The Will of Edward Jenden

 

In the Name of God Amen I Edward Jenden of Horsham in the County of Sussex Currier being weak in Body but of sound and disposing mind and memory and understanding Thanks be to Allmighty God Doe make and ordaine this to be my last Will and Testament hereby revoking all former Wills by me heretofore made and as touching the money whereby it hath pleased Allmighty God to bless me I give devise and bequeath & dispose thereof in manner following And first I give and devise unto my sonne Edward Jenden All that one feild situate in the parish of Horsham aforesaid outhouses and Barn Containing by Estimacion Three Acres of Land more or less in my own occupacion with the stables thereto belonging and other the premises with the appurtenancescalled or known by the name of Billings or by what other name soto To Hold the said feild & stable with the appurtenances unto my son Edward and his heires and assigns forever But my Will and Meaning isand I doe hereby Will and direct that in case my said son shall happen to dye before he shall attain the age of one and twenty years without issue of his Body lawfully begotten Then I give and devise the said feild and stable and the appurtenances unto my loving brother Phillip Jenden of Horsham aforesaid Cordwainer and to his heires and assigns forever Also my Will and desire is that my Trustees hereafter named as soon as may conveniently be after my decease should sell and dispose of all and singular my Goods and stock (save such part of my household goods as they shall think proper to save for my son) and the monies therebyarising to be put and placed out at Interest for the benefit of my said Son and also to get in all my Debts as shall be owing to me at the time of my Decease (so many person or persons whatsoever or Book Bond or Note or otherwise howsoever ) which Debts when collected to be applied for the benefit of my Son And my Will and meaning further is that in case my said son shall happen to dye and Depart this life before he shall attain the age of one and twenty yeares and have no issue of his body lawfully begotten then out of the monies left at the time of his decease I give and bequeath the sum of fforty ffive pounds (if so much) separate and apart from her husband to be by her disposed of as she shall think proper and also one large Chest of Linnen in the Buttery Chamber and my late Wife's Linnen Clothes to be delivered to her in six months next after the Death and Decease of my said son in case he shall dye before the age of twenty one years without Issue by my Trustees hereinafter named and that her discharge shall be sufficient without any regard to her husband To William Jenden my brother tenn pounds To John Jenden my brother tenn pounds To my kinsman William Jenden son of my brother John Jenden ffive pounds residue and remainder of the said fforty five pounds to be paid to them respectively in the same manner as the Legacy of twenty pounds before mentioned is appointed to be paid but in case the money shall fall short Then each Legatee to take in proportion And in case there shall happen to be more money than will pay and satisfy the said fforty five pounds Then What is over and above And allother my Goods Chattles Personall Estate what is over or shall remain I give and bequeath the same unto my brother Philip Jenden and his Assigns as his proper Goods and Chattles for ever and I do hereby nominate constitute and appoint my said Brother Phillip Jenden and Anstell Coom of aforesaid Gentleman as Trustees and Executors of this my Will and Testament and do hereby commit the care and Guardianship of my said son to them and the survivors of them until he shall attain to the said age of one and twenty years and do hereby Will and direct that they shall detain to themselves all reasonable Charges and Expences which they or either of them shall be at or put unto relating to the Guardianship hereby in them reposed and that neither of them shall be lyable or chargeable for the Act or deed of Oath of the other or for the loss of any moneys that may be placed out at Interest unless it appear that it was by their willfull neglect the same were lost And lastly I I do make ordain constitute and appoint my said brother Phillip Jenden and the said Austen Coom joynt Executors and Trustees of this my Will for the purposes aforesaid desiring and requiring them to take care and see my son brought up with the proper education suitable for him and to place him on the world to some business which he shall appraise of and likewise to see all my just debts payd and satisfied In Testimony whereof I have hereunto set my hand to this my last Will & testament contained in three sheets of paper at the bottom of each sheet thereof this Second Day of April in the year of Our Lord one thousand seven hundred and thirty five       Edward Jenden
