The Will of Thomas Jordan

 

In the Name of God Amen I Thomas Jordan of Birmingham in the County of Warwick Gunsmith being Weak in Body yet of Sound and Perfect Mind and Understanding (Praised be God for the same) Do for the Setling of my Estate make this my last Will and Testament in manner following (that is to say) ffirst my Will and Desire is that my Just Debts and ffuneral Expences shall in the first place be paid and Discharged Whereas my late father Edward Jordan late of Birmingham aforesaid Esq deceased in and by his last Will and Testament in Writing duly Executed did amongst other things Vest Several Trusts or Trusts in me as in and by the said Will relation being thereunto had may Appear Now I the said Thomas Jordan by Virtue of the Power or Powers so in me Vested Do hereby Give Direct and Appoint all and every such Power and Powers unto my Executors hereinafter named And I do hereby further Direct and Appoint and my Will and Desire is that my said Executors shall use their utmost Endeavours to Amiably end all Disputes and Differences betwixt me and the Executors of the late Lord Dudley deceased And I do hereby further Direct and Appoint that all my Personal Estate shall be liable to the Payment of such Sum or Sums of Money that shall be necessary and required for the Performance of the Trusts above mentioned And in case the same shall not be sufficient then my Mind and Will is that my said Executors their Heirs and Assigns shall and may by Sale or Mortgage of any Part of my ffreehold Estates to raise such Sum or Sums of Money as there shall be Occasion for to discharge the same Item I Give Devise and bequeath unto my three Daughters Catherine Jordan ffrances Jordan and Ann Jordan and to their Heirs and Assigns for ever All and singular my ffreehold Messuages .... Lands Tenements and Hereditts whatsoever and wheresoever To hold as Tenants in Common and not as Joint Tenants and also all my Personal Estate of what Kind Nature Quality or Condition Soever equally to be Divided betwixt them Share and Share alike And I do hereby direct and Appoint the Tuition Custody and Guardianship of my said three Daughters unto Edward Audley of Birmingham aforesaid and John Waller of Birmingham aforesaid Gentleman until they shall Severally and respectively attain their Several and respective Ages of One and Twenty Years And my Will and Desire further is that they and Edward Audley and John Waller Shall receive the Rents Issues and Profits of my said ffreehold Estates and pay and apply the same in the Maintenance and Education of my said Children or such Part thereof as they shall think necessary And my Will and Desire that they shall from time to time deduct all reasonable Cost and charges for their Trouble and loss of time and expences on Account of the Trusts in them hereby reposed and of this my last Will and Testament in and by which I revoke all and every other I ever made I make and Appoint the said Edward Audley and John Waller Joint Executors In Witness whereof to this my Will contained in Two Sheets of Paper to the ffirst have put my hand and to the last my hand and Seal this ffour and Twentieth day of March In the Year of our Lord One thousand Seven hundred and Sixty two Thomas Jordan his Mark
