The Will of Samuel Lutman

 

This is the last Will and Testament of me Samuel Lutman of Bentley in the County of Southampton Esquire whereby I commend my Soul to God and dispose of my Worldly Estate in manner following ffirst I will and direct that all my just Debts and ffuneral Expences be fully paid and satisfied I give and bequeath unto my Wife Mary One Annuity or Yearly Sum of ten Pounds to be paid out of my Personal Estate for and during so long time as she shall continue my Widow and no longer by four equal quarterly Payments the first Payment thereof to be made within one month next after my decease (the reason of my giving my Wife so small an Annuity as ten pounds a Year is on Account of her very bad and wicked Deportment to me Also I give devise and bequeath all and singular my ffreehold and Copyhold Messuages Lands Tenements and Hereditaments whatsoever with their and every of their Appurtenances situate lying and being in the said County of Southampton or elsewhere in the Kingdom of Great Britain and also all and every my Goods Chattells and Effects Subject to the Payment of the said Yearly Sum of Ten Pounds to my said Wife and in General the whole of my Real and Personal Estate not hereby otherwise particularly disposed of) unto my good ffriends John Croucher of Bentley aforesaid Gentleman and Richard Drinkwater of ffarnham aforesd Surgeon (whom I appoint Executors of this my Will) and the Survivor of them or the Heirs Executors and Administrators of such Survivor Upon this Special Trust and Confidence And I do hereby order and direct that they my said Executors and Trustees and the Survivor of them or the Heirs Executors and Administrators of such Survivor do and shall as soon as conveniently may be after my decease demise and to farm let All my said ffreehold and Copyhold Estates to the best Tenant or Tenants and for the most Rent that can reasonably be obtained for the same and also do and shall from time to time receive the Rents Issues and Profits which I shall die possessed of (Except my Plate which I desire they will keep for my Daughter Elizabeth until she shall attain the Age of twenty one Years)And the Monies arising from the Sale thereof together with such other Monies as I shall have at my death do and shall plant out at Interest in the public Stocks or ffunds of this Kingdom or on private Securitys as they shall think proper And I do hereby order and direct that my said Executors and Trustees or the Survivor of them or the Heirs Executors and Administrators of such Survivor do and shall maintain breed up and educate my said Daughter Elizabeth out of the Rents Dividends and Profits of my Real and Personal Estate until she shall attain the Age of twenty one years and when and so soon as my said Daughter shall have attained the said Age of twenty one years Then I will and direct that they my said Trustees or the Survivor of them or the Heirs Executors and Administrators of such Survivor do and shall convey assign and transfer all my said real and personal Estate unto my Daughter Elizabeth her Heirs Executors Administrators and Assigns subject to the said Payment of the said Yearly Sum of Ten Pounds to my said Wife so long time as she shall remain my Widow And I declare that the bequest hereinbefore made in ffavor of my said Wife shall be void if she shall at any time after my deceas claim any Dower or thirds out of my Real or Personal Estates and that the said bequest shall be in full satisfaction and Bar of such Dower or Thirds But if my said Daughter shall happen to die during her Minority then I Will and direct that they my said Executors and Trustees or the Survivor of them or the Heirs Executors and Administrators of such Survivor do and shall convey assign and transfer all my said real and personal Estate unto and amongst all and every the Children of my Sister Elizabeth (the Wife of the said Richard Drinkwater) by the said Richard Drinkwater their Heirs Executors Administrators and Assigns at their respective Ages of Twenty one years Subject nevertheless to the Payment of the said Yearly Sum of Ten Pounds to my said Wife during her Widowhood and also to one other Annuity or Yearly Sum of ffifty Pounds to my said Sister for and during the term of her natural life to be paid her by four equal quarterly Payments Also I give and bequeath unto my said Executors and Trustees the Sum of Ten Pounds apiece for the trouble they will have in the Execution of this my Will and I give and bequeath to my my said Executors and Trustees and to my Daughter and Sister a Mourning Ring each And I do hereby declare that my said Executors and Trustees shall be at Liberty to deduct and retain to their own use out of the Monies that shall come to their hands in consequence of the Trusts hereby in them reposed all their or either of their reasonable Expences laid out in and about the said Trusts or anyways relating thereto and that they my said Executors and Trustees shall not be answerable for any Loss that may happen in the said Trust monies by bad Securities or otherwise without their wilful and apparent neglect or default and I further declare that my said Executors and Trustees shall not be answerable for the Acts Receipts or Miscarriages of each other but each of them for his own proper Acts Receipts or Miscarriages only in the Execution of this my Will and the Trusts hereby in them reposed and I revoke all former Wills by me at any time heretofore made In Witness whereof I the said Samuel Lutman the Testator have to this my last Will and Testament contained in two sheets of Paper set my hand and seal (that is to say) to the first sheet my hand and to this last sheet my hand and seal the twenty eighth day of ffebruary in the year of our Lord One thousand
