The Will of Richard Lutman

 

In the Name of God Amen the Seventh day of May In the fourth year of the reigns of our most gracious Sovereigns William and Mary by the Grace of God King and Queen of England Scotland ffrance and Ireland Defender of the ffaith Anno Domini One Thousand Six Hundred and Ninety Two I Richard Lutman of Bentley in the County of Southt Gent being of Sound and perfect mind and memory thanks be unto God for the same Doe make and ordain this to be my last Will and Testament in manner and forme followinge ffirst I give to Anne my loving wife the use of all my household Goods and Utensills of household that I shall dye possessed of for and during her Widowhood or soe long as she shall continue unmarried And after that she shall happen to dye or be married Then my Will is that the said Goods shall be and remain to such Child or Children as my said Wife shall happen to be with Child withall at the time of my decease if any And in Case she shall not happen to be with Child at the time of my decease or such Child or Children happen to dye unmarried before my said Wife then my Will is that the said Goods be equally divided amongst my other Children that shall be living at the time of her decease or marriage in such proportion as she shall think fit And Whereas I have Surrendered All my Copyhold Lands and Tenements Situate lying and being in ffarnham Wrecklesham and elsewhere in the Mannor of ffarnham and held of the said Mannor To such use or uses as I should declare in and by my last Will and Testament or to that Effect Now my will is and I doe hereby declare That all my said Copyhold Lands and Tenemts shall be and remain And I doe hereby give and devise the same to my Said Son Samuel and his Heirs for ever Item I doe give and devise to my Said Son Samuel All my ffarme lands and Tenements with the Appurtenances thereto belonging commonly called Langley ffarme Situate lying and being in Rogate in the County of Sussex which I hold by a Lease for a terme of yeares yet to come and unexpired now or late in the tenure or occupation of Elizabeth Locke of her Assignes To have and to hold the same to my Said Son Samuel his Executors Admors and Assigns for by and during all the residue and remainder of the said Terme of yeares yet unexpired Subject nevertheless to the payment of the Annuity or yearly rent of forty pounds unto my mother in Law late Jane Lutman for and during her natural life Whereas I stand indebted unto severall persons in Severall Sums of Money In case I doe not raise moneys in my life time and that my other Provisions made by this my Will be not sufficient to Satisfie and pay my Debts Then I give and devise unto my said Wife Anne and her Heires All that my ffarme Lands and Tenements Situate lying and being in Churton in the County of Surrey And all that Meadow lying and being in Kingsley in the County of Southt both now or late in the occupation of Thomas Giles and his Assigns To have and to hold the same unto my said Wife Anne and her heires To the intent and purpose that she shall Sell and dispose of the Same for and towards the costs of the Debts that I shall owe at the time of my decease And in case that on the Sale thereof there be more money raised than what will be sufficient fro the payment thereof Then the overplus my Will is shall be and remain to my said Wife her Executors and Administrators But in Case the other provisions that I shall make in my lifetime or by this my Will be Sufficient for the payment of my said Debts then my Will is that my said ffarm and Lands in Churton and Kingsley Shall be and remain to my said wife and her heires and Assigns for ever Also my Will is that in Case my said Wife shall happen to be with Child at the time of my decease I doe hereby give devise and bequeath unto such Child or Children as my wife shall happen to goe withall at the time of my decease All that my ffarme lands and Tenements Situate lying and being in the Tything of Sheete in the Parish of Petersfield in the said County of Southt commonly called Whitroe ffarme now or late in the occupation of Richard Sprint To have and to hold the same to such Child or Children And the heires of his her or their bodies lawfully to be begotten And in Case my said wife doe not happen to be with Child at the time of my decease or such Child or Children happen to dye without issue of his her or their bodies lawfully to be begotten Then I give devise and bequeath the said ffarme in Sheete aforesaid unto my Said Son Samuel and his heirs to have and to hold the same to my said Son Samuel his heires and Assigns for ever Subject nevertheless to the payment of the Annuity or yearly rent of forty pounds unto my said mother in Law for and during her naturall life And my will is that all the Rents issues and profits thereof shall be applied towards the payment of the said Annuity of fforty pounds. And the other Annuity of Twenty pounds hereby given to my said Wife And what shall be wanting to make up the said Annuity of fforty pounds out of the Rents issues and profitts to be compleated out of the rents issues and profits of my said ffarme called Langley in Rogate aforesaid And in Case the said Jane Lutman shall happen to depart this life before my said wife Anne Then I give and devise unto my said wife Anne the Annuity or yearly Sum of Twenty Pounds of good and Lawfull money of England too be issuing and payable out of my said ffarme and Lands in Sheete aforesaid To have hold perceive receive take and enjoy the Same from the death of the said Jane Lutman to my said wife for and during the Terme of her natural life at four of the most usual ffeasts or days of payment in the year (that is to Say) the ffeast of St Michael the Archangell St Thomas the Apostle the Annunciation of the blessed Virgin and St John the Baptist by even and equall portions the first payment thereof to be made in and upon the first of the said ffeasts that shall happen after the death of my said mother in Law Item my will is and I doe hereby nominate constitute and appoint my Said wife Anne to be Guardian to both my sons Thomas and Samuel and to such other of my Child or Children as shall happen to be borne after my decease To whom I doe hereby dispose of the Custody and Tuition of my said children untill they Shall respectively attain their ages of one and twenty yeares in case my said wife Shall continue Soe long a widow And alsoe my Will is that my said wife during her said Guardianship shall receive the rents Issues and profits of my said Children's Estates and to educate them out of the Same And the overplus of the said rents and profits to dispose of towards the payment of my Debts And in case she shall happen to depart this life or be married before my said Children shall respectively attain their said ages Then my will is And I doe hereby nominate constitute and appoint my loving friends Henry Baker of Sellbourne in the said County of Southt Mercer, John Haberden of ffroxfield in the said County of Southt Yeoman and Christopher Reynolds and the Survivors and Survivor of them to be Guardians to my said Children to whom I doe hereby dispose of the Custody and Tuition of them untill they shall respectively attain their ages of of one and twenty yeares Alsoe my will is that the said Henry Baker John Haberden and Christopher Reynolds and the Survivors and Survivor of them after the death of my said wife shall receive all the rents issues and proffits of all the Lands Tenements and Hereditaments as well Copyhold & Leasehold as ffreehold that shall respectively belong to my said Children untill their said ages of One and Twenty years And after all allowance for fit and convenient maintenance and other necessary allowances and payment of my Debts They the said Henry Baker John Haberden and Christopher Reynolds shall satisfy and pay the overplus thereof to such Child or Children to whom the said Lands and Tenements shall respectively belong at his her or their respective ages of One and Twenty years Item I give to Martha and Grace the Two daughters of John Worlidge of Petersfield Gent one piece of Gold called a Guinea to each of them Item I give and bequeath unto the said Henry Baker John Haberden and Christopher Reynolds the Sum of four pounds apiece to be paid unto them within three months after my decease whom I make and constitute Executors of this my last Will and Testament in Trust nevertheless for my said wife to whom I give the residue of my personal Estate not herein given and bequeathed Item I give to the poore of the parish of Rogate fforty shillings and to the poore of Bentley fforty shillings to be distributed by my Executors to such of them and in such manner as they shall think fit In witness whereof I have set my hands and Seale the day and yeare first above written Richard Lutman
