The Will of Ann Newport

 

October 19th 1695

 

To all persons to whom this present writing shall cum I send this greeting

 

Know ye that I the sade Ann Newport for the love goodwill and affection which I have and bare towards my loving daughter Ann Newport both living in the Parrish of Barrow and in the Countie of Chester, widdow and mayd and for the love I bare to her I have given and granted and by those present doo freely clearly and absolutly give and grant to the sade Ann Newport all and singular my goods wares and household stuffs plate ......... and ...... monie implements and all other things alive or dead whatsoever, that are moveable both real and personall whatsoever thay bee as well within doors as without and in whose custody or possession soe ever the same or anie of them or anie part therof can or may be found remaneing and being as well in the messuage or Tenement wherein I doo dwell as in any other place or house whatsoever within the Township of Barrow , or els where either  bills or bonds only I give unto my son William Newport the sume of one shilling and allsoe I give unto my daughter Elesabeth former the sume of fore pounds if they shall be alive at my decease and to be pade within sixe monthes after my beuriall if thay doo cum to demand it of Ann Newport my well beloved Daughter to whom I give all as before mentioned to have and to houlde all the sade goods househould stufe impliments and all upon the primisses unto her the sade Ann Newport and after my decease from henseforth to her owne proper use and as her own proper goods for ......... absolutely without anie maner of condition but what is before mentioned and I the saide Ann Newport have delivered unto my daughter six pence as in full ......... of the cost In witness whereof I have unto put my hand and seale the day and yeare first above written

The Condition of this obligation is such that if the above bounden Prudence Hancock Granddaughter and Administratrix with the last Will and Testament annexed of all and singular the goods chattles and credits of Ann Newport Late of Barrow abovesaid Widdow her late grandmother deceased do make or cause to be made a true and perfect inventory of all the goods chattells and credits of the said Deceased which shall or may come to her hands possession or knowledge And the same so made do exhibit or cause to be exhibited into the Registry of the Consistory Court of Chester att or before the Seaventeenth Day of October  next ensuing the Date above written And the same goods chattlels and credits according to the Tenor and effect of the last Will and Testament in writing of the said Deceased annexed to the Letters of Administration to her in that behalf Comitted Do well and duly Administer (That is to say) first pay the Debts of the said Deced which she did owe att the time of her decease and the Legacies and Bequests in the said Will contained as far as her saide goods chattells  and credits will there unto extend and as the Law will charge her And further do make or cause to be made a true and perfect Acc of and upon her said Administration at such time and times as she shall be there unto lawfully called or required. And such part and portion of the residue of the said goods chattles and debts which shall be found reamining upon her said AccT being paid and not otherwise disposed of in the said Will shall Distribute and Dispose as by the Direction of the Judge or Judges of the said Court for the time being shall be limited and appointed. And lastly do att all times and hereafter do discharge and save harmlesse the said Judge or Judges and all other officers for the time being of the said court from and against all manner of Persons whatsoever haveing or pretending to have any Right Tytle or interest to the said goods Chattlles or credits Then this obligation to be Void and of none effect or else to be and remain in full force and virtue.
