The Will of Thomas Kempe

 

In the Name of God Amen the Twentieth day of March in the yeare of our Lord God accordinge to the computation of the Church of England One Thousand Six Hundred and ffifty Thomas Kempe of Dorkinge in the County of Surrey being aged and weake in body but of sound and perfect memorie (praysed be the Lord therefore) yet considering the uncertainbtly of this transitory life and knowinge my continuance cannot be longe upon Earth Renouncinge and Disannullinge all former Wills whatsoever by me made and published heretofore doe make and declare this my last Will and Testament in manner and forme followinge Wherein I doe first bequeath and yeild my Soule into the hands of Almighty God that gave it and my body to the earth untill the Resurrection hopeing by the merritts of the death and passion of my onely Saviour and Redeemer Jesus Christ and by no other meanes to have Remission of all my sinnes and enjoye eternal life in the Kingdome of Heaven And I will my body to be burried in such seemely and decent order as my Executrixes hereafter named shall think fitt willing that all such debts dutyes some or somes of money as I shall truely owe to any person or persons Whatsoever at the tyme of my decease shalbe paid by my Executrixes hereinafter named within convenient tyme after my decease And touchinge the disposal of all and singular such Lands Tenements goods and Chattles as God hath blessed me withal in this life I give and bequeath the Same in manner and form followinge And first I give and bequeath unto Jane Kempe my daughter one Annuity or yearely Rent Charge of Tenn Shillings of lawfull money of England to be yearely issuing out and to be paid unto the said Jane Kempe dureinge the terme of her naturall life out of my Messuage or Tenement and backeside with th... Situate standinge and beinge neare the Markett Range of Dorkinge aforesaid and now in my owne tenure and occupation To be paid yearely at the foure most usuall feast e dayes or termes of and in the yeare (that is to say) att the feast of Annunciation of Mary the blessed Virgin the Nativity of St John Baptist St Michaell the Archangel and the Nativitie of the Lord and Saviour by even and equall portions the full payment to begin and to be made at the first of the said feasts as shall happen after my decease, And if it shall happen the said Annuitie or yearely rent charge of Tenn Shillinges or any part or parcell thereof to bee behind and unpaid in parte or in all by the space of Tenn dayes from and after any of the said feast or dayes of payment thereof in which as is aforesaid ought to be paid and by all that tyme not paid That then and from thenceforth and att all tymes after itt shall bee good and lawfull to and for the said Jane Kempe or her Assignes unto the said Messuage or Tenement and backside to enter and distrayne and the distresse or distresses then and there soe had and f...mes lawfully to loade drive beare and carry away and the same to detayne .....and keepe untill the said Annuity or yearely rent charge of Tenn Shillinges and the overages thereof yf and be shall unto the said Jane Kempe or her Assignes fully satisfied contented and paid Item I give and bequeath unto Henry Gosden of Dorking aforesaid Draper and to Henry Trigge of Dorking aforesaid Chandler All my Messuage or tenement and backeside before mentioned (the Annuitie aforesaid excepted) To have and to hold from and after my decease unto the said Henry Gosden and Henry Trigge and their heires forever To the Uses intents and purposes hereafter expressed And to and for other Use or Uses intents and purpose whatsoever (that is to say) To and for the use and behoof of Elizabeth my nowe Wife for and dureinge the terme of her naturall life (if the said Elizabeth shall for so longe continue unmarried)The remainder thereof unto Thomas Kempe and John Kempe my two younger Sonnes and to their heires males of their bodyes Lawfully begotten and for want of such issue the Remainder thereof for William Kempe my Eldest Sonne and the heires males of his body lawfully begotten for ever for want of such issue to the right heires of me the said Thomas Kempe the Testator forever Item my will intent and meaninge further is That if my said wife shall happen to marry againe with any other man after my decease That then she shall hold and enjoye the Messuage or Tenement and backside aforesaid dureinge the residue of her naturall life she payinge the Annuity of Tenn Shillinges aforesaid unto my said Daughter Jane And after payeinge the yearely rent or some of Thirty Shillinges of lawfull money of England yearely and every yeare dureinge her said life (from and after such her marriage) unto the said Thomas Kempe and John Kempe and the heires males of their two bodyes and for want of such issue unto the said William Kempe and the heires males of his body lawfully begotten for ever and for want of such issue to the right heires of me the said Thomas Kempe the Testator forever Att the feast of Annunciation of Mary the blessed Virgin the Nativity of St John Baptist St Michaell the Archangel and the Nativitie of the Lord and Saviour by even and equall portions to be paid And if it shall happen the said yearly rent of Thirty Shillinges or any part or parcell thereof to bee behind and unpaid in parte or in all by the space of ffowrteen dayes over and after any of att all tymes after itt shall bee good and lawfull to and for the said Thomas Kempe and John Kempe and the heires males of their two bodyes if they have any And if they both of them shall decease and have noe issue male lawfully begotten behind them Then to and for the said William Kemp and the heires male of his body lawfully begotten and for want of such issue to the right heires of me me the Testator unto the said Messuage or Tenement and backside with the appurtenances wholely to enter and the said to hold have possess and enjoye as their own proper estate And the said Elizabeth my wife from thence utterly to expell amove and putt out any thinge aforesaid to the contrary notwithstanding Item I give unto Martha my daughter wife of Thomas Crawley the Some of fforty Shillinges of lawfull money of England to be paid unto her out of the Rents and Profitts of my said Messuage or tenement with the appurtenances within two yeares next after the decease or next marriadge of my said Wife (which of them soever first shall happen) Item I give and bequeath unto William Kempe my sonne the some of Tenn Powndes of lawfull money of England to be paid unto him out of the Rents and Profitts of my said Messuage or tenement within three yeares after the decease of my said Wife Item I make Henry Gosden and Henry Trigge aforesaid Overseers of this my last Will and Testament desireinge theire care to see the same performed according to my trust in them reposed and my true meaninge herein declared And I doe give to either of them the soem of twelve pence to be paid unto them by my Executrixes hereinafter named besides their charges And my will intent and meaninge is that if the said severall....somes of fforty shillinges bequeathed to my said Daughter Martha and Tenn Pounds bequeathed to my said Sonne William aforesaid shall not be paid unto them within the several termes before lymitted for payment thereof by my said sonne Thomas and John or their heires yf thee shalbe any or the said Some of fforty shillinges bequeathed to Martha yf my said sonne Thomas and John shall happen to dye before the tyme of payment thereof and leave noe yssue male behind them shall not be paid by my said sonne William or his heires out of the rents and profitts of my said messuage or tenement aforesaid That then I do appoynt the said Henry Gosden and Henry Trigge to enter upon my Messuage or tenement aforesaid with the appurtenances and the same to devise and ...lett and the rents and profitts thereof the revenue......and take up untill the legacies aforesaid shalbe fully satisfied contented and paid Any thinge aforesaid to the contrary notwithstandinge And my Will and meaninge is And I doe hereby make and ordayne Elizabeth my wife and Sarah my daughter the wife of John Lee of Dorking aforesaid husbandman Joynt Executrixes of this my last Will and Testament to whome after my debts legacies and funerall expences shalbe discharged I give all the rest and residue of my goods and chattles to be equally devided between them And my Will intent and meaninge further is that if my said wife shall dye.......all my said goodes dureinge the space of two yeares after my decease yf she so long live and continue unmarried soe as within one month after my decease shee my said wife doe give sufficient security to the said John Lee and Sara my daughter in the meane time not to embezzell or wilfully waste or spoyle the said goods but peaceable and quiet without...to deliver upp the moyetie of the said goods unto the said Sara her Executors or assignes either at the tyme of her aggaine marriage or at the end of two yeares after my decease or at her decease which soever of them shall first happen In witness whereof I have hereunto sett my hand and seale the day
