This is the last Will and Testament of me Thomas Kirsopp of Marley Coatwalls in the Parish of Slaley in the County of Northumberland Yeoman ffirst I will order and direct that all my just debts and funeral expences and the expences of proving this my will shall all be paid and discharged by my Executors hereinafter named as soon as conveniently may be after my decease Item I give devise and bequeath unto my brother John Kirsopp and my friends Nicholas Surtees of Dain House near Ponteland and William Rochester of the Linnells near Hexham their heirs executors administrators and assigns respectively All my messuages tenements and hereditaments situate at Marley Coatwalls aforesaid And all other my real estate whatsoever And also my Personal Estate and effects whatsoever and wheresoever and of what nature or kind soever the same may be upon the trust to and for the intents and purposes hereinafter mentioned and declared of and concerning the same that is to say Upon trust to receive the yearly rents interest and produce of all my said estate and effects and pay the same over to my said dear wife for and during the term of her natural life in case she shall continue my widow and unmarried to and for her own use and benefit she my said wife or her assigns well and sufficiently maintaining and educating all my children out of the same rents interest and produce until all my children shall attain the respective ages of twenty one years in case my said wife shall so long continue my widow and unmarried and from and immediately after the death or marriage of my said wife which shall first happen all my said real and personal estate so charged and chargeable as aforesaid shall be in trust for my Sons John Kirsopp and Thomas Kirsopp and all and every such other child and children as I shall have living at the time of my death or with whom my said dear wife shall then be….to take the same equally between or among them if more than one as tenants in common and not as joint tenants and their several and respective heirs executors administrators and assigns according to the respective natures of such real and personal estate subject nevertheless in case of the death of any of my said children under the age of twenty one years without having been married for the portion or portions of such child or children so dying as aforesaid to arrive and belong to the other or others of them and to be paid equally among or between them if more than one share and share alike and if only one then the whole to be paid to such one child And my will is and I do hereby expressly declare that my said trustees and executors and the survivor or survivors of them and the executors and administrators shall not be charged or chargeable with or accountable for more monies and effects than that he or they shall actually receive or shall come to his or their respective hands by virtue of this my will nor with or for any loss which shall happen of my said estate and effects or any part thereof so such loss happen without their wilful default or the one of them for the others or other of them or for the acts deed receipts defaults or disbursements of the others or other of them but each of them for himself and for his own acts deeds heirs executors administrators only And also that it shall and may be lawful For them my said trustees and executors and each and every of them their and each and every of their executors and administrators in the first place by and out of the premises respectively to deduct and reimburse him and themselves all such loss costs charges and expences as they or either of them shall sustain expend or be put unto or by reason of the performance of this my will or any other thing in anywise relating thereunto also I hereby appoint the said John Kirsopp my Brother and the said Nicholas Surtees and William Rochester joint Executors of this my Will And I hereby revoke all former and other will and wills by me at any time heretofore made and declare this only to e and contain my last will and testament In witness whereof I have set my hand and seal this nineteenth day of June in the Year of our Lord one thousand eight hundred and twenty three_  Thomas Kirsopp

At London 24 December 1842 Administration with Will annexed granted to Mary Kirsopp Widow the Executors having died without taking upon them the execution of the Will
