The Will of George Nutt

 

In the name of God, Amen. The Nineteenth day of July in the yeare of our lord God (according to the account now used in England) One thousand six hundred ffiftie and one, I GEORGE NUTT of Knights hill in the parish of Lambith in the county of Surrey Gentleman and a freeman of the Citty of London Being at this present in perfect health and of ??nd minde and memorie (blessed be God for the same) Doe make and declare my last will and Testament as followeth (vizt): ffirst and principally I commend my borrowed Soule into the sure hands of my Creator and Redeemer, assuredly resting upon the only and al sufficient meritts of my lord and Saviour Jesus Christ for the pardon and forgiveness of all my Sinnes, and for the injoyment(?) of that inheritance of the Saints in life layed up in Christ for all his, to all eternity I commend my body to the earth, the common mother of us all, to be decently interred by and at the discretion of my Executrix herein after named As for my personall estate I devide the same accordinge to the laudable custome of the Citty of London into three equall parts; one part thereof I render unto my Deare and well beloved wife KATHERINE as her due by the said custome, Another part thereof I give unto and amongst my NYNE CHILDREN to be equally divided amongst them And the other Third part thereof being at my owne disposing according to the custome of the said Citty I doe alsoe give unto and amongst my Children to be equally devided amongst them part and part alike And if any of my Children dye the portion of him or her soe dying to goe to and be paid to the Survivors of them equally when they and every of them can legally give sufficient discharges for the same As for the Messuages lands Tenements and hereditaments which (as Joynt purchaser with my brother WILLIAM NUTT Esquire) I lately bought of Mr. THOMAS (LVILL?) and his Trustees, lyeing and being in Woodford and Chigwell or one of them in the County of Essex I give the same my land Tenements and hereditaments with their appurtenances, unto my said deare and well beloved wife KATHERINE and her Assignes for and duringe her naturall life Provided always and upon this Condition that she the said KATHERINE my deare wife doe give unto every one of my children (vizt) GEORGE, THOMAS, CHRISTOPHER, WILLIAM, JAMES, MARGARET, ANNE, ELIZABETH, and KATHERINE Thirtie pounds apeece in currant money And I hope and trust my said wife will give them my said Children ffiftie pounds a peece more, as shee hath promised me out of her own Third part of my estate in regard(?) my children are many and by that means and the ill fortune I have had in my estate by reason of the late troubles in the commonweath their portions wilbe but smalle; the Revertion(?) in ffee of which lands Tenements and hereditaments with there Appurtenances expectant upon the decease of the said KATHERINE my wife I give nto my oldest sonne GEORGE NUTT and his heires and assignes forever, hopeing that my said Brother WILLIAM NUTT (in case he survive mee) honestly and justly doe and ?er for me to my said wife and sonne in and about the same hereditaments as effectually and fully and peaceably as if I were liveing according to the true intent and meaneinge of his declaration therein in writeinge already sealed to mee And I doe hereby declare it to be my Will, true intent, and meaneinge That if my said wife shall refuse to give my said Children Thirty pounds apeece as aforesaid, then the estate by me given to her for her life with hereditaments aforesaid to be absolutely null and voyd And then I give the same my lands Tenements and hereditaments immediately after my decease unto my said sonne GEORGE NUTT his heires and assignes for ever, Charged with the payment of ffortie pounds a peece unto every one of his brothers and sisters before mentioned to be paid when theire other portions are payable, And this charge upon the land I make in regard I have given my said Eldest sonne GEORGE NUTT One hundred and fforty pounds to trade already, and have been at a hundred pounds charge to place him apprentice besides All the rest and residue of my estate whatsoever both reall and personall undisposed of I give and bequeath unto my said loveinge wife KATHERINE NUTT, and my dutyfull sonne GEORGE NUTT, and do hereby constitute my said loveing wife KATHERINE NUTT, and my said sonne GEORGE NUTT, to be the joynt Executors of this my last will and Testament And I do request my said loveing brother WILLIAM NUTT, and my loveing friend RICHARD RUDYARD of the Middle Temple London gent to be my Overseers Desiring them, and eyther of them, to be aydeing and assisting unto my said Executors and eyther of them, in the due execution of this my Will And I give to each of them my said Overseers Tenn pounds a peece to buy them Mourneing [Rings] And I doe hereby revoak and make void all former wills by me made, and doe declare these presents, conteynde in three sheets of paper to be my last will and Testament In Testimony whereof I have to every one of these three sheetes of paper set my hand and seale, the day and yeare first above written;

This will was proved at London the Twelveth day of July in the yeare of our lord God one thousand six hundred ffifty and five [12 July 1655] Before the Judges for probate of wills and granting Administrations lawfully authorized By the oath of GEORGE NUTT the sonne and surviving Executor named in the said will to whom Administration of all and singular the goods Chattells and debts of the said deceased was Committed He being first sworne truely to Administer the same.

George NUTT's wife was Katherine WOODWARD............Katherine's brother Thomas WOODWARD was assay-master of the London mint but was dismissed in 1649 because of his opposition to Parliament. Thomas came to Virginia vowing that he would never see England again until his Majesty's return from exile. He never did return to England, and left descendants in America.
