The Will of Richard Newport

 

In the name of God Amen. I Richard Newport of Great Barrow in the County of Chester Gentleman being of sound and disposing mind do make Publish and declare this my last Will and Testament in manner and form following that is to say First I subject and charge all my Real and Personal estates with the payment of my debts and funeral expenses and subject and chargeable therewith I give devise and bequeath unto my son in law Thomas Golbourne of Dodleston in the said County of Chester yeoman, and to his wife Elizabeth all those my two several messuages or tenements with the lands Hereditements and appurtances to the same severally belonging Situate lying and being at Long green in the parish of Great Barrow aforesaid now in the tenure holding or possession of Joseph Simcock as my undertenant and which said several Messuages or Tenements Lands hereditements premises I now hold under and by virtue of two several leases thereof to me made and granted by General James Cholmondeley for the several lives I herein named and all those my two several Fields Closes or parcels of lands lying and being at Long green aforesaid now in the tenure holding or possession of John Towers as my undertenant and Meadow called Cawdoe Meadow lying up or near to Sutton Bridge now in the holding or possession of the said Joseph Simcock as my Tenant which said last two mentioned Fields Closes or parcels of land and the Meadow are part of two several other leasehold tenements I hold under the said James Cholmondeley. To hold the said two several Messuages or Tenements with the Lands hereditements and premises there unto respectively belonging and the said two Fields Closes or parcels and land and  said Meadow unto the said Thomas Golbourne and to my daughter Elizabeth his wife and the survivor of them for and during so long time and until Richard Golbourne my Grandson son of the said Thomas Golbourne shall arrive to the age of twentyone years or be married which shall first happen / if my Estate and Interest in the said several Messuages Tenements Fields Closes or parcels of Land meadow and premises shall so long continue at and under the Rents Covenants and reservations in the said lease to me made by the said James Cholmondeley mentioned and contained and from and after the said Richard Golbourne shall arrive the age of twenty-one years or be married which shall first happen then I do give devise and bequeath  unto the said Richard Golbourne all the said two several Messuages Tenements Fields Closes or parcels of Land meadow and premises. To hold to him the said Richard Golbourne  and his heirs Executors Administrators and assigns during all the remainder of my Estate term and Interest in the said premises at and under the Rents Reservations and Covenants in the said leases to me made by the said James Cholmondeley mentioned and reserved he the said Richard Golbourne his heirs Executors Administrators and assigns paying unto his mother the said Elizabeth Golbourne and her assigns during the term of his Natural Life / in case she shall be living at the time of his the said Richard Golbourne coming into possession of the said several Messuages or Tenements Lands and premises herein before to him given and devised the clear yearly annuity or sum of ten pounds of lawful money of Great Britain by even and equal portions at the four most usual feast days or times of the year that is to say Christmasday Ladyday Midsummerday and Michaelmasday the first of such payments to begin and be made on such of the said feast days as shall next happen after the said Richard Golbourne shall come into possession of the said premises with power for the said Elizabeth Golbourne to distrain for the said clear annuity or yearly sum of ten pounds on the day and times in which the same ought to be paid or to re-enter on the premises for want of a distress as is usual in such cases provided always and it is my Will and Mind that if the said Richard Golbourne should happen to depart this life before he shall arrive at the age of Twentyone years or be married and without Issue then and in such case I give devise and bequeath all and singular the said several Messuages or Tenements Lands and premises so given and devised to the said Richard Golbourne as aforesaid immediately upon his decease before the age of Twentyone years as aforesaid / subject to an annuity or clear yearly sum of ten pounds of lawful money of Great Britain payable and to be paid to the said Elizabeth Golbourne during her natural life out of the said premises from and after the decease of the said Richard Golbourne aforesaid at four days or times in the year that is to say Christmasday Ladyday Midsummerday and Michaelmasday by equal payments the first of the said payments to begin and be made on such of the said days as shall next happen after the death of the said Richard Golbourne as aforesaid with power for the said Elizabeth Golbourne to distrain on the said premises for the said last mentioned clear annuity or yearly sum of ten pounds on the said day and times which the same are last mentioned to be paid or to re enter on the said premises for want of a distress as is usual in such cases / unto all and every the child and children of the said Thomas Golbourne on the Body of the said Elizabeth his wife begotten or to be begotten To hold to them and to the Survivors and the Survivor of them equally share and share alike such child and children to take the said premises as Tenants in Common and not as Joint Tenants in any wise during all my then Estate terms and Interest therein. I also give devise and bequeath unto my daughter Mary Newport Spinster all that my Messuage or Tenement with the lands hereditements and appurtenances thereto belonging situate lying and being at Great Barrow aforesaid by me purchased of the Granthams Family or those claiming under them now in my possession / except the said meadow part of the said tenement / herein before by me given devised and bequeathed as aforesaid And also my other leasehold messuage or tenement and land with the appurtenances situate lying and being in Great Barrow aforesaid now in my holding except the said two Fields Closes or parcels of land in the possession of John Towers which said last mentioned Messuage Tenement and lands with the appurtenances were left to me by Late father Peter Newport deceased To hold the said two several last mentioned Messuage Tenement Lands and premises / except before excepted / unto her the said Mary Newport her heirs Executors Administrators and assigns during all my Estates terms and Interests therein that and under the Rents Services Reservations Covenants and agreements in the said two several leases last mentioned under which I hold the said premises subject and chargeable with the payment of the sum of One hundred and fifty pounds of Lawful Money of Great Britain by my said  daughter Mary Newport her heirs Executors Administrators and assigns of and from the same premises so  by me given  bequeathed and devised to her as aforesaid unto my Granddaughter Elizabeth daughter of the said Thomas and Elizabeth Golbourne at her age of twentyone years or day of marriage which shall first happen and if the said Elizabeth Golbourne shall happen to depart this life before she shall attain the age of twentyone years or be married then I will and direct that the said one hundred and fifty pounds be paid or payable by her my said daughter Mary her heirs Executors Administrators and assigns of and from the said premises so by me given bequeathed and devised to her as aforesaid unto all and every the child or children said Thomas Golbourne on the Body of the said Elizabeth his wife begotten or to be begotten the Survivors and the Survivor of them equally share and share alike the same to be paid and payable to them or the Survivor or survivors of them at their respective ages of twentyone years or day or days of marriage which shall first happen. I also give devise and bequeath unto my said daughter Mary Newport all the rest and residue of my said real and personal Estates / not herein before given devised bequeathed / which I shall in any wise name or ....... be possessed of interests in or intitles unto at the time of my decease To hold to her my said daughter Mary her heirs Executors Administrators and assigns for ever. And lastly I do hereby nominate constitute and appoint my said daughter Mary Newport and my Brother in Law Eyr Forster Smith Executrix and Executor of this my last Will and Testament hereby revoking and making void all former Wills and Wills Testament  and Testaments by me at any time heretofore made and declare this to be my Last Will and Testament In witness whereof I the said Testator have here unto set and put my hand and seal this sixth day of December one thousand seven hundred and sixty two.
