The Will of Thomas Kimpton

 

This is the last Will and Testament of me Thomas Kimpton of Lethington in the County of Cambridge Yeoman ffirst I give and devise all Hereditaments at Litlington in the County of Cambridge or in any adjoining Parish unto my Executors hereinafter named and their Heirs until my Eldest Son Thomas Kimpton shall attain his Age of twenty one Years or in case of the Death of the said Thomas Kimpton before he attains his said Age then until my next Surviving Child shall attain his or her Age of twenty one Years upon Trust by and out of the Rents and Profits of the said Premises to maintain and bring up my three Children and to maintain my Wife until my said Son shall attain his said Age And from and after my said Sons attaining his Age of twenty one Years Then I give and devise the said Premises unto and equally among my two Sons Thomas Kimpton and William Kimpton and their Heirs charged nevertheless with the Payment thereout to my Daughter Mary Kimpton of the Sum of two hundred Pounds on her attaining her Age of twenty one Years And charged with the Payment thereout of the sum of Eight Shillings a week to my Wife Elizabeth Kimpton during her Life And also with the Payment thereout of five Pounds a Year to my said Wife for Cloaths Which Payments of eight Shillings a Week and five Pounds a Year to my Wife shall begin to grow due from my said Eldest or Surviving Child attaining the said Age of twenty one Years Also I give all my Leasehold in Oxford Street in the County of Middlesex And other my Leasehold Estates unto my Executors In Trust to make Sale and dispose thereof And to apply the Money arising from such Sale or Sales in Payment of the Mortgage due on my Estate at Litlington And I give and bequeath All the Rest and Residue of my Personal Estate and Effects unto and equally among my three Children share and share alike the same to be applied for their benefit by my Executors during their Minority and the Residue to be divided among them on their attaining their Ages respectively of twenty one Years And whereas my ffarm at Litlington was bequeathed to me with some Limitations over after my Decease in Certain Events by a Will which I have not now in my Custody and which I cannot at Present refer to Now in Case by Virtue of any such Limitations the above devise of my said ffarm should become void and incapable of taking Effect And my Eldest Son should by Virtue of such Limitations come into the absolute Possession of the said ffarm or contrary to this my Will then from and after the annulling of the said Devise contained in this my Will or my Eldest Son refusing to confirm the same I revoke the Devise of the Leasehold Estates and of the Residue of my Personal Property hereinbefore contained And in that Case I give the Produce of my said Leasehold Estates and of the Residue of my Personal Property unto And equally Among my Youngest Son William and my Daughter Mary and my Wife Elizabeth share and share alike And in such aforesaid Case or Event I exonerate my Personal Property from the Payment of the said Mortgage And I charge the said Mortgage on the said Estate at Litlington only as far as I have power to do so such last mentioned Revocation and substituted Bequest or devise being only intended to take Effect in case the devise hereinbefore contained of my Estate at Litlington shall be void and incapable of taking Effect by reason of the Limitation hereinbefore referred to And lastly I appoint my beloved Wife Mary Kimpton during her Widowhood and my Brother William Kimpton joint Executors of this my Will and in Case my Wife shall marry again then from and after such Second Marriage

I appoint my said Brother William Kimpton sole Executor of this my Will In Witness whereof I have hereunto set my Hand and Seal this fifteenth day of September in the Year of our Lord One thousand eight hundred and eight The Mark and Seal of Thomas Kimpton
