The Will of Ann Winfield Moore - (nee Badder)

 

I Ann Winfield Moore, of Rugby Road Hinckley in the County of Leicetser Widow hereby revoke all former Wills, and testimentary disposition made by me and declare this to be my last Will and Testament I appoint my Daughter Ada Moore and Thomas Ghent of Burbage in the said County of Leicster Insurance Agent (thereafter called my Trustees) to be the Executrix and Executor and Trustees of this my Will and bequeth to the said Thomas Ghent the sum of Five Pounds free from death duties in case he shall prove this my Will and accept the trusts thereof I bequeath to each of my Grandchildren who being a grandson attains the age of twenty one years or being a grandaughter attains that age or marries the sum of Twenty five pounds free from death duties. And I declare that if at my decease any grandchild of mine presumptively entitled to a legacy under the aforesaid bequest shall be under the age of twenty one years and being a grandaughter shall be also unmarried then and in every such case the presumptive legacy of such infant grandchild shall be retained and invested by my trustees and shall be deemed to be property held in trust forthat infant or grandchild within the meaning of section 43 of the Conveyancing and Law of Property Act 1881 and the income thereof shall be applied accordingly. And I declare that if any of the legacies herein before bequeathed shall fail to become absolutely vested in any grandchild or grandchildren, under this my Will every such legacy and accumulations thereof and the investments representing the same or such part thereof as shall not have been applied for the advancement of any infant grandchild presumptively entitled thereto as aforesaid shall fall into and form part of my residuary estate. I devise and bequeath all my real and personal estate whatsoever and wheresoever unto my Trustees upon Trust that my Trustees shall sell call in and collect into money the same or such part thereof as shall not consist of money and shall with act of the money's produced by such sale calling in, and conversion and with and out of my ready money pay my funeral and testamentary expenses and debts and the legacies bequeathed by this my Will or any Codicil hereto and shall stand possessed of the residue of the said moneys in trust for my Daughters the said Ada Moore and Annie Elizabeth Rowley the wife of Ernest Edward Rowley now residing at Irwell in the Commonwealth of New Zealad as tenants in common in equal shares for their own absolute use and benefit.
