The Will of Charles Noden

 

In the Name of God Amen I Charles Noden of Woodmanstern in the County of Surrey Esquire do make this my last Will and Testament in manner and form following that is to say I do hereby Charge my two houses with the appurtenances in White Cross Alley in Moorfields now in the possession of John Harrison and all my Houses Lands and Tenements in the County of Cheshire ffreehold and Leasehold in the possession of John Bostock and John Rudyard their assigns and undertenants and all my right Title and Interest in a house in Milk Street in London in the possession of Mr John Alsop and the Lands Tenements and Premises in the possession of John Scott in the parish of South Mimms in the County of Middlesex and my Estate in Woodmanstern aforesaid now in my own possession and undertenants with the Payment of my just Debts ffuneral Expences and Legacies hereafter mentioned In the first place I give and bequeath to my son Hugh Noden the sume of five hundred pounds to be paid him twelve months after my decease upon him giving my Executors a full discharge from all manner of Claims and Demands whatsoever upon any part of my Estate which if he refuseth to give then I give and bequeath him one shilling only and no more Item all my Estate in the parish of Woodmanstern I give and bequeath to my loving wife Mary Noden for and during her natural life and after to my son Richard Noden and his heirs Male for ever lawfully to be begotten and for want of such Issue to my son Phillip Noden and his heirs male for ever and for want of such Issue to my son Hugh Noden and his heirs for ever desireing my said Wife that my son Richard may hold and enjoy the said lands at Woodmanstern during her life upon paying her the annual rent of One hundred Pounds a year clear of all Taxes and Charges whatsoever the first Payment to commence six months after my decease and to be continued to be paid half yearly as the same shall become due and in case my son Richard his heirs Male or such other of my sons or their heirs shall make default or neglect the payment of the said one hundred pounds a year as the same shall become due that then and in such Case it shall and may be lawfull for my said loving wife within one and twenty days after the Expiration of the said half yearly payments to enter in to and upon the stock of my son Richards and the Lands by way of Distress or by such other ways or means as my said Wife shall be advised for the Recovery or Payment of the said rent and all Charges that shall arise by reason of the said Distress or Entry Item all my stock of Corn Cattle and Implements of husbandry on my ffarm at Woodmanstern (the household Goods plate and ffurniture of the dwelling house the South Shaize and my two best Houses and Harness only excepted) I do give and bequeath to my said son Richard the better to enable him to pay my loving wife as above Item I do give and bequeath to my son Phillip Noden the sum of six hundred pounds to be paid him twelve months after my decease Item I do give and bequeath to my son Henry Noden the sume of ten shillings a week to be paid him weekly the first paymt to begin the first Quarter day after my decease and to continue to be paid every week during his natural life Item I do give and bequeath to my said loving wife all my plate Jewells Coach and two best horses and harness to be at her own disposal together with one half of my household Goods in my dwelling house and the other half of my houshold Goods I give to my son Richard and I hereby require my said Wife to permit my son Richard to dwell in the said house with her without paying rent for the same otherwise than is before directed and my will and mind is that if either of my sons Hugh or Phillip should dye before their said Legacy should become due and payable that then I do order will and appoint the Legacy or Legacys of him or them so dying to be paid to my said loving Wife and my said son Richard or the survivors of them and in Case of their decease I order the same to be equally divided between the rest of my Children that shall Survive Item all the rest and residue of my houses and Lands not hereby disposed of I leave to my loving wife during her natural life and after to my said son Richard and his heirs for ever and for what money bonds stocks or Personal Estate not hereby disposed of after the Legacies are Paid I leave to my loving wife Mary Noden and my son Richard Noden equally to be divided and that they equally Pay the said Legacy as divised to my son Henry Noden and I do hereby nominate and appoint my said loving wife Mary Noden and my said son Richard Noden Executrix and Executor of this my last Will and Testament desireing that they will see it carefully performed and I do hereby revoke all former and other wills by me made heretofore and declare this to be my only last Will and Testament In Witness whereof I have hereunto to this my last Will and Testament contained in one sheet of paper set my hand and seal this twenty fifth day of April in the year 1726 Cha: Noden
