The Will of Mary Martyr

 

This is the last Will and Testament of me Mary Martyr of Great Bookham in the County of Surrey Widow I desire to be decently interred at the Great Bookham at the discretion of my Executors hereinafter named I direct my said Executors to pay all my just debts ffuneral expences and the charges of Proving this my Will out of my stock of long annuities which shall be standing in my name in the Bank of England Books at my decease I give and devise to Mary Ann Blanchard Widow (daughter of my late Niece Elizabeth Holles late of Kensington Widow deceased) All that my...... messuage or tenement wherein I now dwell with my woodhouse stable and orchard or garden thereunto belonging situate on the East side of Bookham in the Parish of Great Bookham aforesaid and within and parcel of the manor of Great Bookham and all that my parcel of Customary land lying in the common field of Great Bookham ..... and Parish of Great Bookham and within and parcel of the manor of Great Bookham and now in the occupation of John Anscombe Butcher To hold the same messuage buildings land hereditaments and premises with their appurtenances unto the said Mary Ann Blanchard her heirs and assigns for ever I give to the said Mary Ann Blanchard the sum of one hundred and fifty pounds stock of four per centum bank annuities to be transferred to her by my Executor within twelve calendar months next after my decease I give to the said Mary Ann Blanchard All my plate rings china linen household goods and furniture of every sort and my wearing apparel of all which together with my copyhold Estate I will that the said Mary Ann Blanchard shall take possession within fourteen days next after my interment I give to each of the three brothers of the said Mary Ann Blanchard namely Thomas Holles of Kensington Painter John Holles of the same place Painter and James Holles of London Victualler one hundred pounds stock of four per centum bank annuities And I further give to the said Mary Ann Blanchard two hundred pounds I give to William Ansell of Dorking in the County of Surrey Esquire three hundred pounds To Mrs Ann Croft wife of Thomas Croft Esquire one hundred pounds To Mrs Elizabeth Parkinson Widow of Jeremiah Parkinson Esquire one hundred pounds To Mr George ffranks of Capel one hundred pounds To Miss Harriet Allen late of Dorking one hundred pounds To Thomas Hall son of my late nephew Thomas Hall two hundred pounds To such of the children of Thomas Brookwell late of Westcot in Dorking Blacksmith deceased as shall be living at my decease the sum of one hundred and fifty pounds to be equally divided between them (if more than one) share and share alike and if but one such child shall be living at my decease then the whole to such only child To such of the children of Sarah Kingston deceased the late wife of Thomas Kingston of Great Bookham as shall be living at my decease the sum of two hundred pounds to be equally divided between them (if more than one) share and share alike and if but one such child shall be living at my decease then the whole to such only child I give to the said Thomas Kingston fforty pounds To Mrs Elizabeth Rodgers wife of Mr Benjamin Rodgers late of Mickleham one hundred pounds To one hundred pounds To Mr ffrancis Wood son of the late Mr Robert Wood of Yew Trees ffarm in Great Bookham ffifty pounds To Mr Moses Elliot of Great Bookham ffifty pounds and to Sarah Plaw my late Servant ten Pounds All which said last mentioned pecuniary legacies I will shall be paid out of my said Stock of long annuities within twelve calendar months next after my decease But if it shall happen that the same Stock of long annuities shall not at the time of the sale thereof for the payment of the said legacies produce the full amount of seventeen years purchase of the said stock so as out of the sale monies to satisfy the whole of the last mentioned legacies after payment of my said debts funeral expences and the charges of proving this my will as aforesaid then it is my will and meaning that each of the said several legacies shall abate equally in Proportion to the amount of their respective legacies and ... no other part of my Estate either real or personal shall be liable to answer or make good such deficiency or make good such deficiency And I direct that the receipts of such of the said several legatees as are or shall be married women for their said legacies shall alone be sufficient discharge to my said Executors without the ..... of their respective husbands And that the same legacies shall not be liable to the debts or control such husbands And I declare that it shall be lawful for my said Executors to deduct out of the several legacies hereinbefore by me bequeathed the amount of such respective duties payable thereon And also all such costs and expences as my said Executors shall be put to in or about the obtaining of receipts for the same legacies and proving such receipts to be duly stamped And as to all the Rest and Residue of my real and personal Estate and Effects whatsoever and wheresoever and whereof I shall be seized or possessed of I give devise and bequeath the same respectively unto the said William Ansell and Thomas Croft their heirs executors administrators and assigns for ever equally share and share alike But if either of them the said William Ansell and Thomas Croft shall depart this life in my lifetime then I give devise and bequeath the same rest and residue of my said real and personal Estate and Effects unto the survivor of them the said William Ansell and Thomas Croft his heirs executors administrators and assigns for ever according to the nature and quality of the same Estates respectively And I  constitute and appoint the said William Ansell and Thomas Croft Executors of this my Will and hereby authorize them to reimburse themselves and himself all necessary costs charges and expences to which they or either of them may be put in executing this my will And I declare that neither of them shall be answerable for the acts deeds receipts or defaults of the other but each only for his own separate acts deeds receipts or defaults nor with or for any loss which may happen to any of my monies or effects in the execution of this my Will unless such loss shall arise by or through their or either of their wilful default And lastly I revoke all former wills by me heretofore made In Witness whereof I have to the bottom of the first sheet of this my last Will and Testament the whole whereof is contained in two sheets of Paper subscribed my name and to this second and last sheet set my hand and seal this twentieth day of November in the year of our Lord one thousand eight hundred and twenty three Mary Martyr
