary the wife of James Johnson and Jane the wife of George  Hall in equal shares and proportions And for facilitating the sale of my said real estate I hereby declare that the receipt of the said Joseph ffancet his heirs or assigns for the purchase money shall be a good discharge for the same and that the purchaser shall not answerable for any money beyond what he or they shall actually receive nor for any involuntary loss And that he or they may out of such money as may come to his or their hands retain all his and their lawful and reasonable expences I appoint the said Joseph ffancet sole Executor of this my last Will and Testament hereby revoking all other Wills & Testaments by me at any time heretofore made In witness whereof I the said Rebecca Oliver have hereunto set my hand and seal the twenty fifth day of July in the Year of our Lord one thousand eight hundred and forty The Mark and X Rebecca Oliver Seal of
