The Will of Humphrey Lindsey

 

In the name of God Amen I Humphrey Lindsey of Coate in the parish of Bampton in the County of Oxford Yeoman being aged and infirm in body but of a sound and disposing mind memory and understanding and considering the uncertainty of my so continuing and of this mortal life Do make ordain publish and declare my last Will and Testament in manner and form following (that is to say) First I recommend my soul into the hands of Almighty God my Creator hoping for his mercy thro' Christ and my body I will shall be decently buried at the discretion of my executors hereinafter named and as for the worldly estate wherewith it hath pleased Almighty God to bless me I dispose thereof as follows (that is to say)  First I will that all my just debts and funeral expenses shall be paid and discharged  Also in consideration that my son John Lindsey hath conveyed two parts in three of one undivided moiety or half part of a Close in Coate in the parish of Bampton aforesaid unto my son Edward Lindsey and his heirs and assigns for ever commonly called Huckett Close I do hereby give devise and bequeath unto my said son John Lindsey and his heirs and assigns for ever All those three lands of arable land in the common fields of Aston and Coat in the parish of Bampton aforesaid and three cow commons in Aston and Coat aforesaid which I purchased of and from Richard Fox Also I give devise and bequeath unto my daughter Elizabeth (immediately after the decease of Mary my wife) All that one quarter of one yard land and one quarter of one yard meadow with the commons thereto belonging and one common in West Moor mead in Aston and Coate in the parish of Bampton aforesaid which hath lately been conveyed and assured to me and my heirs and assigns for ever by my said wife after her decease To hold the same immediately after my said wife's decease unto my said daughter Elizabeth Lindsey and her heirs and assigns for ever Also I give devise and bequeath unto my said daughter Elizabeth Lindsey All that one half yard land and one half yard meadow with the commons thereto belonging in Aston and Coate in the parish of Bampton aforesaid which I now hold by lease for years determinable on the lives of my son Edward Lindsey and of my said daughter Elizabeth Lindsey To hold the same unto my said daughter Elizabeth Lindsey her executors administrators and assigns for and during all such term or terms of years estate and interest which I have to come therein Also I give devise and bequeath unto Mary my wife All that one half yard land and one half yard meadow with the commons and appurtenances thereto belonging in Aston and Coate in the parish of Bampton aforesaid which I now hold by lease for years determinable on the lives of my said wife and of my son Edward Lindsey To hold the same unto the said Mary my said wife and her assigns for and during so much of the said term which I have to come Wherein as she my said wife shall happen to live and from and immediately after her decease I give devise and bequeath the same unto my said son Edward Lindsey for and during the residue and remainder of the lessor term of years estate and interest which I am now entitled unto and which shall be then to come therein Also I give devise and bequeath unto my said son Edward Lindsey All that one half yard land and one half yard meadow And also all that one quarter of one yard land and one quarter of one yard meadow with the commons and appurtenances thereunto respectively belonging situate and being in Aston and Coate in the parish of Bampton aforesaid and which I now hold by two several leases for years determinable on the lives of my said son John Lindsey and Edward Lindsey To hold the same unto my said son Edward Lindsey his executors administrators and assigns for and during all and every such respective term and terms of years estate and interest which I have to come therein Also I give and bequeath unto the said Mary my said wife all and singular my household goods and linen whatsoever to be at her own free and absolute disposal Also I give and bequeath unto my granddaughter Sarah Watts the sum of ten pounds to be paid unto her by my executors as soon after my decease as she shall attain the age of twenty one years without interest in the meantime  Also I give and bequeath unto my said son Edward Lindsey all my sheep which I shall be possessed of at the time of my decease Also I give and bequeath unto my said sons John Lindsey and Edward Lindsey all the rest and residue of my goods chattels cattle money and personal estate whatsoever not hereinbefore by me given and disposed of to be equally divided between them share and share alike  And I do hereby make ordain constitute and appoint my said sons John Lindsey and Edward Lindsey joint executors of this my last will and testament and do hereby revoke and make void all former and other wills at any time heretofore by me made    In witness whereof I the said Humphrey Lindsey have to this my last will and testament contained in two sheets of paper to each sheet set my hand and seal this third day of October in the year of our Lord one thousand seven hundred and sixty eight         Humphrey X Signed sealed published and declared by the above named Testator Humphrey Lindsey as and for his last will and testament in the presence of us who at his request and in his presence and sight have subscribed our names as witnesses hereto

This Will was proved at Oxford on the twenty fourth day of August in the year of our Lord one thousand seven hundred and seventy six before the Reverend Samuel Forster Clerk Batchelor of Laws Surrogate of the Worshipful Thomas Bower Doctor of Laws Official Principal of the Reverend the Archdeacon of the Archdeaconry of Oxford lawfully constituted by the oaths of John Lindsey and Edward Lindsey the sons of the deceased and executors therein named to whom administration was granted being first sworn duly to administer
