The Will of Bass Oliver

 

I John Bass Oliver of No 31 Saint Swithins Lane in the City of London Gentleman do declare this to be my Last Will and Testament I specially direct that my body may be buried by the side of my Wife in the Cemetery of Dunkerque France where a Vault is already prepared for that purpose I wish no expense or distance to interfere with this direction I direct that all my just debts funeral and testamentary expences are paid as soon as conveniently may be after my decease I give and bequeath the following legacies To my sister Charlotte Jane wife of Colonel Charles Herrick Burnaby Royal Artillery my late Wife’s Dressing Case and Work Boxes together with all the jewellery and Watches therein as well as elsewhere and all my Pictures Prints books clocks and Ornaments of all kinds Set of Silver ffurs Shawls and every other Article she may wish to remove for her own use (but not for sale now being in or upon my house at Bruxelles or elsewhere. to my Sister Elizabeth Mary the Wife of the Reverend Irmson Davies one hundred pounds (£100) To my friend John Peter Jenkes of Benpells two thousand franks (ff2000) and to my servants Joseph Vaniechout and Petronelle his Wife one thousand five hundred franks (ff1500) and all my Clothes and Wearing Apparel in or about my house at Brusells aforesaid I acquit release and discharge the heirs executors administrators and assigns of my deceased Brother Thomas Bass Oliver of all debts whether specialties or otherwise appearing in my books against him Upon payment of the principal sum of three hundred pounds devised to me by the said Charles Herrick Burnaby upon a certain reversionary sum payable on the death of his Mother Marguit, release and discharge his executors administrators and assigns of all arrears of interest thereon amounting to a very large sum Should it so happen that at the time of my decease the separate earnings of my Partner William Henry Wilkins upon the Partnership firm of Oliver and Wilkins should exceed mine and that he should exceed mine and that he should appear a greater debtor to the Partnership ffirm than myself or should have drawn out more money in such case I acquit and release him of all share in such …… in such drawings up to or within six Calendar months of my decease when a stop shall be made Provided that the amount of such drawings have not exceeded the usual drafts on the Business a Balance can also be struck of Capital and Bills of Cost outstanding and paid to my executors in due course I give devise and bequeath unto the Trustees or Trustee for the time being of the Settlement made on the marriage of my said Sister Charlotte Jane with the said Charles Herrick Burnaby all that my moiety or equal half part of and in a certain freehold house at Loughborough in the County of Leicester and in one share of the Loughborough or Boat Navigation together also with a small plot of freehold land inclosed by a Wall and Iron Railing in front of the said house which last mentioned plot of ground is vested in me in entirety, to hold the same upon the same trusts to and for the same ends intents and purposes in all things as they now hold the other moiety of the said house and share by virtue of the aforesaid settlement I direct my executors to keep sufficient monies in hand to prosecute two suits in which I am now engaged in Bruxelles one against the Dendre Valley Company and the other against Dubois Richoui and others and to charge the expenses of such suits to the proper accounts opened in my Books with Messrs Oliver and Luedsell and Messrs Bouard and Bullot I devise all estates vested in me as trustee unto the said William Henry Wilkins and his heirs to hold the same subject to the equities affecting the same respectively And as to all the rest residue and remainder of my real and personal estate whatsoever and wheresoever I give devise and bequeath the same unto the said William Henry Wilkins and Charles Herrick Burnaby their heirs executors administrators and assigns upon trust to call in collect and convert into money and possess themselves of the same and pay and apply the same forthwith to the aforesaid trustees or trustee of the Settlement made on the marriage of my said sister with the said Charles Herrick Burnaby to be held and applied by them pursuant to the trust of the aforesaid settlement as if the same were originally part of the funds and property the subject of the said settlement and lastly I appoint the said William Henry Wilkins and Charles Herrick Burnaby joint Executors of this my Will In Witness whereof I have hereunto set my hand this twentieth day of April one thousand eight hundred and fifty four - J B Oliver-
