This is the last Will
and Testament of me William Minchin of Great Barrington in the
County of Gloucester gentleman In the first place I direct that
all my just debts funeral and testamentary expenses shall be
paid and satisfied I give and devise unto William Powell of
Taynton in the County of Oxford Gentleman Samuel Druce of Ensham
in the same County gentleman and William Moore of Milton in the
same County Gentleman and their heirs All that my estate lands
tenements and hereditaments with the appurtenances situate at
Broadwell in the said County of Gloucester now in the occupation
of Mr Herbert as my tenant and all other my real estate
whatsoever and wheresoever To hold unto and to the use of them
the said William Powell Samuel Druce and William Moore their
heirs and assigns upon trust that they my said trustees the
survivors and survivor of them or the heirs or assigns of such
survivor do and shall as soon as conveniently may be after my
decease sell and convey and dispose of the same either together
or separately by public or private sale as by them or him may be
thought most advisable with full liberty to buy in the same or
any part thereof at any auction or auctions and to sell the same
or any part thereof at any future auction or auctions or by
private contract without being answerable for any loss or
diminution in price And I hereby order and direct that the
receipt or receipts of my said Trustees or the survivors or
survivor of them, his heirs or assigns shall be good and
sufficient discharge or discharges to the purchaser or
purchasers of the same or any part thereof for the purchase
money And that such purchaser or purchasers shall not be
answerable or accountable for such purchase money or any part
thereof nor for the application or misapplication of the same
And I direct that the produce of such Estate shall be and become
part of my personal Estate and be subject to the payment of my
debts and legacies I give and bequeath unto my granddaughters
Jane Jubilee Cox and Sophia Hawkins the sum of one hundred
pounds each to be vested Interests in them when and as they
shall attain their respective ages of twenty one years But in
case of them shall die before she shall attain the age of twenty
one years without leaving issue her surviving I direct that the
legacy shall vest in the survivor attaining that age and I
direct that the said legacies shall be paid to the said Jane
Jubilee Cox and Sophia Hawkins in such parts and proportions and
at such times as my said trustees or the survivors or survivor
of them shall think fit Also I give and bequeath to Harriet
Jarvis daughter of my son in law Emanuel Jarvis of Ensham in the
County of Oxford the sum of one hundred pounds to be paid to her
within twelve months next after my decease but without interest
for the same Also I give and bequeath unto my granddaughter
Louisa Cox daughter of James and Elizabeth Cox the sum of one
hundred pounds to be paid to her when she shall attain the age
of twenty one years with interest for the same in the mean time
I bequeath unto John Hawkins Willm Hawkins George Hawkins and
James Hawkins the children of my daughter Sophia by her husband
John Hawkins the sum of one hundred pounds to be equally divided
amongst them share and share alike at their respective ages of
twenty one years with benefit of survivorship as well in the
original as in the accruing share or shares Also I give and
bequeath unto my said trustees five pounds each as a
compensation for their trouble in the execution of the trusts of
this my Will I give and bequeath unto Rachael Philip William
Harriet and George the five children of my late daughter Rachael
Cox the sum of one hundred pounds each and to my granddaughter
Ann Maria Cox the sum of one hundred pounds payable at their
respective ages of twenty one years And I direct that the shares
of such of them as shall at my decease be under that age shall
be invested and placed out on real security or in some or one of
the parliamentary securities or in the funds at interest in the
names or name of them my said trustees or trustee or the trustee
for the time being of this my Will in order that the same may
respectively accumulate until such children respectively shall
arrive at their ages of twenty one years when I direct that such
respective legacies and their respective accumulations shall be
paid or transferred to such children so attaining that age And
I direct that if any one or more of them the said Rachel Philip
William Harriet George and Ann Maria shall die before she or
they have attained his her or their age or respective ages of
twenty one years the legacy or legacies and the accumulations
thereof of him her or their so dying shall go and belong to the
survivors and survivor of them share and share alike I give
and bequeath all my brewing utensils and Casks and my liquors
beer and my plate linen and china and all other my household
goods and furniture into and amongst my two daughters Ann
Watkins and Rebecca Moor equally to be divided between them
share and share alike And as to for and concerning all the rest
residue and remainder of my personal estate and effects of every
kind and description whatsoever and wheresoever and also the
residue and remainder of the produce of my said real estate
remaining after payment of my said debts funeral and
testamentary expenses and the expenses of proving this my Will
and the legacies I have hereinbefore given and bequeathed I give
and bequeath the same equally unto and amongst my four daughters
the said Ann Watkins Mary Hemming the said Rebecca Moor and
Hannah the wife of William Fisher and I direct that their shares
respectively shall not be subject to the debts control or
engagements of their present or any future husband and that the
same respectively shall be paid into their respective hands for
their sole and separate use And that their respective receipts
alone shall be good and sufficient discharges for the same And I
do authorize and empower my said trustees and the survivors and
survivor of them and the executors and administrators of such
survivor at any time or times to alter or vary the securities on
which any part of my estate and effects may be invested and
again to place the same out at interest upon such good and
sufficient security and securities as they or he may think
proper And it is my Will and meaning that my said trustees or
any or either of them shall not be liable to answer or make good
any loss or losses that shall or may happen to any part or parts
of my aforesaid estate and effects in placing out any trust
monies according to the direction of this my Will or in
transacting any money affairs or otherwise relating to or
concerning the execution of the trusts mentioned in this my Will
unless the same shall appear to happen through or by their or
either of their wilful neglect or default nor shall any or
either of them my said trustees be answerable or accountable for
the acts deeds defaults receipts and disbursements of the others
or other of them but each of them for his own acts deeds
defaults receipts and disbursements only And I hereby direct
that my said trustees shall and may pay and reimburse themselves
and himself out of the aforesaid residue of my estate and
effects all their reasonable and necessary costs charges damages
and expenses whatsoever that they or either of them shall or may
bear pay be put unto or sustain in or about the execution of
this my Will or the trusts hereby in them reposed And lastly I
hereby appoint them the said William Powell Samuel Druce and
William Moor Executors of this my last Will and Testament and do
hereby also revoke and make void all former and other Will and
Wills by me at any time heretofore made and do declare this to
be my last Will and Testament In witness whereof I the said
William Minchin have to this my last Will and Testament
contained in four sheets of paper to the first three sheets
hereof subscribed my hand and to this fourth and last sheet
hereof subscribed my hand and affixed my seal this fifth day of
July one thousand eight hundred and twenty eight
