The Will of William Newport

 

This is the last Will and Testament of me William Newport of the Parish of Barrow in the County of Chester Farmer I order and direct all my just debts funeral expenses and the charges of the probate of this my will to be paid. I give devise and bequeath all that my messuage or dwelling house together with all the outbuildings yards gardens rights members and appurtenances thereunto belonging now in my own occupation also the Hemp yard or Barn Croft likewise the Moore and Crib Crofts all in the Parish of Barrow aforesaid and containing in the whole by Common Estimation two hundred roods of land or thereabouts be the same more or less unto and to the use of my Granddaughter Jane Hitchen wife of Charles Hitchen Wheelwright her heirs and assigns for ever Chargeable nevertheless and I do hereby charge the same with the payment of one hundred pounds to my Executors and I direct that the said one hundred pounds shall fall into the residue of my personal estate and be disposed of accordingly. I give devise and bequeath all that my Croft piece or parcel of land called the Little Croft in the Parish of Barrow aforesaid unto and to the use of my Granddaughter Susannah Jones wife of Henry Jones for and during the term of her natural life and that the same shall not be subject to the debts or engagements of her said husband but to and for her own use and benefit and from and after her decease I give devise and bequeath the same to the heirs of her Body lawfully issuing share and share alike as Tenants in Common and not as Joint Tenants and in default of issue of the Body of the said Susannah Jones then I give devise and bequeath the same piece or parcel of land called the Little Croft unto and to the use of my three granddaughters Jane Hitchen Sarah Heyward and Ann Heyward share and share alike as tenants in Common to them their heirs and assigns forever. Chargeable nevertheless and I do hereby charge the same with the payment of Twenty pounds to my Executors and I direct that the said Twenty pounds shall fall into the residue of my personal Estate and be disposed of accordingly. I give devise and bequeath all that higher part of my piece or parcel of land called the big Croft situate in the parish of Barrow aforesaid and adjoining to land belonging to Mr John Cheers Caldecot containing by Common Estimation two statute acres of land or thereabouts be the same more or less and divided by a hedge from the lower part of the same big Croft unto and to the use of my Granddaughter Sarah Heyward for and during the term of her natural life and from and after her decease to the heirs of her body lawfully issuing share and share alike their his or her heirs  and assigns forever. And in default of issue of my said granddaughter Sarah Heyward I give devise and bequeath the same piece or parcel of land unto and to the use of my Granddaughter Ann Heyward for and during the term of her natural life and from and after her decease to the heirs of her body lawfully issuing share and share alike as Tenants in Common and not as Joint Tenants their his or her heirs and assigns forever and in default of issue of my said granddaughter Ann Heywood I give devise and bequeath the said piece or parcel of land to my said Grandddaughter Jane Hitchen her heirs and assigns for ever Chargeable nevertheless with the payment of the sum of Twenty five pounds to my Executors and I direct that the said Twentyfive pounds shall fall into the residue of my personal Estate and be disposed of accordingly. I give devise and bequeath all that lower part of my said piece or parcel of land called the big Croft situate in the Parish of Barrow aforesaid and adjoining to the lane containing by Common Estimation two statute acres of land or thereabout be the same more or less and divided by a hedge as aforesaid from the higher part of the same big Croft unto and to the use of my Granddaughter Ann Heyward for and during the term of her natural life and from and after her decease to the heirs of her body lawfully issuing share and share and share alike their his or her heirs  and assigns forever and in default of issue of my said Granddaughter Ann Heyward I give devise and bequeath the said piece or parcel of land unto and to the use of my said Grandddaughter Sarah Heyward for and during the term of her natural life and from and after her decease to the heirs of her body lawfully issuing share and share alike as Tenant in Common and not as Joint Tenants their his or her heirs  and assigns forever. And in default of issue of my said Granddaughter Sarah Heyward I give devise and bequeath the said piece or parcel of land to my said Granddaughter Jane Hichen her heirs and assigns forever. Chargeable nevertheless with the payments of the sum of Twenty five pounds to my Executors and I direct that the said Twenty five pounds shall fall into the residue of my personal Estate and be disposed of accordingly. I give and bequeath to my said Granddaughter Ann Heyward my four post bed stocks together with the Bed Bolster and Pillows and bedclothes thereon and all the furniture in the house place except the Chest Screen Grate and oven together with the whole of my Crockery Ware. I give and bequeath to my said Granddaughter Sarah Heyward the Tent Bed Stock Bed and Bedding Pillows Bolsters together with the Bedclothes thereon and the furniture in the room above the parlour. And as to all the rest residue and remainder of my personal Estate and the money made chargeable on my real Estate as aforesaid forming part of my said personal Estate I order and direst my Executors  hereafter named to pay and discharge all my just debts funeral and testamentary Expenses as aforesaid and particularly two several debts of one hundred pounds and seventy pounds which I owe upon two promisary notes the remainder I give and bequeath unto my four Granddaughters Jane Hitchen Susannah Jones Sarah Heyward and Ann Heywood share and share alike and lastly I do hereby nominate constitute and appoint the said Charles Hitchen of Barrow aforesaid Wheelwright and William Povar of Holme Bank near Tarvin both in the county of Chester Trustees and Executors of this my will revoking all other Will or Wills by me at any time heretofore made. In witness whereof I have hereunto set my hand this 3rd day of January one thousand eight hundred and forty nine.

 

Signed sealed published and declared by the said William Newport the Testator as and for his last Will and Testament contained on four sheets of paper and written on one side only in the presence of us present at the same time who at his request in his presence and in the presence of each other have here unto subscribed our names as Witnesses Davis Ruscoe William Newport
