The Will of Edmund Nurden

 

In the Name of God amen I Edmund Nurden being at this present time in good health of body and in sound and perfect memory Thanks be given to Almighty God for the same do hereby make and declare this my last Will and Testament in manner and form following (viz) ffirst I recommend my Soul to God nothing doubting but upon my full Repentance and Amendment of Life to obtain fforgiveness of all my sins through (and only through) the Merits and Mediation of the Blessed Jesus And my Body I desire may be buried in the same Grave where my Dear very Dear late and loving Wife and Daughter lyes and my Coffen to be laid on my Dear Deceased Wife's Coffen if it can so be or at least as near their Graves as conveniency but that and who shall be my Pall Bearers and what Company shall be at my Burial and what they shall have at my Burial given them I do intirely leave to the Management of my Executrix hereafter named And for settling my Temporal Estate and such goods and Chattels as it shall please God to Bless me with I do give and bequeath the same in manner and form following my Debts and ffunerall charges being first paid Item I give and bequeath to my Niece MARY NURDEN my Silver Tea Pott and two Silver Tea Cannisters which was formerly her Mothers having on them my Coat of Arms Next I give and bequeath to my Nephew WILLIAM NURDEN my Pint Silver Mugg which was formerly his ffathers and three silver spoons which was my Bachelor's spoons markd E.N. Next I give and bequeath to my Niece MARTHA NURDEN a Silver Salver which was formerley her Mothers and two Silver Salts of my own both alike Next I give and bequeath to the Revd. MR. CANDY (who lives near Mr. Powells) if alive Two Guineas To the Revd. MR. BLACKBOURNE where I belong to Two guineas To the Revs. MR. LINDSAY and MR BENNET One guinea apiece if alive Likewise to MR. BALL my Taylor One guinea to MRS. HUSBANDS and MRS. STANTON and MRS. HAMPSON Ten shillings a piece and to C.E. PARKER One Guinea Likewise to the woman who cleans the Chapple Ten Shillings the Chapple where I goe but I don't know her name
Item I give and bequeath to my Dear Wife's Sister MARY HOTCHKINGS the Lease of my House and Dye-house I now live with my whole plant which was praised to me at 100 pounds value, namely all my Copper, Pinns Dye Stuffs pump and in one word all and everything belonging to me as a Dyer Likewise I give and bequeath to the said MARY HOTCHKINGS all and every of my Household Goods Watch Rings Pewter and Brasses Porridge Potts Plate and Spoons those excepted that I gave and bequeathed as aforsaid namely to WILLIAM and MARY and MARTHA NURDEN And in one word I give and bequeath to the aforesaid MARY HOTCHKINGS all and everything which was properly mine and belong'd to me the moment before my death except what has been before excepted Provided nevertheless I do order and appoint MARY HOTCHKINGS to pay my Dear Sister MARY BATES or her Husband THOMAS BATES Thirty Pounds of good and Lawful Money of Great Britain either out of Money I may have in th house or out of the first Money she the aforesaid MARY HOTCHKINGS shall recieve from any of my Customers with the utmost speed she possibly can after my death And in consideration that I have gave and bequeathed my House and Dye-house to the aforesaid MARY HOTCHKINGS for the Term of Years the Lease has to come which (I think) is thirteen and fouteen years I do herefore Order and appoint MARY HOTCHKINGS shall pay or cause to be paid out of the Rents and Profits of my aforesaid House and Dye-house Twenty Pounds a year to the aforesaid my Sister MARY BATES or her Husband THOMAS BATES to be paid Quarterly at the four usual Quarter days and because the aforesaid MARY HOTCHKINGS shall not be put to any difficulty I do order and appoint the first Quarterly payment shall not be payd to the aforesaid THOMAS or MARY BATES till the first Quarter day happens after I have been dead twelve calender months that the aforesaid MARY HOTCHKINGS may (as the saying is) turn herself round and make provision as aforesaid ffor the aforesaid MARY HOTCHKINGS is to have my House and Dye-house for one whole year free without paying any Quarterly payments to the aforesaid MARY BATES or her Husband THOMAS BATES only (note) the Thirty Pounds is to be paid with all convenient speed as is aforesaid And further Note, I do order that the Quarterly payments are to be no longer than the Lease of my House and Dye-house continues ffor when the Leases is out the Quarterly payment ceases and if the aforesaid THOMAS BATES dies or his Wife dies before the Lease of my House and Dye-house expires yet the surviving person (namely) BATES or his Wife shall have and enjoy the thirty Pounds and the Quarterly payments aforesaid But if BATES or his Wife (my Sister) both dies before then the quarterly payment ceases But in any case the aforesaid MARY HOTCHKINGS shall refuse or neglect to pay or cause to be paid to the aforesaid THOMAS BATES or his Wife according to the aforesaid directions the Thirty Pounds or the Quarterly payments being lawfully demanded She the aforesaid MARY HOTCHKINGS being able but not willing then it may and shall be lawful for the aforesaid THOMAS BATES or MARY BATES his wife singly or joyntly to take and enjoy my House and Dye-house the remainder of the years the Lease has to run and MARY HOTCHKINGS shall quit it and give it up peaceable to the aforesaid THOMAS BATES or his wife MARY BATES Provided nevertherless because MARY HOTCHKINGS shall not break through my Orders as afore appointed Neither THOMAS BATES or his Wife MARY BATES have any sort of secret designs against MARY HOTCHKINGS Therefore to prevent any wicked designs on either side I order if any Quarterly payments should not be paid quite so regularly as I have ordered either because my House and Dye-house should not be inhabited or burnt down, any difference arising upon thise two accounts Then a man or two chosen on either side shall end the dispute but if not, Then any single man whom the other men on each side shall choose shall wholly decide the dispute Nevertheless MARY HOTCHKINGS shall not lose her right and title to my House and Dye-house except it very plainly appears her non compliance to my orders as above said is done with a wicked design to cheat BATES or his Wife of what I left them And if MARY HOTCHKINGS dies before the Lease of my house is expired Then THOMAS BATES and his Wife shall have the house And if one of them BATES or his Wife dies the surviving person to have it But if BATES or his Wife dies before the Lease of my house is expired the MARTHA NURDEN If she dies then MARY NURDEN If she dies then WILLIAM NURDEN If he dies the I order ELIZABETH HOTCHKINGS and SARAH HOTCHKINGS shall have and enjoy the Lease of my House ect. provided the Lease is not expired before And whereas Brother and Sister BATES has a house on Labour-in-vamshill now in the possession of Mr. Akins which comes to me after both their deaths Now if it should please God that Brother Bates and his Wife both dies before the Lease of their house is expired Then I Will and bequeath the house abovesaid to my Dear and Loving Sister in Law MARY HOTCHKINGS Next to both her Daughters Elizabeth and Sarah HOTCHKINGS and the surviving Sister (if one should die) to enjoy the house herself But in case they both die Then WILLIAM NURDEN then MARY NURDEN then MARTHA NURDEN One thing I forgot to mention in it's proper place namely after my Sister MARY BATES or her Husband THOMAS BATES has recieved their Thirty Pounds as aforesaid that being as I said before first payd Then I order MARY HOTCHKINGS to pay or cause to paid to my maid SARAH FFITZARICK ffive pounds either in lawful money of Great Britain or in Goods or in any other things as they shall both agree Provided she lives in my house at my death but not else Likewise I give and bequeath to my Brother BATES all my Cloths Linnen and Woollen Hats Wiggs Shoes and Stockings These two last articles should have been put in their proper place but I do desire that will be no barr to their advantage in that point Lastly I do hereby Order and appoint my Sister in Law MARY HOTCHKINGS my full and sole Executrix to this my last Will and Testament written with my own hand revoking all former Wills made by me declaring this to be last Will and Testament containing one whole sheet of paper Witness my hand this seventh day of December 1733 / Edmund Nurden /

This Will was proved at London before the Worshipful William Bramston Doctor of Laws Surrogate of the Right Worshipful John Bettesworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted on the Thirteenth day of April in the year of our Lord One Thousand Seven hundred and thirty four by the Oath of Mary Hotchkings (wife of George Hotchkings) the Executrix named in the said Will to whom was granted administration of all and singular the Goods Chattels and Credits of the said Deceased She being first sworn duly to administer the same.
