This is the last
Will and Testament of me Humphry Lear
of Motcombe in the County of Dorset Yeoman made the thirtieth
day of September one thousand eight hundred and sixty two First
I direct all my just debts funeral and testamentary expenses to
be paid by my Executor hereinafter named I give and devise unto
my son Thomas Lear all that my copyhold estate situate near
Sherborne Causeway in the said parish of Motcombe late Woolcotts
and now in my own occupation To hold to him his heirs and
assigns for ever subject and charged nevertheless with the
payment of the weekly sum of fourteen shillings to my dear wife
Ann for and during her natural life to be paid her by even and
equal quarterly payments that is to say Lady day Midsummer day
Michaelmas day and Christmas day, the first payment to be made
on such of the said days which shall next happen after my
decease and I empower my said wife by distress and also by entry
upon and perception of the rents and profits of the said
hereditaments to recover payment of the said weekly sum when in
arrear. I also charge my said estate so devised to my said son
with the payment of one hundred pounds to my daughter Rebecca
the wife of William Hopkins and with the like sum of one hundred
pounds to my daughter Jemima the wife of John Elkins to be paid
them in Twelve months next after my said decease I give and
devise unto my son Charles Lear all that messuage or dwelling
house (used as two dwellings) with its appurtenances now
occupied by me and my son Charles Lear situate at Sherborne
Causeway aforesaid To hold to him his heirs and assigns for ever
subject nevertheless to my said wife having the free use of one
of the said dwellings and one half of the garden during her life
without paying any rent for the same. I desire my said wife may
have the use of my household goods during her life and after her
decease I give and bequeath the same to my said son Charles I
also give and devise unto my son Charles my two cottages on the
south side of the Turnpike Road leading to Sherborne and now
occupied by William Bridle and Joseph Hunt To hold to him my
said son Charles his heirs and assigns for ever And lastly all
the rest residue and remainder of my personal estate and effects
whatsoever and wheresoever I give and bequeath unto my said son
Charles to and for his own absolute use and benefit. I nominate
and appoint my said son Thomas Lear Executor of my said Will and
do revoke all former Wills by me made In witness whereof I
have hereunto set my hand the day and year first above

the foot or end hereof in the joint presence of us who at his
request in his presence and in the presence of each other have
subscribed our names as witnesses

Whereas I have by my
last Will and Testament written on the other side of this sheet
of paper desired that my wife may have the use of my household
goods during her life and after her decease I have given the
same to my son Charles Lear Now I do hereby revoke the said
bequest and instead thereof give and bequeath my said household
goods unto my said wife absolutely In witness whereof I have
hereunto set my hand the seventh day of February one thousand
eight hundred and sixty three

On the fourteenth day
of May 1864 the Will and Codicil of Humphry Lear late of
Motcombe in the County of Dorset Yeoman was proved by the oath
of Thomas Lear of North Brewham in the County of Somerset Yeoman
son of the deceased the sole Executor named in the said will he
having been first sworn duly to administer.
