The Will of Thomas Middleton
In the Name of God Amen I Thomas Middleton of Shipston
upon Stower in the County of Worcester Gent. Being of sound and perfect Mind
& memory blessed be God do make and ordain this my last Will and Testament
in manner following (That is to say) First of all I Give and Devise unto my
Son in Law Thomas Colbourne of Shipston aforesaid Office of Excise All that
Messuage or Tenement several Closes Meadows or inclosed Grounds and premises
to the same belonging with their and every of their Appurtenances situate
lying and being in the Parish of Brayles in the County of Warwick called or
known by the name of upper Chilmscott now in the Occupation of Thomas Farmer
as Tenant thereof and all other my Messuages Lands Tenements and
Hereditaments of what nature or kind soever situate lying and being in the
said Parish of Brayles or elsewhere To have and to hold the said Messuage or
Tenement several Closes Meadows or Inclosed Grounds Lands Tenements
Hereditaments and Premises to the same belonging with their and every Rights
Members and Appurtenances unto the said Thomas Colbourne his Heirs and
Assignes for ever , but charged and chargeable nevertheless and subject and
liable to the Payment of all my just Debts ffuneral Expences the several
Legacys by me hereinafter given and Bequeathed as also with the Annuity
hereinafter mentioned Also I Give and Bequeath to my Son in Law John Owen of
Shipston aforesaid the Sum of Two Hundred Pounds to be raised out of the
said Estate and paid to him by the said Thomas Colbourne his Heirs or
Assignes within Twelve Months next after my Decease Also I Give and Bequeath
to my Daughter Henrietta Wife of the said John Owen One Annuity or yearly
Rent Charge of Ten Pounds free of all Deductions whatsoever to be Issuing
and Payable had and taken out of the said Estate yearly and every Year
during the Term of her natural Life by two equal Halfe Yearly Payments the
first of which my Will is shall be made and begin at the end of Six Months
next after my Decease But my Will and Mind is that in case the said John
Owen shall happen to depart this Life in the life time of my said Daughter
Henrietta Owen the Sum of Ten Pounds hereby charged on and made payable on
my said Estate as aforesaid shall cease and become absolutely void And in
lieu of the said Annuity I give and bequeath to my said Daughter Henrietta
Owen the Sum of Three Hundred Pounds chargeable on my said Estate and to be
raised and paid thereout to my said Daughter by the said Thomas Colbourne
his Heirs or Assignes within six Months from such time as the aforesaid
Annuity shall cease and become void as aforesaid And my Will and Mind
further is that in Case my said Daughter Henrietta Owen shall happen to
depart this Life in the Life time of her said Husband Then I give the said
Legacy or Sum of Three Hundred Pounds so given to my said Daughter in lieu
of the said Annuity to the said John Owen to be raised out of my said Estate
& paid to him by the said Thomas Colbourne his Heirs or Assignes within
Twelve Months from the ceasing of the said Annuity Also I Give and Bequeath
to my Servant Mary Baldwyn for her diligent and faithfull Services and
Attendances on me during several Illnesses the Sum of One Hundred Pounds (in
case she shall be my Servant at the time of my Death but not otherwise) to
be raised out of my said Estate and paid to her her Exors Admors or Assignes
within Six Months next after my Decease Also I Give and Bequeath to the said
Mary Baldwyn as further Recompence for such her Service s (and in case she
shall be my Servant at the time of my Decease) the several Goods and Effects
particularly mentioned and expressed in a Schedule or Particular thereof
annexed to this my Will and which I desire and direct shall be deemed
esteemed and taken as apart from the same to all intents & purposes as fully
& effectually as if such Goods and Effects had been expressed and set down
in the Body thereof and which said Goods and Effects my Will is shall be
delivered tom the said Mary Baldwyn by my Executor hereinafter named as soon
as she shall have the convenience of removing them& require the same Also I
Give & Bequeath to my Sister Catherine Middleton my Gold Watch with the
seals and every thing belonging to the same but on this Condition
nevertheless that my said Sister do and shall give & deliver to the said
Mary Baldwyn her Metal Watch in a Shagreen Case in good going Order and my
…….with it All the rest & residue of my Plate China Linnen Household Goods &
implements of Household of what kind soever I Give and Bequeath to my two
Sons in Law Thomas Colbourne & John Owne equally to be divided between them
And in case any Dispute shall arise touching such Division the same my Will
is shall be finally settled by Mr William Davis & Mr Thomas Sabin and the
said Thomas Colbourne and John Owen shall abide by their determination &
such of those refusing to do so shall loose all benefit & Advantage thereof
and the other of them consenting thereto shall have and enjoy the whole All
the rest residue & Remainder of my personal Estate of what nature or kind
soever I Give & Bequeath to the said Thomas Colbourne who I nominate &
Appoint Sole Executor of this my last Will and Testament I revoke and make
void all former Wills by me made In Witness whereof I have to this my last
Will and Testament set my hand and Seal the Eleventh Day of March in the
Year of our Lord One Thousand Seven Hundred & Sixty three T Middleton
