The Will of John Kimpton

 

In the Name of God Amen I John Kimpton of Tooley Street Southwark in the County of Surry Victualler being weak in body but of sound mind memory and understanding do make this my last Will & Testament in manner following in the first place I desire to be decently buried at as small expence as may be I give & bequeath unto Peter Crawford of Tooley Street Southwark aforesaid Lighterman & Joseph Spencer of East Barnett in the County of Herts ffarmer who together with my Wife I hereinafter name Exors of this my Will all those my seven Leasehold Messuages or Tenements & Premises with the Appurts …whereof are situate in hackney Road in the County of Middx & the remaining two in the Kent Road also all my Estate & Interest in three other Leasehold Houses in the Kent Road aforesaid for which I receive a Ground rent of five pounds per annum & also all my Stock in Trade household Goods & ffurniture & also all other my Personal Estate & Effects wheresoever & of what nature or kind soever upon trust to pay over unto my dear Wife Ann Kimpton the rents & profits of my said Leasehold Estates & permit & suffer her to take to her own use & benefit the Stock in Trade Household Goods ffurniture & Effects for & during the term of her natural life if she shall so long continue my Widow (but not otherwise) provided always nevertheless that in case my son William Kimpton shall attain the age of 21 years before the death of my said Wife or her marrying again then upon trust that my said trustees or the Survivor of them or the Exors or Admors of such Survivor shall & do assign over one Moiety or equal half part of the said Leasehold Estates & also a Moiety of the said Household Goods Stock in Trade & Effects or the profits & benefits thereof unto my said Son William Kimpton his Exors Admors & Assigns & from & immediately after the decease of my said Wife or her marrying again which shall first happen then I Give & bequeath all & every my said Leasehold Estates Stock in Trade Household Goods ffurniture personal Estate & Effects unto my said Son William Kimpton his Exors Admors & Assigns to & for his & their use & benefit charged & chargeable nevertheless in the event of my said Wife’s not being then decd but only marrying again with the payment for & during her natural life of an Annuity or clear yearly Sum of fforty pounds free from all taxes & deductions whatsoever & to be paid & payable quarterly at Christmas Day Lady Day Midsummer & Michaelmas in every Year the first of such Payments to begin & be made on such of the said feasts or days of payment as shall first happen after her marrying again & I do hereby Give & bequeath the Annuity to my said trustees accordingly Upon trust to pay the same as they shall receive it to my said Wife & I direct that the same shall not be subject to the controul Debts or Engagements of her future husband but shall be at her own absolute disposal & her receipts shall be a sufficient discharge to my trustees I Give & bequeath unto my dear Mother Mary Kempton & her assigns for & during the term of her natural life an Annuity or clear yearly sum of five pounds clear of all taxes & deductions whatsoever to be payable half yearly at Midsummer & Christmas the first payment to begin & be made on the first of such feast days that shall next happen after my decease & I hereby charge all my said Personal Estate with the Payment of the last mentioned Annuity & in addition to the said Annuity I Give unto my said Dear Mother the Sum of five pounds for Mourning to be paid to her immediately after my decease & lastly I Appoint my said Wife Amy Kempton the said Peter Crawford & Joseph Spencer Executrix & Exors of this my Will & I Give to each of them the said Peter Crawford & Joseph Spencer the Sum of five pounds for their trouble & I hereby direct that my said trustees & Exors or either of them shall not be responsible or accountable the one of them for the other of them or for the Acts Deeds receipts disbursements neglect or default of the other of them but each for himself only & also that it shall & may be lawful for my said Trustees & Exors & each of them out of my said Estates & Effects or the Monies arising therefrom to deduct & reimburse himself & themselves respectively all such costs Charges & Expences as he or they shall sustain expend or be put unto in or about the execution of this my Will or the trusts thereof & I hereby revoke all former & other Wills by me at any time made & declare this present contained in two sheets of paper to be my only last Will |& Testament In Witness whereof I have hereunto set my hand & seal this 12th day of July in the year of our Lord 1809 John Kimpton
