The Will of William Kenny

 

This is the last will and testament of me WILLIAM KENNEY, of GREAT MASSINGHAM in the county of Norfolk, Wool Merchant, made the thirtieth day of September in the year one thousand eight hundred and fifty six.
First I nominate, constitute and appoint my brother JOHN KENNEY of Great Massingham aforesaid Postmaster and JOHN MARSTERS of King's Lynn in the said county Merchant, executors of this my last will . And I give the sum of ten pounds to the said John Kenney for his trouble in the execution of this my will , exclusive of his necessary costs and expenses.
I give and devise and by virtue of all powers in anywise enabling me in that behalf appoint unto my said brother John Kenney all and singular my real estates whatsoever and wheresoever situate and of what nature, or kind soever the same may be to hold the same unto and to the rest(?) of him my said brother, his heirs and assigns for ever.
And I give and bequeath unto the said John Kenney and John Marsters all my household furniture, plate, linen, china, monies and securities for money and all other my personal estate and effects whatsoever and wheresoever and of other nature or kind soever the same may be upon trust that they or the survivor of them or the executors or administrators of such survivor do and shall as soon as conveniently can be after my decease in such manner and form and in all respects as they or his discretion shall think proper absolutely sell and dispose of all such parts of my said personal estate and effects as shall be in their nature saleable and call in, recover and receive of all debts, sum and sums of money which may be out and owing to me at the time of my decease on any amount whatever. And I trust my said executors or the survivor of them, or executors or administrators of such survivor to stand possessed of the monies to arise from such sale, collection and conversion of my said personal estate and effects (after payment and satisfaction of all my just debts, funeral and testamentary expenses and all expenses incidental to the execution of the trusts of this my will upon trust to pay the following legacies, namely
I give and bequeath to the said John Marsters the sum of four hundred pounds .
I give and bequeath unto the children of my said brother John Kenney as shall be living at the time of my decease the sum of forty pounds each.
Unto each of of the children of my late brother EDMUND KENNEY as shall be living at my death the like sum of forty pounds each.
Unto each of the children of my sister ANN WRIGHT , widow, as shall be living at my decease the like sum of forty pounds each.
Unto MARY ANN, the only daughter of my sister CATHERINE KENNEY the like sum of forty pounds
Unto SUSAN GRAY (late GRAVE) of the City of Norwich, the sum of forty pounds
And unto ELIZABETH BATTERBEE, late PRYOR, for nursing and assistance over and above her daily pay the sum of nineteen pounds and nineteen shillings to be paid to her within one month after my decease.
And all the rest, residue and remainder of my said personal estate and effects I give and bequeath as follows :
namely
One fifth part thereof I give to my said Brother JOHN KENNEY
One other fifth part thereof I give to my sister MARY FARMAN widow.
One other fifth part thereof I give to my said sister ANN WRIGHT
One other fifth part I give to my said sister CATHERINE KENNEY
And the remaining fifth part I give to my sister ALICE KENDLE and MARY BOULTER late the widow of my said brother EDMUND KENNEY to be equally divided between them. But in case any or either of them my said brother John Kenney and my said sisters Mary Farman, Ann Wright and Catherine Kenney to each of whom I have given one fifth part of my said residuary personal estate shall happen to die in my lifetime, then I give and bequeath the share or shares of such one or more of them so dying unto the survivors or survivor of them in equal shares. And it is my will and mind I hereby ..... that in case any of the said legatees shall be indebted to me at the time of my decease in any sum or sums of money or note or otherwise such sum or sums of money shall be deducted from their his or her share or shares and be considered as part thereof.
And I will and devise all estates vested in me as mortgagee unto the said John Kenney and John Marsters, their heirs and assigns upon the trusts and subject to the equities affecting the same respectively.
And I devise that my said Executors, their executors or administrators shall be responsible only for so much money as shall come to their respective hands by virtue of the trusts hereof. And that they shall not be answerable for any loss which shall happen in the execution of the aforesaid trusts, except the same shall happen through his or their own wilful neglect or default nor be answerable or accountable for the arts,.... receipts or defaults of each other. And I empower my said executors , their executors and administrators to retain and allow to each other all costs incurred in the execution of the trusts of this my will or in relation thereto.
And lastly, revoking all former wills by me at any time heretofore made I do declare this to be and contain my last will and testament, in witness whereof I the said William Kenney the testator have to this my last will and testament written on three sheets of paper to the two preceding sheets set my hand and to this third and last sheet set my hand and affixed my seal the day and year first above written W Kenney (Tst) ...., .... published and .... by the said William Kenney the testator as and for his last will and testament in the presence of us present at the same time who in his presence at his request and in the presence of each other have subscribed our names as witnesses.
JOHN KING JARVIS, FRANK MARSTERS

This is a codicil to my last will and testament bearing date the thirtieth day of September one thousand eight hundred and fifty six. I give and bequeath unto HARRY, the infant son of HORATIO BECK of HARPLEY in the county of Norfolk, Gentleman, the .... or .... of one hundred pounds which I direct my executors to pay to the said Horatio Beck for the benefit of his said son and the receipt(?) of the quit, Horatio Beck shall be in good behaviour to my said executors for the quit and I ratify and confirm my said will in all other respects.

On witness written , I William Kenney have hereunto set my hand this twelfth day of May one thousand eight hundred and fifty nine W Kenney Signed and delivered by the said William Kenney as and for a codicil to his last will and testament in the presence of us who in his presence at his request and in the presence of each other in presence at the same time have hereunto subscribed our names as witnesses.

Proved in London with a codicil 13th July 1860 by the oath of John Kenney the brother and John Marsters, the executors to whom administration was granted.
