Will of Peter Leyland – Died 4th April 1847

 

The Will Of Peter Leyland Dated 8th April One Thousand Eight Hundred and forty sixth year.

In The Name of God. Amen
I Peter Leyland of the Township of Windle in the Parish of Prescot in the County of Lancaster. Being weak in body but sound in mind and understanding praised Be In Almighty God do Hence provoke and make void all former wills cordials and all others testamentary dispositions made by me at any time orlines here to follow and I do publish and declare this to be my last will and testament by vertue of every right and power cohalso ever enabling me in this behalf. In the first place I will and direct that all possible speed after my death executor here in after mentioned. I give devise and appoint all those my five house numbered 1, 2 , 3, 4 and 5 situated in Windle aforesaid with gardens lands rights members and appurtenances the unto belonging together with my estate and interest in them as also inall ives of coal beds or vaines of coal and minerals of what nature or kind even under said five houses gardens lands and premises. Also all my right estate and interest in all that my ninth shares in certain mines or beds and veins of coal and minerals of what nature or kind so even lying and being under a certain meddow called or known by the name of the Brook Meadow but now under water also all right estate and interest in the said Meadow situated in Windle aforesaid at or near to Merton Bank. Also all and singulare my household furniture, plate glass, china of what nature or kind service I may diesieged as professed of unto Edward Morgan of Parr Hall agent his thevis and assignes to

the uses upon and for justs intents and purposes and with under and subject to the power provisions and declaration hence after expensed and contained of and concerning the same. That is to say I will and direct give devise and bequeath unto my wife Elizabeth Leyland tho rents, profits and emoluments of and arising from and out of all my five said houses numbered 1, 2, 3, 4 and 5 situated in Windle aforesaid together with the use of all my household furniture, plate glass and china aforesaid during her nature life and at and after the death of her my said wife I give devise and bequeath unto my daughter Ann Leyland one half of all rents and profits arising from and out of my real and personal estate during her natural life and at the death I give and bequeath one half of all rents and profits arings from and out of my real and personal estate unto Elizabeth Leyland natural daughter of her my daughter Ann Leyland. Now about the age of her years, at her attaining the age of twenty one years as herown for ever, but should the said Elizabeth Leyland die under the age of twenty one years without leaving lawful living issue of the body, then and int he case I will and direct tho half share of rents and profits aforesaid to be divided into and amung my son Charles Leyland and my daughter Margaret Chisnall wife of Thomas Chisnall and there heirs and assigns all share and share alike. I give devises and bequeath the other noiely or half share of the rents unto my son Charles Leyland and unto my daughter Margaret Chisnall aforesaid as their own forever. Tho my will and intention is that at and as soon after the death of her my said wife Elizabeth Leyland

all my right title interest in all those my five dwelling houses with their gardens and apprentenances with all my right title interests in all mines of coal and minerals whether to under the said premises as well as under the platlo meadow aftersaid or also hence together to with my household furniture, plate glass and china aforesaid to be sold by my executors hereince after mentioned either by public auction or private contract fot the most money that law begotten for the same or sales into and amongest my children as before decided upon, to my son Charles Leyland one full fouty shares to my daughter Margaret Chisnall one full forty shares and to my daughter Ann Leyland two full forty shares she being of weak and unsound mind and at her death to Elizabeth Leyland her natural child the said full Forty shares as before devised. I give my clothes to my son Charles Leyland. I herby appoint Edward Morgan of Parr Hall agent my executor of this my will and I herby declare my will and mind to be that receipt aspeceipts of him my said executor in righting shall be good and sufficient discharge and discharges in the law to be the person or persons to when the shame shall be divided. In the witness where ence of I the said Peter Leyland have to this my last will and testament sent my hand and seal that is to say I hand to the bottom of the two proseding pages and my hand shall seal to this the third sheet of paper on this the eighth day of April in the year of out lord one thousand eight hundred and forty six

Signed sealed published and declared by the within named Peter Leyland the testator as any for his last will and testament in the presence of us who in his presence at his request and in the presence of each other here unto subscribed our names as witnesses on this eighth day of April in the year one thousand eight hundred and forty six year

To this conceal to my will and I wish and direct it to be received as such whereas I have directed all my household furniture to be sold at the death of my wife Elizabeth Leyland. I give devise and bequeath unto my daughter Ann Leyland one feather bed with one steads and the appureturences these upon belongings as her own for ever this 8th April in the one thousand eight hundred and forty six year.

Edward Morgan the sole executor in this will was sworn in common form and further then made oath that the testators personal estate and effects within the diverse of Chester were under the valling one hundred pounds before me

 

The testator died on the 

Fourth day of April in the one thousand eight hundred and forty seven year.
