The Will of James Lee

 

This is the last Will and Testament of me James Lee of the Lower Lighthouse at Hoylake in the Parish of West Kirby in the County of Chester which I make this thirty first day of March one thousand eight hundred and fifty eight. I direct payment of all my just debts and funeral and testamentary expenses. I give and bequeath the clock belonging to me in the aforesaid Lighthouse unto my Granddaughter Ruth Bird I devise my cottage in the Township of Hoose in the said Parish now in the occupation of Mr Chatterton with the appurtenances and together with one third part of the two gardens belonging to me behind this and my two adjoining Cottages unto my son Thomas Lee and his heirs for ever I devise my Cottage in the said Township now in the occupation of Samuel Parr with the appurtenances and together with one third part of the two gardens unto my son James Lee and his heirs for ever I devise my Cottage in the said Township now in the occupation of George Dean with the appurtenances and together with one third part of the said two gardens unto and to the use of my Executors hereinafter appointed their heirs and assigns Upon trust to pay the rents and profits thereof unto my daughter Margaret the Wife of Henry Bird during her life for her separate use free from the control and debts of her present or any future husband and so that my said daughter shall have no power to anticipate the same And after the decease of my said daughter In trust for such of her children and their heirs as she shall by deed or Will notwithstanding coverture appoint And in default of such appointment In trust for her children equally and their heirs and in the event of her leaving no children In trust for such person or persons and for such estates as she shall by deed or Will notwithstanding coverture appoint And in default of such appointment In trust for the right heirs of my said daughter for ever And I direct that the said two gardens shall be equally divided among the said devisees of the said three Cottages I give and bequeath the remainder of my estate and effects unto and equally between my children living at my decease their heirs executors administrators as or in the nature of tenants in common according to the nature and quality thereof respectively I devise all real estates vested in me as trustee or mortgagee unto my Executors hereinafter named their heirs and assigns Upon the trusts and subject to the equities affecting the same respectively I appoint my sons the said Thomas Lee and James Lee Trustees and Executors of this my Will And lastly revoking all former Wills Codicils and Testamentary dispositions by me at any time heretofore made I declare this to be my last Will and Testament In Witness whereof I have hereunto set and subscribed my name and handwriting the day and year first before written
