The Will of Mary Ann Livingston

 

In the Name of God Amen I MARY ANN LIVINGSTON of Three Colt Street Limehouse in the parish of Saint Ann in the County of Middlesex Widow being of sound mind memory and understanding but considering the certainty of death and the uncertainty of the time thereof do make this my last Will and Testament in manner following ( that is to say ) first I direct all my just debts funeral and testamentary expenses to be paid by my Executors hereinafter named I give and bequeath unto my Executors hereinafter named all my household furniture plate linen china books trinkets and things of a like sort to hold to them their Executors administrators and assigns Upon Trust to sell and dispose of the same either by private contract or public auction for the best price or prices that can be reasonable had or procured for the same and their reciept shall be a sufficient discharge to the purchaser or purchasers thereof who shall not be bound to see to the application or nonapplication of the same and to pay and apply the net proceeds thereof unto and amongst my four Children hereinafter named or such of them as shall be living at my decease in equal shares and proportions I give devise and bequeath unto my said Executors and the survivor of them all the stock that shall be standing in my name in the Books of the Governor and Company of the Bank of England together with all and singular the rest residue and remainder of my real and personal estate and effects of every nature kind and quality that I may have any power to dispose or in any way entitled unto and whether the same shall be in possessin reversion remainder or expectancy To hold to them my said Executors and the survivor of them their and his Executors adminstrators and assigns Upon Trust as soon as conveniently may be after my decease to trasfer pay and apply the same and every part thereof in equal shares and proportions unto and amongst my four Children namely MARY ANN BROWN the Wife of ROBERT BROWN of Jamaica Terrace Limehouse GEORGE CHARLES LIVINGSTON, WILLIAM JOHN LIVINGSTON and CHARLES LIVINGSTON all of Limehouse Sail Makers to hold to them my said four Children their heirs Executors administrators and assigns unto and for their own use benefit and disposal as tenants in common and not as joint tenants and in case any of my said four Children should die in my lifetime the I give devise and bequeath the share or shares of him her or them so dying unto the survivors or survivor of them his her or their heirs Executors administrators and assigns absolutely And I do hereby nominate constitute and appoint my said Sons GEORGE CHARLES LIVINGSTON and CHARLES LIVINGSTON as Trustees and Executors of this my Will hereby revoking and making void all former or other Will or Wills by me at any time or times heretofore made and I do hereby declare this to be and contain my last Will and Testament In witness whereof I the said MARY ANN LIVINGSTON have to this my last Will and Testament in writing contained in two sheets of paper to the first sheet thereof set my hand and to this second sheet and last sheet thereof set my hand and seal this twenty fourth day May in the year of our Lord one thousand eight hundred and twenty five - MARY ANN LIVINGSTON /SS/ - signed sealed published and declared by the said MARY ANN LIVINGSTON the Testatrix as and for her last Will and Testament in the presence of us who in her presence of the request and in the presence of each other hereunto subscribed our names as witnesses JN. TIPPER Clefton Palce Hackney WILLIAM HOWARD Clerk to JN. Tipper - The Mark of MARY ANN PRICE Three Colt Street Limehouse.

Proved at London the 22nd day of January 1840 before the Worshipful Jesse Addams Doctor of Laws and Surrogate by the Oaths of George Charles Livingston and Charles Livingston the Sons the Executors to whom Administration was granted having been first sworn duly to administer.
