The Will of Ernst August Mustapha

 

In the Name of the Holy and Ever Blessed Trinity God the Father God the Son and God the Holy Ghost Amen. Whereas the ERNST AUGUST MUSTAPHA Native of Misistra late Valet de Chambre of his late Royall Majesty of Great Britain of Glorious memory and MAGDALENA CATHARINA by Marriage MUSTAPHA born HOMEYER have lived and passed many years together in a Christian and Happy State of Matrimony and call to our mind the Mortality which all mankind is subject to We have resolved being in health of Body and of good and perfect memory God be Praised to make together the following declaration of our last Will touching the Goods which after the death of either or both of us shall be left consisting in Houses Gardens Furniture Plate Jewels ready money outstanding Debts or pretensions or of whatsoever denomination the same may be that is to say First we give thanks to the most high God for all his Great Blessings and kindnesses which he has bestowed on us during the whole course of our lives and do pray to him that he will be pleased to continue and to preserve the same to us till to the hour of our death. But whenever it shall please him to call us or any one of us by a natural death out of this World We do commend our Souls to him into his merciful and gracious hands who has Redeemed the same by the precious blood of Jesus Christ and pray that he may preserve and receive the same to Everlasting joy and happiness Our Bodies we bequeath to the Earth and the longest liver of us will take care to have the Body of the deceased buried and carried to his place of rest according to the Christian Rites without any of the pompous Ceremonies As to our worldly Goods and Effects which we are already possessed of or which we may stil acquire hereafter We do make our beloved Son the Secretary of Chancery GEORGE LEWIS MUSTAPHA our Heir therein of his legal share under an honourable Title so that he shall enjoy a yearly Revenue of Two Hundred Rix Dollars wherewith he is to consent himself But Whereas we, more especially I , ERNEST AUGUSTUS MUSTAPHA have delivered and signed a Bond of Two Thousand Rix Dollars his account for Debts he contracted and for which I have yearly payd hither to a sum of Eighty Rix Dollars Interest the said two thousand Rix Dollars shall be accounted for in his said legal share that is to say in the legitima and we have that confidence in him that he will not touch the Principall but be contented with the income thereof forbidding him at the same time to touch or to break into the Principal Stock of his said legal share Whatsoever after the deduction of the said legal share shall then be found left in the Remainder lett the same consist in moveable or unmoveable Goods or Effects Plate Jewels outstanding or active debts or whatsoever the same may be called in all those Goods I ERNST AUGUST MUSTAPHA do declare my Wife MAGDALEN CATHARINA MUSTAPHA born HOMEYER to be my Universal Heir because of the Manyfold love fidelity and assistance she has shewn me as also for her prudent care and management of the Family. But if she should happen to dye my Son should Survive her, then I declare all the said Goods to be Fidei Commis that is to say that they shall then devolve to my Son the Secretary GEORGE LEWIS MUSTAPHA but so that he shall have no power to alienate Morgage or charge or Incumber with Debt my part of parts thereof or account of Debts which he may have contracted before or may contract afterwards. Nay I desire that so as I have acquired the same with great pains he will keep the same together for his lawful posterity desiring and requesting at the same time my Wife and appointed Universal Heir to preserve the said Goods and Effects in the same state as I shall happen to leave the same. However my son as long as he lives shall receive and enjoy the yearly income thereof hoping that Whereas my intent aims only for the continual good and welfare of him and his lawfull Heir which he may have perhaps hereafter that he will content himself with it and be satisfyed. On the other hand I MAGDALENA CATHARINA MUSTAPHA born HOMEYER after my Son the Secretary GEORGE LEWIS MUSTAPHA shall have recieved as above mentioned his legal share of my Goods and effects which I have brought in for my portion and which I shall happen to leave behind my whereof I make him my Heir under a Honourable Title I do make and appoint my loving Husband the Royal and Electoral Valet de Chambre Mr ERNST AUGUST MUSTAPHA my Universal Heir of all my Estate. So that if he happens to Survive me he shall not be obliged to cause an Inventory thereof to be made nor deliver any specification thereof but my son shall give and entire belief of the declaration of his Father my Husband and Heir to how much his legal share amounts and further if he shall happen to Survive his Father and me the said Goods and Effects though they shall devolve to him yet they shall lay under a Fidei Commiss So that my said son shall enjoy the income thereof but shall alienate nothing of them but transmitt the same to his lawful posterity and in case he leaves none to my nearest kndred and Relations. And Wheras I ERNST AUGUST MUSTAPHA have hitherto mantained a poor Girl called LOUISA I do bequeath to her in case she behaves herself well a Sum of One Hundred Rix Dollars however it shall be left to my Wife as my Universale Heir to consider and judge if she deserves the said legacy and if she should find that she is not deserving of it by being disobedient to her or shewing her no duty or respect she shall be authorised and impowered to take the same from her entirely to annull or to give the same to any body else And to the end that this our reciprocal Testament may take effect after the death of either one or both of us, we have resolved personally to present the same to the Royal and Elelctoral Court of Judicature in order to be kept there among the publick Records and there also to petition that in case both of us shall happen to dye or my wife survive me the said ERNST AUGUST MUSTPAHA to appoint and to name a provident and able Man to be the executor of this Will to assist her with his good advice and after both our death to procure the observants of our Testament in the best manner and to see that this our Will may be punctually complyed with In Case this Testament cannot subsist as a Solemn Testament or Last Will We do will that the same may subsist as asside Comiss codicil or in what manner else it may best be done. In Testimony whereof we have signd the same under every side and at the end with our own hands having affixt our seal thereunto done Hanover on the 9th November 1737. Superscription. The Judicial and reciprocal Testament of the Royal Valet de Chambre Ernst August Mustpaha which they personally presented in Court and delivered to be recorded as a Judicial Testament on the 11 day of November 1737.

 

I Samuel Willett Licentiate of Laws and Notary Publick by Royal Authority duly admitted and sworn do testify to all to whom it may concern that the hereunto annexed translation is a just true translation out of the High Dutch Language of the attested Will and Testament ..... 6 March 1738

 

 

This Will was proved at London..... 8 March 1738 by the oath of Magdalena Catharina Mustapha otherwise Homeyer as widow the relict of the said deceased and Universal Heiress or Executrix named in the said will.....
