The Will of John Smith Lee
This is the last Will and Testament of me John Smith
Lee of 122 Market Street Hoylake in the County of Chester Market Gardener
and Grocer. I hereby revoke all former Wills and declare this only to be my
last Will and Testament. I appoint my Wife Louisa Lee and my son Henry Lee
(who are hereinafter referred to as “my Trustees”) to be Executors and
Trustees of this my Will. I bequeath to my said Wife Louisa Lee the use of
my household furniture and effects for her life during her Widowhood for her
life during her Widowhood and after her death or remarriage I declare that
the same shall go to and form part of my residuary personal estate. I give
devise and bequeath all my real and personal estate whatsoever not hereby
otherwise disposed of unto my Trustees upon trust to sell call in and
convert the same (subject to the directions as to the Goodwill and assets of
my business hereinafter contained) into money and thereout in the first
place to pay my just debts funeral and Testamentary expenses and then to
stand possessed of the residue thereof (hereinafter called my residuary
estate) subject to the directions hereinafter contained as to the employing
the whole or part thereof as capital for my said business on the following
trusts that is to say – I direct my Trustees if and for so long as they in
their absolute discretion shall think fit so to do and so long as a profit
may be made thereby to carry on my business of a Market Gardener and Grocer
upon the said premises where such business is now carried on by me or at
such places as they may think fit and for that purpose to employ capital in
such business all book debts which at the time of my death shall be owing to
me in respect of such business and all my stock in trade and the whole or
such other part of my moneys or other personal estate as they may think
necessary in addition to the said stock and book debts and with liberty to
employ such managers assistants and servants as they may think necessary and
in particular I direct that my said son Henry Lee shall be employed as
Manager of the said business at such remuneration as may be mutually agreed
between my said Wife and him And I direct my Trustees to pay to my said Wife
for her life until her remarriage the net earnings of my said business
whilst the same shall be carried on And upon the death or remarriage of my
said Wife I give and bequeath my said business and all the assets thereof to
my said son Henry Lee for his own use and benefit absolutely And as to the
whole of my said residuary estate which shall not from time to time be
required for my said Trustees to be used as capital in my said business I
direct that my Trustees shall invest the same upon any of the securities
authorised by law or upon mortgage of real Estate in England or Wales I
authorise my Trustees to retain in its actual state of investment without
being responsible for loss any investments made by me during my lifetime
whether of an authorised nature for the investment of trust funds by
Trustees or not and all moneys liable to be invested under this my Will for
so long as they shall think fit or shall at any time or shall at any time or
times at their discretion sell call in and convert into money the same or
any part thereof and invest the moneys produced thereby in the names of my
Trustees in or upon the investments hereinbefore authorised for the
investment of Trust money And I direct my Trustees to stand possessed of
such investments and of the income thereof upon trust to pay the rents
dividends and annual income thereof to my said Wife during her life until
her remarriage and at the death or remarriage of my said Wife which shall
first happen upon trust of my said Son Henry Lee for his own absolute use
and benefit And I declare that my Trustees may postpone the sale and
conversion of my said real and personal estate or any part thereof for so
long as they shall think fit and that the rents profits and income to accrue
therefrom shall after payment thereout of all incidental expenses and
outgoings be paid and applied to the persons and the manner to whom and in
which the income of the moneys produced by such sale and conversion would
for the time being be payable under this my Will if such sale and conversion
had been actually made. In witness whereof I have hereunto set my hand this
ninth day of December one thousand nine hundred and eighteen John
